Council (continued) April 27, 2023 192 NEW BUSINESS 11.5 Request for Decision prepared February 28, 2023 - Financial & Information Services - Council Chamber Upgrades (Electronic Meetings). Material to follow. Cliff Gall, Director of Information Services reported to Council that it has been a challenging journey since beginning of COVID - meetings with iPads, and back to the office with hybrid meetings with staff and people joining from the outside world - people need to see that. What we have done to date has always been temporary and it doesn’t address accessibility. He asked members of Council what they would like to have improved. Comments by Councillors:  Poor picture quality;  Garbled audio;  Talking over one another;  The Owl system doesn’t work the best;  Better microphones;  Linking people in and watching them on a screen is awkward;  Not speaking in turn and difficulty knowing who is to speak next. The Director of Information Services then provided an overview of what the new system is capable of, i.e., push to talk allows the camera to focus on the Councillor speaking, electronic voting, blue tooth capability, queuing system for speakers, screen for sign language, etc. He noted that the only adjustment would be on the first recommendation it should include “net HST” as there may be a bit of change in the price. 2023-226 MOVED by Councillor Assaff, SECONDED by Councillor Veinotte that Council: 1. Permit staff to work with Backman Vidcom Ltd. For the supply of audio-visual goods associated with upgrades in Council Chambers in the amount of $115,00 net HST, funded from the Operations Reserve; 2. Authorize the use of push to talk functionality on desk microphones, enabling automated camera tracking during Council meetings; and 3. Authorize the use of electronic voting during Council meetings. DISCUSSION: Councillor Veinotte asked about alternative procurement and the Director of Information Services indicated that the province held a competition on audio-visual supply and Backman Vidcom Ltd. was the successful bidder on the Provincial Standing Offer Listing. MOTION CARRIED. 6.3 Building Code & Unsightly Premises Committee - April 20, 2023 - Request for Decision prepared April 20, 2023 - Community Development & Recreation - Order to Remedy. Brendan Mosher, By-Law Enforcement Officer reviewed the Request for Decision prepared April 20, 2023 regarding the unsightly premises at 80 Commons Road. 2023-231 MOVED by Deputy Warden Shatford, SECONDED by Councillor Assaff Council approve staff to work with legal Counsel on the issuance of a Summary Offense Ticket to the property owners of 80 Commons Road based on section 344 and section 348(4) of the Municipal Government Act for failing to abide by the Order previously served along with a Long Form Information so that the Municipality can also seek to have the property cleaned up pursuant to section 505(4). DISCUSSION Additional properties that are in similar or worse condition. The intent is to work with owners before it gets to this stage. If the owner(s) clean up the property, the ticket can be withdrawn. Concern that the Municipality is being too lenient and allowing things to take so long to rectify. ALL IN FAVOUR. MOTION CARRIED. 6.4 Lunenburg County Seniors’ Safety Program - March 2023 - Councillor Connors. Councillor Connors reviewed the meeting held yesterday providing good news by way of a grant approved by the United Way of $8,750. She reported that are working on the four-year strategic plan and what they are focused on. There has also been a part time person start on the committee to augment the work of the Coordinator. She noted that they will be coming into Council at a future meeting to give a brief update during the public input portion of the meeting. PUBLIC PRESENTATIONS There were no public presentations. Council (continued) April 27, 2023 197 BY-LAWS AND POLICIES BY-LAWS: 8.1 Second Reading - Adoption of By-Law 154 Property Assessed Clean Energy (PACE) By-Law. The CAO provided a brief overview. 2023-232 MOVED by Councillor Church, SECONDED by Councillor Assaff that Council conduct Second and Final Reading of By-Law 154 Property Assessed Clean Energy (PACE) By- Law. ALL IN FAVOUR. MOTION CARRIED. POLICIES: 8.2 Second Notice - Amend Policy P-40 Promotional Advertisement Policy to update the policy. 2023-233 MOVED by Deputy Warden Shatford, SECONDED by Councillor Wells that Council conduct Second/Final Notice to amend Policy P-40 Promotional Advertisement Policy. ALL IN FAVOUR. MOTION CARRIED. 8.3 First Notice - Adoption of Policy P-111 Property Assessed Clean Energy (PACE) Program Policy. Refer to Second Notice. Present was Jonathan Meakin, Strategic Initiatives Coordinator to review the process by which the Policy came to Council today for First Notice. He noted that Clean Foundation has agreed to reduce the PACE program fee of $650 to $250 for homeowners who exit the program early before completing any recommended energy upgrades. The interest rate will be the same as the Water Supply Upgrade Lending Program (Scotiabank Prime Interest Rate). Staff applied for and received a Department of Natural Resources and Renewables grant of $15,000 to assist with costs for program marketing and onboarding with Clean Foundation. Next steps will be for the Finance Department to coordinate process details with Clean Foundation and for staff to help boost promotion of the PACE program. 