HomeMy Public PortalAboutBy-Law 2006-38 Adopt a Policy for Changing of Names of Roads and StreetsCORPORATION OF THE MUNICIPALITY OF TWEED BY-LAW NO. 2006-38 Being a By -Law to adopt a policy for the changing of names of roads and streets in the Municipality of Tweed. WHEREAS the Municipal Act, 2001 gives general authority for councils to adopt policies; AND WHEREAS Section 47 of the Municipal Act, 2001 gives authority for councils to name or change names of highways; AND WHEREAS the Council of the Corporation of the Municipality of Tweed deems it expedient to adopt a policy to set out the procedures for the changing of names of roads and streets in the Municipality of Tweed; NOW THEREFORE the Council of the Corporation of the Municipality of Tweed enacts as follows: 1. That the Policy for Changing the Names of Roads and Streets attached hereto as Schedule "A" to this by-law is hereby adopted as the Municipality of Tweed policy for the changing of the names of roads and streets in the Municipality of Tweed. 2. That this by-law shall come into force and take effect immediately upon the passing thereof by the Council of the Corporation of the Municipality of Tweed. O REEVE 0)6kAA(4, V 2 CLERK Schedule "A" CORPORATION OF THE MUNICIPALITY OF TWEED O 0 POLICY for CHANGING NAMES of ROADS and STREETS This Policy for the Changing of Names of Roads and Streets in the Municipality of Tweed is issued under the authority of the Council of the Corporation of the Municipality of Tweed in accordance with By -Law No. 2006-38 dated September 19, 2006. CORPORATION OF THE MUNICIPALITY OF TWEED POLICY for CHANGING NAMES OF ROADS and STREETS The following provisions pertain to the changing of names of roads and streets in the Municipality of Tweed. The changing of names of roads and streets in the Municipality of Tweed may be initiated by one of the following methods: O O i. Request from a member of the public to change the name of a certain road or street. ii. Council decision to change the name of a certain road or street. Section 47 of the Municipal Act, 2001 provides that before passing a by-law naming a highway or changing the name of a highway, a municipality shall give public notice of its intention to pass the by-law. The provisions of Section 47 of the Municipal Act, 2001 shall be pertain to all changes to names of roads and streets in the Municipality of Tweed. REQUESTS FROM PUBLIC FOR ROAD / STREET NAME CHANGE The following procedures shall be undertaken upon receipt of a request from a member of the public for a change in the name of a road or street. 1. Written request for name change, with applicable reason(s), provided to Council. 2. Historical significance of existing road / street name investigated by municipal staff. 3. Estimate of applicable costs of road / street name change investigated by municipal staff and provided to applicant. Costs to include but not limited to the following: cost of road / street name sign and cost of installation of sign; cost of implementation of road / street name change in 911 database; administration costs including postage and photocopies. 4. Written notification of name change request provided by municipal staff to all residents of subject road / street. Notification to include request for return of written consent to proposed name change . The following process shall be undertaken following completion of the above: 1. Report provided to Council at regular meeting. 2. Council approval to the name change given subject to the following: Page 2 - Road Name Change Policy i. No historical significance of existing road / street name found; and ii. Written consent to the road / street name change received from all residents of the subject road / street; and iii. Payment of applicable costs of road / street name change is received from applicant. 3. Council approval to the name change denied subject to the following: i. Historical significance of existing road / street name is proven; or, ii. Written consent to the road / street name change is not received from all residents of the subject road / street. 4. Public notification of Council's intention to pass a by-law for the road / street name change is given in accordance with Section 47 of the Municipal Act and the Municipality's by-law for the giving of notice. 5. By-law for the changing of the name of the road / street passed by Council. 6. Information on the name change forwarded to County of Hastings for implementation in the 911 database. 7. Written notification to all affected residents given by the Municipality. COUNCIL DECISION TO CHANGE ROAD / STREET NAME The following procedures shall be undertaken if Council determines that a change in the name of a road or street should take place. 1. Historical significance of existing road / street name investigated by municipal staff. 2. Estimate of applicable costs of road / street name change investigated by municipal staff. Costs to include but not limited to the following: cost of road / street name sign and installation of sign; cost of implementation of road / street name change in 911 database; administration costs including postage and photocopies. 3. Written notification of name change request provided by municipal staff to all residents of subject road / street. The following process shall be undertaken following completion of the above: 1. Staff report provided to Council at regular meeting; report to include the following: O Page 3 - Road Name Change Policy i. Information on historical significance of existing road / street name. ii. Comments received from residents of subject road / street regarding proposed change. 2. Council approval to the name change given subject to consideration of the report, including historical significance of existing road / street name found and comments received from residents. 3. Public notification of Council's intention to pass a by-law for the road / street name change is given in accordance with Section 47 of the Municipal Act and the Municipality's by-law for the giving of notice. 4. By-law for the changing of the name of the road / street passed by Council. 5. Information on the name change forwarded to County of Hastings for implementation in the 911 database. 6. Written notification to all affected residents given by the Municipality. a
