BY-LAW NO. 2015-25
Being a By -Law to establish the procedures by which land severances will be granted in
the Municipality of Tweed, and to repeal By -Law No. 2002-30 and By -Law No. 2004-25.
WHEREAS Section 50(1) of the Planning Act, R.S.O. 1990 provides that consent for
subdivision of land is given by the council of the county where the land is situate within a
local municipality that forms part of a county for municipal purposes;
AND WHEREAS Section 53(1) of the Planning Act, R.S.O. 1990 provides that a council
of a municipality may impose certain conditions on land severances, consents and
subdivisions;
NOW THEREFORE the Council of the Corporation of the Municipality of Tweed enacts
as follows:
1. That the following conditions shall be imposed on all land severances in the
Municipality of Tweed:
i) All realty taxes for the subject property of the severance application shall be
paid in full;
ii) The severed parcel of land shall be zoned for the purpose or use intended
for the land;
iii) A parkland fee in the amount of $750.00 shall be required for each severed
parcel of land;
iv) Road widening shall be required on all severed parcels of land in accordance
with the Policy for Road Widening for Severances adopted by Municipality
of Tweed By -Law No. 2005-36 and dated March 15, 2005;
v) A satisfactory entrance onto a fully maintained municipal roadway can be or
has been established for each severed parcel of land, if such parcel fronts
upon a fully maintained municipal roadway. Location of site entrance shall
be subject to the satisfaction of the Public Works Manager.
vi) Proper ditching and drainage across the frontage of the severed lot shall be
required to the satisfaction of the Public Works Manager.
2. That By -Law No. 2002-30 and By -Law No. 2004-25 are hereby repealed in their
entirety.
3. That this By -Law shall come into force and take effect immediately upon the
passing thereof by the Council of the Corporation of the Municipality of Tweed.