2023-234 MOVED by Councillor Assaff, SECONDED by Councillor Church that: Council allocate $2,400,000 of General Operating Reserve for a Property Assessed Clean Energy (PACE) program. This allocation, along with any interest income earned on cash balance and/or PACE loans, will be used to provide financing for energy Council (continued) April 27, 2023 198 efficiency upgrades to qualifying residential properties within the Municipality in accordance with By-Law 154 and Policy P-111. Any interest income that would increase this balance above $2,400,000 will be returned to the unallocated portion of the reserve. DISCUSSION  The Solicitor commented on the possibility of the lien on the property being missed if there is a sale of the property. His concern was that the new owner may not be aware of the lien and that it should be conveyed in some way.  It was asked if there was a duty to disclose and it was indicated that there was, however, sometimes these types of things may get missed.  It was thought that liens are included on tax certificates.  It was agreed that this was an administrative detail that can be dealt with. MOTION CARRIED. 2023-235 MOVED by Councillor Veinotte, SECONDED by Councillor Assaff that Council conduct First Notice to adopt Policy P-111: Property Assessed Clean Energy (PACE) Program and that the policy be referred to Second Notice. ALL IN FAVOUR. MOTION CARRIED. MATTERS ARISING 9.1 Request for Direction prepared April 20, 2023 - Community Development & Recreation - NS Road Trails Act (Gold River Bridge reconstruction). Fred Whynot, Director of Public Works was present to review the potential of the change to the NS Road Trails Act and possibility of this change allowing ATVs to get from the Croft Road trail intersection to the intersection on Beech Hill Road, due to the inability to use the Gold River Trail Bridge. He noted that the restrictions are still in place, but if Council is interested in exploring the possibility, staff can change the course of action and consider the change to the Act. Concern was noted that it may take years to get from an amendment to a point where there are regulations and criteria. Delaying the construction of the Gold River Trail Bridge may increase costs and it is not confirmation that the change in the Act will give ATV users the use of the road. Councillor Connors indicated that she has made her feelings known about the total cost of the Gold River Trail Bridge at a workshop. This is allowing her to get on the record her belief that if Council (continued) April 27, 2023 199 we proceed with the D Class estimate of $4.2 Million, the cost could be up to $10 Million. It makes sense to pursue what is in front of us today. She acknowledged that what also needs to be determined is who is responsible for the demolition, which is at the cost of the taxpayer. Discussion took place on:  Overruns take place unfortunately.  No criteria on the NS Road Trails Act .  The years it would require to build a bridge, and longer if we wait until the NS Road Trails Act is complete.  Concern about spending millions just to have people without licenses have a way to drive their ATVs.  Add the matter to the May 9th Quarterly Meeting with NS Department of Public Works. 2023-236 MOVED by Councillor Assaff, SECONDED by Councillor Veinotte that Council take no action on the NS Road Trails Act information, procced with the current bridge design, engineering, and construction schedule as previously approved by Council. THREE IN FAVOUR. FOUR OPPOSED. MOTION DEFEATED. It was agreed to speak with the NS Department of Public Works at the next quarterly meeting and advise them this is a topic to be discussed. Councillor Veinotte confirmed that the plan for the construction of the bridge is not cancelled. We are just exploring the province’s appetite for this. When engineering is complete and comes back to Council there will be more opportunity to discuss. Councillor Veinotte asked how the plans are coming along and the Director of Public Works noted that they are waiting for geotechnical information and hope to have something before fall of this year. Warden Webber confirmed that we are not able to provide an alternate route at this time. Councillor Assaff voiced concerns of his residents as they are hoping to get some kind of answer and they don’t want to see it years and years down the road. The CAO left the meeting to attend another matter. BREAK 9:48 a.m. to 10:02 a.m. Council (continued) April 27, 2023 200 CORRESPONDENCE 10.1 NS Utility and Review Board Decision - Boundary Review. The Boundary Review Decision from the NS Utility and Review Board was received as information. 10.2 Correspondence dated April 11, 2023 from Office of the Minister of Public Works regarding traffic calming policy. Councillor Wells commented that this is important to know when we receive complaints about speeding - we can say province is coming out with a policy to deal with traffic calming. NEW BUSINESS 11.1 Request for Direction prepared April 19, 2023 - Corporate & Strategic Management - Industrial Park Development Fund. Erin Lowe, Senior Economic Development Officer was present to review the Request for Direction prepared April 19, 2023 regarding an Industrial Park Development Fund. Currently there is no policy that allocates revenue from the Industrial Park to any particular use. The fund will provide directions on spending the funds. She also noted that there is more information on the website and will bring back more information to Council on the plan once it is prepared. 