HomeMy Public PortalAboutBy-Law 2014-12 Adopt Policy for Use of Corporate Resources for Election PurposesCORPORATION OF THE MUNICIPALITY OF TWEED BY-LAW NO. 2014-12 Being a By -Law to adopt a Policy for Use of Corporate Resources for Election Purposes Municipality of Tweed. WHEREAS the Municipal Act, 2001 provides the general authority for Councils to adopt policies; O 0 WHEREAS the Municipal Election Act, 1996 sets out the provisions for municipal election contributions and campaign expenses; AND WHEREAS Council has deemed it expedient to set a policy for municipal elections contributions and expenses, including use of corporate resources; NOW THEREFORE the Council of the Corporation of the Municipality of Tweed enacts as follows: 1. That the Policy for Use of Corporate Resources for Election Purposes attached hereto as Schedule "A" to this by-law is hereby adopted as the policy for the use of corporate resources for election purposes in the Municipality of Tweed. 2. That this by-law shall come into force and take effect immediately upon the passing thereof by the Council of the Corporation of the Municipality of Tweed. Read a first and second time this 25th day of March, 2014. Read a third and final time, passed, signed and sealed in open Council this 25a` day of March, 2014. By -Law No. 2014-12 Schedule 'A' MUNICIPALITY OF TWEED POLICY RE: USE OF CORPORATE RESOURCES FOR ELECTION PURPOSES 0 0 All election candidates, including members of current Council in any municipal election year, are required to follow the provisions of the Municipal Elections Act, 1996. The establishment of guidelines on the appropriate use of corporate resources during an election period protects the interests of both the Members of Council and the Corporation of the Municipality of Tweed. The Municipal Elections Act, 1996 prohibits a municipality from making a contribution to a candidate. The Act also prohibits a candidate, or someone acting on the candidate's behalf, from accepting a contribution from a person who is not entitled to make a contribution. A contribution may take the form of money, goods or services. Use of the Corporation's resources by a member of Council for his or her election campaign would be viewed as a contribution by the Municipality to the member, which is a violation of the Act. Specifically, > No candidate shall use the facilities, equipment, supplies, services, staff or other resources of the Municipality for any election campaign or campaign related activities. > No candidate shall undertake campaign -related activities on Municipality property during regular working hours. > No candidate shall use the services of persons during hours in which those persons receive compensation from the Municipality.
