COMMITTEE REPORTS
4.1 Committee of the Whole - November 21, 2013 - Warden Webber
It was noted that the motions were previously approved at the Council meeting on November 28,
2013.
2013 -575 MOVED by Deputy Warden Stratford, SECONDED by Councillor Church- Cornelius that
the minutes of the November 21, 2013 meeting of Committee of the Whole be
accepted as presented. CARRIED.
4.2 Committee of the Whole - December S, 2013 - Warden Webber
2013.576 MOVED by Deputy Warden Stratford, SECONDED by Councillor Church- Cornelius the
recommendations from the December 5, 2013 meeting of Committee of the Whole be
approved as follows:
2013 -565 -"...award Tender No. T- 2013 -020 Supply of a Four Wheel Drive Public
Works Truck to Connel Chrysler Dodge Jeep Ram, Middleton, Nova Scotia for the
amount of $34,125.00 plus HST."
2031 -566 - "...the Municipality continue with Standard Life for the Municipality's
Pension Plan for staff for the time being and continue to look at possibilities of
joining other municipalities in a group plan with a third party administrator to act as
trustee."

2013 -568 - "...accept the Village Planning Advisory Committee's assertion of the
intent to include the subject use a s a prior exiting use in the Village Area Land Use
By -Law and amend Schedule "C" accordingly (housekeeping amendment)."
2013 -569 - "...hold the public hearings on January 9, 2014 at 8:45 a.m. to amend
Schedule "C" of the Village Area Land Use By -Law to correct the following:

4,3 Lunenburg County VON- Councillor Connors
Councillor Connors reported that the VON Board approved 2014/15 Fund Development Plan. She
also indicated that the board was successful in recruiting a youth board member from Parkview
and noted that the board looks at each high school for students for an annual term.
4.3 Lunenburg County Seniors Safety Advisory Board -- Councillor Connors
Councillor Connors reported that there is full cooperation and representation from all
Municipalities in Lunenburg County. She indicated that duties will rotate rather than electing a
chair and the responsibilities will be hosted by each Municipality. She noted that the next meeting
will be chaired in Chester.
4.4 Church Memorial Park - Councillor Church - Cornelius
Councillor Church- Cornelius reported the following:
• new chair /board members
• revamping and updating of website
• looking for hockey photos for on website
• next meeting expected in January
4.6 REMO - Deputy Warden Shatford
Deputy Warden Shatford reported that the list of comfort stations for the Municipality has some
blanks and asked if everyone can submit their information soon.
4.7 AAirfield Engineers - Councillor Myra
Councillor Myra reported that the Committee has lots of work to do but is lacking in staff to do it
and lacking in recruits due to cut backs. He noted that it is impossible to handle requests received
because of the lack of staff and noted that they are in need of new recruits.

5.1 Correspondence from Marlene Fenn, Western Shore dated December 2, 2013 requesting
permission to reconnect her sump pump to sewage system.
The Director of Public Works reviewed the information included in the December 10, 2013 report
regarding 6486 Highway 3, Western Shore - Sump Pump Connection as follows:

After a lengthy discussion and reviewing the recommendations presented by the Director of Public
Works, the following motion was made.
2013 -577 MOVED by Councillor Vehnotte, SECONDED by Councillor Church- Cornelius that the
request from Marlene Fenn of Western Shore to reconnect her sump pump to sewage
system be rejected.
Deputy Warden Shatfo d indicated that he will not support the motion and would like to provide a
six months for a solution. A recorded vote was requested. Councillor Myra also indicated that he is
not in support of the motion and would like to give Ms. Fenn time.
In Favour: Councillor Veinotte, Councillor Church - Cornelius, Councillor Connors, Warden Webber,
Councillor Armstrong.
Opposed: Councillor Myra, Deputy Warden Stratford.
MOTION CARRIED.
5.2 Correspondence from the Town of Yarmouth dated November 14, 2013 regarding the
return of the Yarmouth- New England Ferry Service and Federal funding to renovate the
existing terminal in preparation for startup in May, 2014.
This was considered information.
5.3 Correspondence from Region 6 Solid Waste Management dated November 25, 2013
regarding motion to accept Operations Budget and Education Budget for budget year
2014/2015.
2013 -578 MOVED by Councillor Church- Cornelius, SECONDED by Deputy Warden Shatford
accept the Region 6 Solid Waste Management Operation Budget in the amount of
$124,804 and Education Budget in the amount of $65,813 for the budget year
2014 /201S. CARRIED.
5.4 Correspondence from NS Department of Transportation and Infrastructure Renewal Capital
Programs dated November 29, 2013 regarding Cost Shared Paving and Repaving of J -Class
Subdivision Streets. Submit a prioritized list of streets for consideration due no later than
January 31 2014
It was noted that this is for information purposes only unless someone has a reason to provide a list
of road names. It was noted that a letter of response be sent to the NS Department of
Transportation and Infrastructure Renewal indicating that the Municipality is not interested in
submitting a prioritized list of streets for this upcoming year.
5.5 Correspondence from Our Health Centre dated November 28, 2013 regarding request for
funding.