2023-237 MOVED by Deputy Warden Shatford, SECONDED by Deputy Warden Shatford that Council direct staff to develop an Industrial Park Development Fund Policy ALL IN FAVOUR. MOTION CARRIED. 11.2 Information Report prepared April 18, 2023 - Corporate & Strategic Management - Economic Development Sponsorships Update. Erin Lowe, Senior Economic Development Officer was present to review the sponsorship approved to date for $100 to Golf 4 Charity. 11.3 District 1 Council Grants Request 2022/23 - Ocean Swells Community Association $1,950. MOTION CARRIED. 11.4 All Districts Council Grant Request 2023/24 - FHCS Prom Committee 2023 - $2,100. 2023-239 MOVED by Councillor Church, SECONDED by Councillor Assaff that Council approve District Council Grant Requests from all 7 districts in the amount of $300 each (total of $2,100) to the FHCS Prom Committee 2023. ALL IN FAVOUR. MOTION CARRIED. 11.6 Request for Decision prepared April 18, 2023 - Corporate & Strategic Management - Loan Guarantee request for Western Shore Fire Commission. Bruce Blackwood, Fire Services Coordinator was present to review the Request for Decision regarding a loan guarantee request from the Western Shore Fire Commission for the purpose of the acquisition of a firefighting pumper truck in the amount of $155,500. 2023-240 MOVED by Councillor Assaff, SECONDED by Deputy Warden Shatford that Council approve the Guarantee Resolution to guarantee a $155,500 loan for the Western Shore Fire Commission for the purchase of a firefighting pumper truck, and hereby authorize the execution of the Guarantee Resolution as provided. ALL IN FAVOUR. MOTION CARRIED. 11.7 Church Memorial Park AGM - Councillor Connors. Councillor Connors asked the date of the Church Memorial Park Annual General Meeting and Councillor Church indicated that they are waiting for the financial reports and would hold the meeting after that time. Each year, it organizes the International Day Against Homophobia and Transphobia (May 17), which was created by the Foundation for the first time in the world, in Quebec, in 2003. This day is now recognized nationally and internationally. For last year's International Day Against Homophobia and Transphobia, Fondation Émergence sent a pride flag (rainbow) to every municipality in Quebec. For this year, we’re trying to reach out to every municipality in Canada, this will send a stronger message to the government that the population stand with the LGBTQ+ community. We also invite you to adopt a resolution at City Council to mark this important day (see attached template in the email). Last year 287 municipalities showed their support for LGBTQ+ people, join the movement to help us reach a new record this year for the 20th anniversary of the Day. We appreciate your interest in working with us, and I'm looking forward to discussing this further. Regarding the cost estimates, we understand the importance of consistency in determining the connection fees for developments within the municipality. However, we also believe that a development the size and scope of Chester Hills may require a different category of fee due to its significant impact on the municipality. While consistency is important, it should not be conflated with uniformity. The nature of each development project is unique, and therefore requires a tailored approach to ensure equitable and effective outcomes. As we previously mentioned, our calculation of $1750 per unit is based on the infrastructure required to install an on-site system versus connecting to the central sewer service, and while we used $1750 x 250, our proposal is only for the residential lots. We expect a different fee for the multi-residential lots, which we suggest should be in line with other rural municipalities, such as $1500 per unit.
 We appreciate that funding has been secured for the expansion and upgrade of the sewer system, indicating that the municipality and other levels of government are keen to invest in the area and see development. Our efforts here are to create the most sustainable and attractive development to the benefit of everyone in the municipality, while also ensuring that the costs to onboarding users are not prohibitive. In this regard, we propose that the fee of $1750 be considered an “inspection fee” for new sewer connections, as we will be handling all of the engineering costs and practical connection costs for each unit ourselves. As part of our proposal for consistency perhaps Chester would consider when a developer is building new roads and installing sewer mains, laterals, and so on, an inspection fee is required. However, in the event a new development requires Chester to handle the engineering, excavation, etc. a connection fee of $6000 applies. We believe that our proposal is reasonable and will benefit both our development and the municipality. We appreciate your consideration and look forward to discussing this further with