WHEREAS pursuant to "Sewer System Establishment and Financing Bylaw No. 141, 1964" the Council of the Town of Oliver hereinafter referred to as the Municipality, caused to establish a sewer system and constructed a sewer system to serve the Municipality and was further authorized to operate and maintain the said sewer system; AND WHEREAS pursuant to the Community Charter the Council may by Bylaw impose a charge against the owner or occupier of real property for the use of the Municipal Sewer System, and may vary the charge in accordance with the number of outlets served or the quantity of water delivered to the premises by a utility or by classifying users or effluent or by any combination of such methods; NOW THEREFORE the Council of the Town of Oliver, in open meeting assembled, enacts as follows: 1. All users of the municipal sewer system shall pay the rates and charges as set out in Schedule “A” attached to and forming part of this bylaw. 2. This Bylaw shall come into force and take effect on January 1, 2013. 3. Oliver Sewer User Rates Bylaw No. 1309 is hereby repealed. 4. This Bylaw may be cited for all purposes as "Sewer User Rates Bylaw 1331". Read a first, second and third time on the 26th day of November, 2012. In the case there is a residence accompanying a commercial undertaking without a definite separation of fixtures available to each use, the applicable rate shall be the higher of the two rates but not both. The rate for churches and halls is only intended where the premises are used for holding regular meetings. Where other uses are made of the building the appropriate user rates shall also apply. 2. METERED RATES Where sewer flows for a particular property are determined, by the Director of Operations or his designate, to be in excess of the recoverable flat rate, the property in question will be invoiced based on one of the following: (a) Sewer users with an effluent or sewage flow meter shall be charged at the rate of $1.00 per cubic metre of measured effluent. (b) For commercial metered water users without effluent flow meters, the charge for use of the sewage system shall be calculated as 80% of the recorded volume of metered water used times a rate of $1.00 per cubic metre. 3. OSOYOOS INDIAN RESERVE PARCEL SERVICE FEE All parcels within the Osoyoos Indian Reserve No.1, that are connected to the public sewer system, shall be levied an annual flat rate service fee of One Hundred and Twenty Dollars and Seventy Cents ($120.70). This parcel service fee is in addition to any applicable metered or flat rate user fees. 4. NEW CONNECTIONS Sewer charges commence on a newly constructed or installed building immediately upon the expiration of six months (one month in the case of a renovated building) from the date of validation of the building permit, provided however, that this amount will be pro-rated monthly from the effective date to December 31 of the year in which the building is built or renovated. SCHEDULE “A” – SEWER FEES AND CHARGES (continued) An extension to the 6 month period will be considered providing the builder applies in writing to the Building Official prior to the expiration of the 6 month period. Should a request come from a builder after the expiration of the six month period, an extension may still be granted upon payment of an administration fee of $15.00 for the first unit and $5.00 for each additional unit in the same complex. Extensions will be in multiples of one month periods, and are at the discretion of the Building Official based on projected construction completion date. B. PENALTY/DUE DATE Sewer charges as set forth in Schedule A shall be invoiced for sewer use for each calendar quarter. Any sewer charges remaining unpaid 30 days after date of invoice shall have a penalty of 10% of the unpaid balance added thereon. 3. OSOYOOS INDIAN RESERVE PARCEL SERVICE FEE Osoyoos Indian Reserve Parcel Service Fees, as set forth in Section A 3 of this schedule, shall be invoiced in conjunction with the metered water invoices that are issued following June 30 in each year and shall be due on the date specified on the invoice, which shall not be less than 30 days after the date of the invoice. Any Osoyoos Indian Reserve Parcel Service Fees remaining unpaid after the due date of the invoice shall have a penalty of 10% of the unpaid balance added thereon. 4. ADMINISTRATIVE AUTHORIZATION Notwithstanding any provisions in Sections A or B, the Chief Financial Officer, or his designate, may authorize an adjustment for a period of up to three years to correct an error made by the Town.