After reviewing the request for funding from Our Health Centre the following motion was made.
2013 -579 MOVED by Councillor Veinotte, SECONDED by Councillor Myra that the request from
Our Health Centre in the amount of $1,000,000.00 be referred to the budget process.
CARRIED.
It was noted to send a letter of response to Dan Green and advise him that the request has been
referred to the budget process for 2014/15.
Warden Webber indicated that all of Council believe it is a good project, the question is the amount.
NEW BUSINESS
6.1 Lordly Park
It was noted that a resolution is required to authorize the execution of agreement and deed for the
sale of Lordly Park to the Heritage Society. It was noted that when the Municipality receives the
$80,000 for Lordly Park the Municipality will turn over the deed.
2013 -580 MOVED by Councillor Armstrong, SECONDED by Councillor Myra authorize the
execution of the Agreement to sell land at 82 Union Street, Chester to the Chester
Municipal Heritage Society PID #60089760 in the amount of $80,000 and authorize
the Warden and Municipal Clerk to sign the documents. CARRIED.
The CAD indicated a resolution will be needed to write off the remaining amount of interest and
penalties and noted that she will bring back the amount to Council.
A ten minute break was held.
2013 -581 MOVED by Councillor Myra, SECONDED by Councillor Armstrong the meeting convene
"In Camera" to legal opinion on Tender T- 201.3 -016 Cell 3. CARRIED.
After a brief meeting held "In Camera" the meeting reconvened in Regular Session with all members
present.
2013 -582 MOVED by Councilor Church-Cornelius, SECONDED by Councillor Areastrongthat the
Tender T- 2013 -016 - Cell 3 be cancelled and re- tendered in the New Year. CARRIED.
NEW BUSINESS (continued)
6.2 FCM Sustainability Conference in PEI - Warden Webber
Warden Webber indicated that there is a sustainability conference being held February 11 -13, 2014
in PEI. He indicated that the conference is close therefore it is a better opportunity to participate. it
was noted that the Municipal Clerk will resend the UNSM email and at next meeting Council it can
be discussed whether Councillors want to attend or not. The Municipal Cleric will need to know to
register and book roans.
Councillor Myra indicated that he would like to attend. The CAD noted that the sessions are very
good.
Councillor Connors indicated that she would prefer attending the Tourism Conference as she has
attended it for the past 18 years.

a) The Chairperson indicated thatthe reason for the meetingwas a request for letter of concurrence
to Industry Canada for the installation of a 15.54 metre radio communications pole /antenna to
be located on Hillcrest Road property identified as PID 60100492 by the Chester Basin Volunteer
Fire Department.

Nature of Application: Request for a letter of concurrence to Industry Canada with regard to the

4) OVERVIEW BY PLANNER
The Senior Planner briefly outlined the location indicating it is the Fire Department's second attempt
at a location. The locations meets all requirements and permits have been received.
Councilor Armstrong asked if there were any barriers to the tower and it was noted it would be at
the top of a pole and specialized equipment would be required to climb it.
Warden Webber indicated he had one call from a resident but once the caller was provided with the
information there were no issues.

The applicant did not have any further information to add.
6) COMMENTS BY THE PUBLIC ON THE PROPOSAL

Public Hearing - Housekeeping Amendments

At its meeting of 12 December 2013, Council set a Public Hearing date of 9 January 2014 to consider
any submissions regarding proposed housekeeping amendments to Schedule "C" of the Village Area
Land Use By -law: "List of Prior Existing Uses,"
The proposed amendments were to list a commercial use as a prior existing use in the Royal Canadian
Legion (Branch #44) building, 14 Union Street, and to correct two typographical errors regarding
apartment buildings on one lot on Duke and Water Streets.
Regretfully, I must advise that the Notice of Public Hearing did not meet its required publication date
in the local press. Accordingly, Council is requested to set a new Public Hearing date.
RECOMMENDATION:
Staff suggests 30 January 2014, 8:4S a.m. as Public Hearing date for this matter.