you. Our purpose for writing to you is to open a conversation regarding the connection fees for the wastewater service for Chester Hills and to discuss whether it is in everyone's best interest to move ahead with central service rather than an on-site system. We would like to provide you with a brief history of our development proposal. When we first began with the Chester Hills development application, the parcel was completely unserviced. As such, our proposed development was designed as a bareland condo to allow shared wells and a shared on-site septic system. This would result in a significant area of the natural landscape being cleared to allow for a large septic field. Feedback from the public information session indicated that there is great opposition to clearing land for a septic field, and all efforts should be made to preserve the natural landscape. Once Chester committed to expanding the central wastewater service to our lot, this was seen as a preferred option for the reasons described, and we proceeded to price out the implementation of the infrastructure required for us to connect to the central wastewater service. The figure quoted was $820,125.00 for wastewater alone. In addition to the wastewater efforts, we have drilled wells for testing and have confirmed we will be establishing a private water utility that will service Chester Hills, which will allow the bulk of this project to move from a Development Agreement to a Subdivision. This will enable us to move the start date of the project up by several months. Our desire has always been to design and develop a new neighbourhood that is complimentary to the existing community of Chester and one that can be successful in the current real estate market. Like our neighbours, we believe that it is a notable benefit to the community to have as much of the natural landscape remain undisturbed by connecting to the central wastewater system. We also believe that there is a greater benefit to all of Chester by bringing online approximately 250 units, which will generate considerable tax revenue for the municipality. We are aware that Chester currently intends to codify a wastewater connection fee of $6000 per lot and $3500 for additional units on the same lot. In the case of our development, this burden is simply too high for our currently proposed development. The $6000 fee is higher than what developers see in HRM, which is a much stronger real estate market, but with similar building costs. We take into account that in the case of central wastewater and Chester Hills, the municipality would need to extend and expand the current system. We also understand that a portion of that extension has been funded by provincial and federal grants. As we can all appreciate, the extension of your system to service Chester Hills stands to be mutually beneficial. We presented a proposal of $1750 per dwelling (not inclusive of multi-residential buildings). This was calculated by determining the difference between us engineering and implementing an on- site septic system, versus supplying and installing the necessary infrastructure required on our 53-acre parcel for the central wastewater system. We felt the calculation would be a fair amount allowing for benefits for both parties. We proposed this amount knowing that other rural communities do not typically levy additional connection fees to developers when they are implementing the infrastructure to the individual building lots. Further, we have concerns about passing the cost on through the 10-year amortized tax vehicle. With interest rates and inflation, the cost to build is higher than it has ever been. The biggest conversation in development circles within our housing crisis is affordability. How do we build quality products and maintain a level of affordability? Adding additional taxation costs could very well impact the salability of the homes. Without sales, there can be no development. We are happy to engage in additional creative measures to see this development be a success for all involved, including the greater municipality. POLICY 2.01 Evaluation (a) Section 2.03 of this Policy lists the eligible Clean Energy Upgrade types that may be financed. Each type of upgrade must be evaluated by a specific energy evaluation procedure and may need to conform to a particular energy standard, which is identified beside each upgrade type. The required evaluation procedure or standard ensures that the upgrade is studied from an energy science perspective, and that a definable energy benefit is determined. (b) In administering this Policy, the Municipality, through an Agreement for Services with the Program Provider, will ensure that any Clean Energy Upgrades requested by property owners to be financed through the PACE program are identified as being eligible types in Section 2.03. Furthermore, the Municipality, through an Agreement for Services with the Program Provider, will ensure that for each requested upgrade the required evaluation procedure or standard has been met and that a definable energy benefit has been determined or recommended by a qualified energy professional. These minimum conditions must be met before permitting a requested upgrade to be financed on a Qualifying Property. There is no cost to maintain this facility