D BUSINESS ARISING OUT OF PRIOR MINUTES
E WATER MATTERS
E-1 Washout at Chokecherry Lane
On Monday, April 18, 2016, a washout occurred at Mr. Gill’s property
on Chokecherry Lane. Mr. Gill is requesting assistance from the Town
of Oliver to clean the silt from his orchard.
Director of Operation noted that the Town is repairing its infrastructure
but will not be cleaning the orchard as fault cannot be determined.

Recommendation:
THAT this matter be brought forward to the Regular Meeting of April 26,
2016; to consider; and
THAT Council direct staff to report back on the legal circumstances of
immunity under the Local Government Act, the facts of the washout,
damage, and cost to repair.