2013 -586 APPROVAL OF MINUTES
MOVED by Councillor Armstrong, SECONDED by Brenda Mulrooney that the minutes of the October
30, 2013 meeting of the Village Planning Advisory Committee be approved with the following
amendments to read as follows:
Page 421, sixth paragraph: "...The Chair advised this Committee has the ability to propose
changes to the Planning Strategy and that a review was coming up in the near future ";
Page 421, under "Other Planning Matters ", last sentence: "She further commented that for
comparison, Grand Pre is not considered a cultural landscape but the view towards Blomidon
is considered as such."

2013 -587 APPLICATION FROM ROYAL CANADIAN LEGION BRANCH #44 - REZONING
MOVED by Ray Cambria, SECONDED BY Councillor Armstrong that a recommendation be made to
consider the application from the Royal Canadian Legion, Branch #44, as changed from a rezoning of
the entire propertyto an identification of the part of the building in question as having a prior existing
use as a Personal Service shop and that the prior existing use be allowed. CARRIED.

After discussion, the Village PAC made the following motion.
2013 -586 MOVED by Councillor Armstrong, SECONDED by Brenda Mulrooneythat the minutes of
the October 30, 2013 meeting of the Village Planning Advisory Committee be approved
with the following amendments to read as follows:

HEIGHT DEFINITION
The Director advised a Staff Report should be ready for the December, 2013 or January, 2014
Village PAC meeting. She further advised the recommendation from the Village PAC had been
presented to Council, however, Council referred the matter back to the Village PAC for further
discussion and information.
ROYAL CANADIAN LEGION BRANCH #44 - ZONING AMENDMENT: INSTITUTIONAL TO
CENTRAL COMMERCIAL
The Senior Planner reviewed his report in relation to the application from the Royal Canadian
Legion, Branch #44, requesting a Zoning Amendment for their building at 14 Union Street, Chester,
to be zoned Central Commercial from Institutional.

Bill DeGrace advised the recommendation from staff is that the proposed amendment to zone the
property as commercial is consistent with the intent of the Secondary Planning Strategy.
The Committee discussed the application and possible future effects it could have on the Village if
the property were to be rezoned to commercial. A question was raised as to whether this should be
a prior existing use and was missed at the last review.
The Director suggested that if the Committee felt this was an oversight when Schedule C was
created then this property could be added as a prior existing use. This could probably be done as a
housekeeping amendment. The Solicitor suggested obtaining further documentation prior to this
amendment.
The Chair asked if anyone from the public in attendance wished to address this issue.
Marian Friday -Cook, Past President of Branch 44 Chester Legion, spoke to the Committee regarding
the zoning amendment request.
There were no other comments from the public in attendance.
There was no one from the gallery who requested to address this issue.
2013 -587 MOVED by Ray Cambria, SECONDED BY Councillor Armstrong that a recommendation
be made to consider the application from the Royal Canadian Legion, Branch #44, as
changed from a rezoning of the entire property to an identification of the part of the
building in question as having a prior existing use as a Personal Service shop and that
the prior existing use be allowed. CARRIED.
OTHER PLANNING MATTERS
There were none.

The date of the next meeting is scheduled for January 22W, 2014 @ 4:30pm.
Councillor Armstrong commented that he had spoken with the Deputy Chief regarding the "height
issue" and it was confirmed by the Deputy Chief that the fire department cannot fight a fire higher
than 33' from the ground.

Further to our letter dated October 7 'h, 2013, in a motion passed at our monthly meeting on December
11 "', the Village of Chester Commission wishes to advise that we feel we have no choice but to
continue with the existing arrangement for garbage collection. That is to say that we do not intend to
burden the residents of the Village with duplicate collections, by the Village and the Municipality.
Our intention was to provide service in the Village in relation to its unique needs, different from the
rural areas of our Municipality. In obtaining pricing from three different suppliers, we have found that
the passible savings to the residents would have been significantly lower that our current costs. We
ask that the Municipality investigate every means of lowering the cost of waste collection.
As always, we remain committed to working with the Municipality to help build a strong working
relationship and ensure our residents interests always be the motivation.