until it is used, at which point the costs would be interest charges for amounts drawn. CURRENT SITUATION Staff have prepared proposed signage locations, size, design and budget for the production and installation of 6 municipal welcome signs. BACKGROUND At the May 21, 2021, Council meeting, Staff were directed to prepare a report on the costs for adding welcome signs at the entrance of the Municipality in Martins River, New Ross, and Hubbards. In addition, at the July 15, 2021, Council meeting, Council discussed a request from a resident to consider adding Mi’kmaw community names to municipal signage. Staff were directed to research which community name signs or welcome signs were owned by the Municipality. Corporate & Strategic Management prepared an Information Memo for the August 16, 2021, Council meeting which outlined the signs that were owned by the Municipality and their associated costs for Councils consideration. Potential sign locations were also discussed, with the conclusion to have welcome signs at all entrances to the Municipality. Staff were directed to come back to Council with information on costs and locations for these signs. At this meeting, Council also determined that the signage should be metal and approximately the same size as the sign near the Chester Home Hardware location. At the November 17, 2022, Committee of the Whole meeting Staff prepared a Request for Direction with the proposed signage locations. Staff were directed to come back with reduced sign size, consultation with Acadia first nations, and consideration of French wording. DISCUSSION Staff have identified the proposed signage locations at all entrances to the Municipality highlighted on the map in Attachment 1. Proposed locations have been selected based on the municipal border. These locations have not yet been visited by Staff. Signage (metal sheets, printing and posts) cost for six signs is $2,400 plus HST. Installation will be completed by MOC Public Works staff and will require some additional parts not to exceed $1,600 plus HST. The signs will be sheeted aluminum and 4ft by 3ft in size. Acadia First Nation indicated to Staff that they are not opposed to having “Pjila’si” included on the municipal welcome sign. The proposed sign design is included as Attachment 2. The sign size has been reduced to 4ft by 3ft (from 8ft by 5ft as previously presented to Council). OPTIONS 1. CURRENT SITUATION The Deep Cove Property Owners’ Association requests that the Municipality collect street improvement and maintenance fees on behalf of their association. The Deep Cove Property Owners’ Association is registered with the Nova Scotia Registry of Joint Stock Companies under the Societies Act (Registry ID 4330126). The association has submitted supporting documentation found in the attachment of this report. BACKGROUND Bruce Lever, a member of the Deep Cove Property Owners’ Association, has requested that the Municipality collect street improvement and maintenance fees on behalf of their association. These fees will be used to provide for annual street maintenance such as plowing, mowing, brush removal, ditch maintenance, and culvert repairs and/or culvert replacement. The fees will also be used for street improvement that will include adding road materials and the extension of Larch Lane. Bruce Lever has submitted an annual street maintenance budget for 2023/24 of $5760 and a street improvement budget for 2023/24 of $2500 for forty-three (43) affected properties to be calculated by the “Per Owner” method as described in the Private Street Improvement & Maintenance By-Law. A petition package has been circulated to determine if support exists to implement this fee, collected by the Municipality of Chester as a special tax, to cover improvements and annual maintenance costs required for the street. Based on the signed and returned petitions, sufficient support has been received to proceed. As per the Private Street Improvement & Maintenance By-law, 67% of the owners of real property, who also represent 67% of the real property in the affected area (see attached map) must provide positive responses to the petition. There are forty-three (43) eligible properties within the affected area. Thirty-three (33) of these properties have had positive responses from the property owners, which represents 76.74% of the total number of affected properties and represents 80.61% by area of the real property within the total affected area (see enclosed map). The forty-three (43) eligible properties have thirty (30) unique owners, and positive responses have been received by 70% of these unique property owners. It is worth mentioning, that the method of calculating the number of owners for billing purposes is different from the method of calculating the number of owners for voting purposes. It was recorded on the received petitions that of two property owners are decreased. At this time, staff recommend that Council accept the signed petitions and direct Finance Staff to implement the street improvement and maintenance fee requested by the Deep Cove Property Owners’ Association. OPTIONS 1. Municipal Council can approve the request and accept the petition package for private street improvement and maintenance, and direct finance staff to implement a special tax for the affected accounts. 