HomeMy Public PortalAboutBy-Law 2010-17 Adopt Harassment in Workplace PolicyCORPORATION OF THE MUNICIPALITY OF TWEED BY-LAW NO. 2010-17 Being a By -Law to adopt a Harassment in the Workplace Policy for the Municipality of Tweed. WHEREAS the Municipal Act, 2001 provides the general authority for Councils to adopt policies; O v AND WHEREAS the Occupational Health and Safety Act has been amended by Bill 168 which requires worker protection from violence and harassment in the workplace and which requires employers to prepare written policies with respect to workplace violence and workplace harassment; NOW THEREFORE the Council of the Corporation of the Municipality of Tweed enacts as follows: 1. That the Policy for Harassment in the Workplace attached hereto as Schedule "A" to this by-law is hereby adopted as the policy for addressing harassment in the workplace. 2. That this by-law shall come into force and take effect immediately upon the passing thereof by the Council of the Corporation of the Municipality of Tweed. Read a first and second time this 8th day of June, 2010. Read a third and final time, passed, signed and sealed in open Council this 8th day of June, 2010. _ ORA CLERK I) Harassment in the Workplace Policy The Corporation of the Municipality of Tweed is committed to providing a work environment in which all individuals are treated with respect and dignity. It is crucial that, in the workplace, everyone, regardless of their role or position in the organization, conduct themselves in a respectful and professional manner. Workplace harassment will not be tolerated from any person in the workplace. Everyone in the workplace must be dedicated to preventing workplace harassment. Department Heads, managers, supervisor and workers are expected to uphold this policy, and will be held accountable by the Municipality of Tweed. Any workplace harassment will be regarded as a serious offence. A copy of this policy will be posted in the workplace. Workplace harassment means engaging in a course of vexatious comment or conduct against a worker in a workplace — a comment or conduct that is known or ought reasonably to be known to be unwelcome. Harassment may also relate to a form of discrimination as set out in the Ontario Human Rights Code, but it does not have to. Workers are encouraged to report any incidents of workplace harassment. Management will investigate and deal with all concerns, complaints or incidents of workplace harassment in a fair and timely manner while respecting workers' privacy as much as possible. Nothing in this policy prevents or discourages a worker from filing an application with the Humans Rights Tribunal of Ontario on a matter related to Ontario's Human Rights code within one year of the last alleged incident. A worker also retains the right to exercise any other legal avenues that may be available. This policy will be reviewed at least annually. Dated at the Municipality of Tweed this ' day of June, 2010.
