HomeMy Public PortalAboutBy-law 2022-49 Adopt a Policy for Site Plan Requirements for Residential Development and Repeal 2006-14 and 2020-36CORPORATION OF THE MUNICIPALITY OF TWEED BY-LAW NO. 2022-49 Being a By-law to Adopt a Policy for Site Plan Requirements for Residential Development in the Municipality of Tweed, and to Repeal By-law No. 2006-14 and By-law No. 2020-36. WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, as amended, gives general authority for Councils to adopt policies; AND WHEREAS the Planning Act, R.S.O. 1990, c. P.13, as amended, gives general authority for Councils to implement and administer land uses; AND WHEREAS the Council of the Corporation of the Municipality of Tweed deems it expedient to adopt a policy to set out site plan requirements for residential development in the Municipality of Tweed; NOW THEREFORE the Council of the Corporation of the Municipality of Tweed enacts as follows: 1. THAT the Site Plan Requirements Policy attached hereto as Schedule 'A' to this By-law is hereby adopted as the policy for site plan requirements for residential development in the Municipality of Tweed. 2. THAT Schedule 'A' attached hereto forms part of this By-law. 3. THAT By-law No. 2006-14 and By-law No. 2020-36 are hereby repealed. 4. That this By-law shall come into force and take effect immediately upon the passing thereof by the Council of the Corporation of the Municipality of Tweed. Read a first, second, and third and final time, passed, signed, and sealed in open Council this 23rd day of August, 2022. -24a-e MA OR Ck 66/1,\Y- Ct SC_l/; -cam SCHEDULE 'A' TO BY-LAW NO. 2022-49 MUNICIPALITY OF TWEED Site Plan Requirements for Residential Development The following Site Plan provisions and requirements pertain to residential development other than single family residential dwellings. Where a zoning amendment is required the site plan will form part of a complete application for the zoning amendment process. Where a zoning amendment is not required the site plan will form part of a complete application for a building permit. Where a plan of subdivision is required the site plan will be addressed as part of the subdivision agreement. 1. RESPONSIBILITY FOR COSTS. All costs associated with the preparation and development and review by outside agencies (if applicable) of a site plan will be the responsibility of the developer. 2. SITE PLAN PREPARATION. The site plan will be prepared by a qualified person which may include a consultant, an engineer or an architect. The professional stamp of the qualified person shall be identified on the site plan. 3. SITE PLAN PROVISIONS. The following shall be included in and form part of a site plan: i. scale detail of drawings. ii. key map with compass bearing arrow. iii. identification of landowner and / or agent for landowner. iv. legal description of lands and civic address where applicable. 4. SITE PLAN REQUIREMENTS. The following shall be included in and form part of a site plan: Lot Information i. lot area. ii. % lot coverage of buildings. Page 1 of 3 iii. dimensions and bearings of lot lines. iv. adjacent uses identified and distances of adjacent buildings from lot lines. v. areas of non -pervious materials (i.e. concrete, asphalt, etc.). Building Information i. building design. ii. numeric gross floor area proposed and permitted in zoning by-law. iii. building(s) plans, including number of storeys. iv. proposed building setbacks from street lines, existing and proposed. v. overhead canopies, including location, dimension and height. vi. floor plan showing minimum size of rooms. vii. identification of roof -top mechanical units and relevant screening. viii. proposed elevation of building to street line. Parking and Loading Space Information i. parking spaces proposed and required, including dimensions of each and associated aisles. ii. handicapped parking areas. iii. location of pedestrian walkways and sidewalks, including safety curbs placed between sidewalks and parking areas. iv. concrete curbing between asphalt and landscaped areas. v. location and dimensions of aisles and loading spaces. Ingress and Egress Information i. all vehicular entrances, including width and radii. ii. location and turning radii for Fire and Emergency service access routes, including proposed percent slope of grade in fire route areas. Landscaping Information i. numeric landscaped area, proposed and required. ii. identification of existing natural vegetation to be preserved, and relevant existing grade elevations. iii. landscaped and amenity areas. iv. proposed fencing and berming. Grade Information i. existing and proposed grades of site and proposed elevation of buildings to be serviced in relation to centreline of street or as determined by municipal engineer. ii. elevation of building entrances in relation to proposed finished grade. Page 2 of 3 Stormwater Management Information i. stormwater facilities, including swales, catch basins and/or storm water ponds. ii. location, elevation and sizing of stormwater facilities. Water and Sewer Services Information i. servicing of buildings by water and sewer laterals and respective sizing. Signage i. sign locations (i.e. facility identification; stop signs at street line; handicapped parking; fire route; etc.). Garbage Disposal i. garbage storage and handling facilities. Lighting i. proposed lighting of access area. ii. proposed lighting of exterior, including predominant lighting iii. proposed number and location of streetlighting. Buffering i. type and location on property of buffer (i.e. hedge; trees; etc.) proposed (required adjacent to low density residential). 5. SITE PLAN REVIEW. The completed site plan may be forwarded to any outside agencies and internal staff that Council and/or the Zoning Administrator deems appropriate for review and comments. 6. SITE PLAN ACCEPTANCE. Final acceptance of the site plan shall be by the Zoning Administrator under the delegated authority granted by By-law No. 2022-46. Page 3 of 3