2. Municipal Council can decide not to approve the request. Collection of fees to maintain the private street will remain solely with the private landowners. 3. Municipal Council can defer making a decision and request additional criteria or information. IMPLICATIONS By-Law/Policy Private Street Improvement and Maintenance By-Law No. 72. Financial/budgetary As noted in the section 4 of the Private Street Improvement & Maintenance By-law #72, the total amount of the special tax levied by the Municipality under this By-Law shall not exceed the cost of the street improvements and/or maintenance plus interest and an administration charge of five percent (5%). The Deep Cove Property Owners’ Association has submitted an annual street maintenance budget for 2023/24 of $5760 and a street improvement budget for 2023/24 of $2500. My Municipal Clerk NOVA SCOTIA'S TREASURE Municipality of the District of Chester Private Street Improvement and Maintenance By -Law By -Law No. 72 Effective Date: September 14, 2022 Private Street Improvement and Maintenance By -Law #72 (continued) Page 2 of 12 MUNICIPALITY OF THE DISTRICT OF CHESTER PRIVATE STREET IMPROVEMENT AND MAINTENANCE BY-LAW BY-LAW # 72 This By -Law shall be known as the "PRIVATE STREET IMPROVEMENT AND MAINTENANCE BY-LAW" In this By -Law, unless the context otherwise indicates: 2.1. "Cost" means the amount of money paid or payable in respect of the street "improvement and/or maintenance." 2.2. "Improvement" means laying out, opening, constructing, upgrading, and improving. 2.3. "Maintenance" means repairing and maintaining. 2.4. "Municipality" means the Municipality of the District of Chester. 2.5. "Owner" includes part owner, joint owner, tenant -in -common orjoint tenant of the whole or part of any real property fronting on a street or situate within an affected area and also includes any trustee, executor guardian, agent or other person having the care or control of such real property in the case of absence or disability of the person having the title thereto provided that for the purpose of calculating the percentage of owners in Section 3(1) real property with more than one owner shall be counted as having one owner. An Owner is entitled to one vote for each individual property parcel they own within the Defined Area. In the case where an individual property has more than one Owner, all Owners must agree on the single response. If all Owners are not in agreement, it will be deemed that the Owner's response is negative. 2.6. "Special Tax" means a tax in respect of the street improvement and/or maintenance based on a per lot basis, a frontage basis, per owner or an area rate based on $100.00 of assessment, as requested in the petition. 2.7. "Street" means any private street, roadway, highway or travelled way, or portion thereof, situate in the Municipality but does not include any unopened or undeveloped street unless specifically included in the Plan attached to Form "A" of the Petition of the owners. 2.8. "Association" means a body corporate incorporated under the Societies Act which represents the owners within the affected area. "Affected Area" means that area within which the owner shall be liable for the special tax levied pursuant to this By -Law, and which is shown on the Plan attached to Form "A" of the Petition of the owners and shall include any subdivision shown therein. 2.10. "Interest" means that rate of interest charged to the Municipality from time to time on the money borrowed for the improvements which the Municipality shall be entitled to recover from the owners as part of the special tax. 2.11. "Approved purpose" means those purposes for which a Municipality is authorized to expend money pursuant to the Municipal Government Act. 2.12. "Applicant" means the Association referenced in section 2.8 and which has the right itself, or on behalf of the Owners, to maintain the Street. 2.13. "Dwelling" means a residential unit as identified by the Property Valuation Services Corporation filed roll. 3.1 Where sixty-seven (67%) of the owners of real property owning at least sixty-seven (67 %) of the real property within an affected area petition in person or by agent the Municipality for an improvement and/or maintenance of a street, for an approved purpose which may be within or outside the affected area or both, the Municipality may make such improvements, and/or provide for such maintenance if it determines that such improvement and/or maintenance carries out an approved purpose and if so shall be entitled to recover all of the cost of such improvements or maintenance by levying a special tax upon the owners of real property within the affected area as provided by in this bylaw and such tax shall be recoverable from each owner by the Municipality by a per foot of lot frontage basis, or by a per lot basis or by a per owner basis or by an area rate of so much per $100.00 of assessed value of real property within the affected area as requested in the petition which is generally to be in the form as shown on Form "A" attached. The owner of a lot which fronts on more than one street within the affected area, shall pay based on only one (1) boundary of their property, that being the longest boundary that fronts on a street and only this boundary