Re: Operational Grant

As you may be aware, the Lido Pool, which was turned over to the Village from the Municipality,
has had a complete overhaul. A public washroom was added to the facility, fencing was installed,
the floor of the pool was replaced and the walls inspected to ensure the ongoing integrity of the
structure. The majority of the cost for this work was covered by the residents in the Village. We
are proud of the end result from all the hard work and costs, and readily provide the whole
Municipality with the use of this facility at no charge. Since the renovations, the cost to run the
pool has risen. It is for this reason that we are writing to ask that the Municipality share the cost
with the Village residents. Increasing operational costs have caused an increase in the tax rate for
the pool and other than an operational grant; the only other choice would be a user fee to anyone
living outside of the Village. Understandably, this could be misinterpreted by these users and
may result in all sorts of undesirable outcomes. This seems unacceptable to us on every level.
We hope the Municipality feels that same way and will provide the necessary additional monetary
help that will ensure our Lido Pool remains a part of our community. Looking forward, there are
additional improvements to be made; changing rooms, safety hand rails for children and seniors
entering the pool to name a couple.

Council Grants are provided at the discretion of Council for non - profit organizations benefiting the residents
of the Municipality of the District of Chester.
PLEASE NOTE:
1. PLEASE NOTE: Organizations are only eligible for ONE grant from the Municipality per fiscal year
which is April 1 to March 31 in any given year (that ONE grant could be from Council, the Recreation
& Parks Department, or Tourism). The Recreation & Parks Department has its own application form.
2. You must be a non - profit, volunteer organization.
3. Your primary purpose must be to operate, sponsor or encourage programs, activities or facilities
within the Municipality of the District of Chester.
4. A group that does not fit items 2 or 3, but are the only group in the area providing the service may be
considered.
5. Financial assistance should not be anticipated on an annual basis.

I am trying to "fund" two additional plaques regarding historical locations in
Blandford. They would be sited alongside the existing plaques at the
Blandford viewpoint which were put there approximately 10 years ago.
The viewpoint which now has two picnic benches and garbage box arranged
througlh our councillor Andre Veinot in July 2013.
I am informed from the office of Tourism Minister Steele that funding must
be from a non -profit organization. As such I would like to apply as an
adjunct of "Destination Bluenose Coast" and therefore would like your
agreement.
I have initially sourced funding availability and have application forms:

I'm writing to follow -up on your letter from Minister Steele of August 23, 2013 and phone
call I received on August 30 regarding the opportunity to add two historical interpretive
Panels to the viewpoint area in Blandford.
As mentioned, the Tourism Development Investment Fund does provide funding for
interpretive panels, however, projects are required to demonstrate fit with an existing
plan for the region, and be directed to a tourism audience. Additional program
information is available in the attached First Impressions Program: Guidelines and
Application Fom7. Please note that the funding program closed on June 28, 2013. When
details on next fiscal year's funding are finalized, information will be available online at
htt isi,nagen . ca/ tourism- develoa�ment- investmeril -fund before April
1, 2014.
I encourage you to discuss your idea with Trudi Curley, Coordinator, Destination
Bluenose Coast to determine how panels in Blandford may fit into a larger tourism
project in the region. Trudi can be contacted at (902) 275 -4802. If you are focused
solely on two interpretation panels, rather than a larger project, you may wish to
investigate other sources of funding at the municipal or regional level. Another provincial
funding opportunity that may be of interest is the Department of Communities, Culture
and Heritage's Main Street program, which will be finalized by March 2014. For more

The viewpoint is well visited by tourists viewing west over

The winter parking ban is managed and coordinated by the Province through the Department of
Transportation. They install and remove the signs before and after the ban. I can pass along the
request for larger signs to the Department but I think it might be more productive if the request
comes from Council for betting signage and enforcement of the ban.

I have been asked by some merchants down in the village if we could put up better signage for
our winter parking ban.There really isn't any signage to speak o£In front of Julian's there is one
faded out small sign.Most people just are disregarding the ban anyway but without some signage
it is pretty well not enforceable.The signs could be put on some of the existing 4 hr sign posts
and perhaps removed in the spring.
It would be great if we could do something to improve the situation,this is not an emergency but
we seem to getting a lot of snow this year with a big storm on the way,and with that comes the
problem,etc.Thank you for your consideration.