will be considered when calculating the total frontage within the affected area and in calculating the percentage of frontage that the owner owns. a) In the case of recovery of the cost of the street improvement by area rate, based on so much per $100.00 of assessed value of the real property, in the affected area as shown in the petition in Form "A", such area rate shall be struck by Municipal Council from year to year for a period not to exceed ten Notice of Intention to Amend — Committee of the Whole — May 19, 2022 (2022-218) First Reading— Council — May 26, 2022 (2022-227) Second Reading — Council — September 8, 2022 (2022-352) Effective Date —September 14, 2022 (Date of publication in Lighthouse NOW Progress Bulletin) Private Street Improvement and Maintenance By -Law #72 (continued) Page 4 of 12 10) years and shall cover all the projected costs including interest, to the Municipality for that year for such street improvement. b) In the case of recovery of the cost of the street maintenance by area rate, based on so much per $100.00 of assessed value of the real property, in the affected area as shown in the petition in Form "A", such area rate shall be struck by Municipal Council from year to year for the year for which maintenance is sought as provided for herein. 3.2 In the case of recovery of the cost of the street improvement and/or maintenance on a per lot basis and unless otherwise proved defined in this By-law, lot shall mean each individual developed lot, approved building lot or lot capable of being approved in its existing condition for development purposes and any land not capable of being developed, shall not be considered a lot for the purpose of this By -Law until such time as it is. 3.3 In the case of recovery of the cost of street improvement and/or maintenance on a per owner basis, multiple owners of the same real property shall be considered as one owner. For this paragraph, an owner of real property shall be defined as an owner of an area of land that forms one contiguous parcel of land upon which no more than one dwelling unit is constructed and contains at least one lot as defined in paragraph 3(2). If an owner has more than one parcel of land within the affected area separated by intervening property owners, then that owner shall be assessed individually for each separate parcel of land provided that each parcel has at least one lot as defined in paragraph 3(2). Further, if any parcel of land has more than one dwelling unit constructed upon it, then that owner shall be assessed individually for each dwelling unit. 3.4 Every petition for a street improvement and/or maintenance shall be in Form "A" of this By - Law, or similar thereto, and shall clearly state the locality in which the improvement and/or maintenance is requested, the approved purpose for which the maintenance and/or improvement requested and together with the following information shall be presented for approval to the Council of the Municipality. a) A Plan showing the streets outlined in red, which the Petitioners are desirous of having improved and or maintained and within the affected area, the names of the owners, length and width of the roadways and the frontage of each owner if the method of levying this special tax is on a frontage basis. b) In the case of a street improvement an estimate of the cost of the desired improvement along with the names of the persons or Association who shall be responsible for having the improvement carried out. The budget as submitted shall be verified by the Executive of the Association as having been passed by a majority of the members of the Association in attendance at a duly called meeting for that purpose at which a quorum was present. 3.5 In the event of a dispute between an owner and the Municipality as to any measurements or area of real property referred to in this By -Law, the owner shall be responsible to retain at their expense a surveyor in good standing of the Association of Nova Scotia Land Surveyors who shall certify as to the measurements or area or real property to the Council for the Municipality of the District of Chester. 3.6 That notice of the petition for street improvement and/or maintenance shall be sent by registered mail to each owner within the affected area who has not signed the petition including the owner of the street, if known, at the address shown on the assessment rolls and proof of the sending of this notice shall accompany every petition presented to the Municipality but it shall not be necessary to prove actual receipt of notice. 4 The total amount of the special tax levied by the Municipality under this By -Law shall not exceed the cost of the street improvements and/or maintenance to the Municipality plus interest and an administration charge of five percent (5%). 5.1 The special tax levied under this By -Law is a lien on the whole of the property of each owner for that owner's share of the capital improvement and/or maintenance with the same effect as rates and taxes under the Assessment Act and each owner shall be liable for a portion of the total cost of the street improvement and/or maintenance and an administration charge equal to: a) In the case of property fronting on a street the ratio that the lot frontage of each owner bears to the total frontage in the affected area. b) Within the affected area equal to the ratio that each lot bears to the total number of such properties situate in the affected area or c) An area rate of so much per $100.00 of assessed value of the property within the affected area as shown in the petition on Form "A", Notice of Intention to Amend — Committee of the Whole — May 19, 2022 (2022-218) First Reading — Council — May 26, 2022 (2022-227) Second Reading — Council — September 8, 2022 (2022-352) Effective Date —September 14, 2022 (Date of publication in Lighthouse NOW Progress Bulletin) Private Street Improvement and Maintenance By -Law #72 (continued) Page 6 of 12 5.3 7. d) In the case of a per owner basis, an equal amount assessed to each owner of a parcel of land as defined in paragraph 3.3 within the affected area as requested in the petition. 5.2 Notwithstanding the provisions of this By -Law, the Municipality may, upon request, exempt from assessment any owners within an affected area whose property abuts and has access to a public highway or do not use or have access to the street upon which improvements and/or maintenance are being sought but subject to the provision that the Municipality may later assess those exempted owners if it appears to it that they are then using the improved streets. a) In the case of a street improvement, the special tax levied pursuant to this By -Law, shall cover a period not exceeding ten (10) years and should cover all projected costs including interest to the Municipality for each year for such street improvement. b) In the case of street maintenance, special tax levied pursuant to this By -Law shall cover the amount approved by the Municipality pursuant to the budget submitted to the Municipality including all costs together with interest to the Municipality for that year for the street maintenance. 5.4 Notwithstanding paragraph 5.3 an owner subject to this special tax levied with respect to a street improvement, may elect to pay their share of the capital cost in a lump sum as calculated pursuant to this By -Law, and upon payment thereof that property shall bear no further responsibility for the balance of the cost of the street improvement. The special tax levied under this By -Law is collectible in the same manner as rates and taxes under the Assessment Act and by the same proceedings as are rates and taxes under the Assessment Act. 7.1 Regarding a street improvement, the lien provided for in this By -Law shall become effective on the date on which the Clerk of the Municipality signs and files at the Municipal Office, a Certificate stating the total costs of the street improvement and the amount of the special tax to be levied on each owner. 7.2 With regard to street maintenance, the lien provided for in this By -Law shall become effective on the date on which the Clerk of the Municipality signs and files with the Municipality a Certificate with a statement that the affected area is subject to an annual Notice of Intention to Amend — Committee of the Whole — May 19, 2022 (2022-218) First Reading — Council — May 26, 2022 (2022-227) Second Reading — Council — September 8, 2022 (2022-352) Effective Date —September 14, 2022 (Date of publication in Lighthouse NOW Progress Bulletin) Private Street Improvement and Maintenance By -Law #72 (continued) Page 7 of 12 10. special tax for street maintenance in an amount set annually by Municipal Council as provided for in this By -Law and shall remain effective from year to year until terminated pursuant to this By -Law. The Clerk of the Municipality shall keep a separate record of all monies due for the improvement and/or maintenance of streets, which records shall contain: 8.1 The names of the owner of a property liable for the special tax and the name of the improvement and/or maintenance with respect to which the taxes arose. 8.2 The amount of frontage each owner or the number of properties as the case may require. 8.3 The amount of the special tax levied on each owner with particulars of the amounts due or owing. The Clerk of the Municipality shall notify the owner of each property within the affected area upon the filing of the Certificate referred to in Section 7. Attached to such notice shall be a copy of the Certificate. 10.1 The amount payable in respect to the special tax for street improvement by each owner of real property within an affected area may be paid in equal annual instalments together with interest over a period not exceeding ten (10) years. 10.2 Each instalment and each succeeding instalment in respect of the tax imposed by this By - Law shall be due on the same date as the Municipality, by resolution, requires a payment of rates and taxes and in the event of default of payment of any instalment the whole balance with interest becomes due and payable. 10.3 The tax imposed by this By -Law shall bear interest at the rate imposed by Municipal Council by resolution for overdue taxes as an additional charge for non-payment of rates and taxes. 10.4 The amount payable in respect of the tax by each owner of real property within the affected area, may at the option of that owner be paid in one lump sum on or before the 31st day in the fiscal year in which the cost has been incurred or at any other time over the ten (10) year period. 11.
