BY-LAW NO, 2022-73
Being a By-law to Limit the Gross Vehicle Weight of Any Vehicle or Any Class Thereof
Passing Over Certain Bridges Under the Jurisdiction of the Corporation of the
Municipality of Tweed Pursuant to the Highway Traffic Act, R.S.O. 1990, c. H.8, as
Amended, and to Repeal Prior Load Limit By-laws.
WHEREAS Section 8 of the Municipal Act, S.O. 2001, c. 25, as amended, (hereinafter
li referred to as the "Municipal Act") provides that the powers of a municipality under the
Municipal Act or any other Act shall be interpreted broadly so as to confer broad
i authority on the municipality to enable the municipality to govern its affairs as it
considers appropriate and to enhance the municipality's ability to respond to municipal
issues;
AND WHEREAS Section 9 of the Municipal Act provides that a municipality has the
capacity, rights, powers and privileges of a natural person for the purpose of
exercising its authority under the Municipal Act or any other Act;
AND WHEREAS Section 11 (3) of the Municipal Act provides that a lower -tier
municipality may pass by-laws respecting matters within its spheres of jurisdiction;
AND WHEREAS, Section 123 (2) of the Highway Traffic Act, R.S.O. 1990 c. H.8, as
amended, provides that a municipality or other authority having jurisdiction over a
bridge may by by-law limit the gross vehicle weight of any vehicle or any class thereof
passing over a bridge;
AND WHEREAS, the Council of the Corporation of the Municipality of Tweed deems it
expedient to enact a By-law to limit the gross vehicle weight of any vehicle or any
class thereof passing over certain bridges under the jurisdiction of the Corporation of
the Municipality of Tweed;
NOW THEREFORE the Council of the Corporation of the Municipality of Tweed enacts
as follows:
DEFINITIONS
1. That in this By-law:
1.1 Gross Vehicle Weight means the total weight in tonnes transmitted to
the highway by a vehicle or combination of vehicles and load.
1.2 L1/Evaluation Level 1 means vehicle trains - vehicles composed of
three or more units. A tractor -semi -trailer -trailer setup.
1.3 L2/Evaluation Level 2 means two -unit vehicles — car -trailer, truck -trailer,
and other vehicles consisting of two units.
1.4 L3/Evaluation Level 3 means single -unit vehicles — buses, cars, trucks,
and other vehicles consisting of a single unit.
2. That no vehicle or combination of vehicles or any class thereof, whether empty
or loaded, shall pass over the following bridges within the Municipality of
Tweed, having a gross vehicle weight in excess of the loads shown in the table
below:

3. That this By-Iaw shall not become effective until a notice of the limit of gross
vehicle weight permitted, legibly printed, has been posted in a conspicuous
place at each end of the bridge.
4. That every person who contravenes the provisions of this By-Iaw is guilty of an
offence and on conviction is liable to a fine as provided in the Highway Traffic
Act, R.S.O. 1990, c. H.8, as amended from time to time.
5. That the engineers' statements verifying the gross vehicle weight limits
specified in Section 2 of this By-law are set out in Schedule 'A' attached hereto
and form part of this By-Iaw.
6. That By-Iaw No. 2020-61, 2020-62, 2020-63, 2020-64, 2020-65, 2020-66, 2020-
67, 2020-68, 2020-69, 2020-70, 2020-71, 2020-72, 2020-73, 2020-74, 2020-75,
2020-76, 2020-77, and 2020-78 be and are hereby repealed.
7. That this By-Iaw shall come into force and take effect immediately upon the
passing thereof by the Council of the Corporation of the Municipality of Tweed.
Read a first, second, and third and final time, passed, signed, and sealed in open
Council this 14th day of December, 2022.

Bradshaw Bridge (Structure 36) located on Flinton Road;
Scotchwoman Bridge (Structure 39) located on Flinton Road;
Ross Bridge (Structure 40) located on Bosley Road;
Queensborough Bridge (Structure 42) located on Queensborough Road;
Joe Allore Bridge (Structure 48) located on Allore Road;
Joe Trudeau Bridge (Structure 49) located on Courneya Road;
Kinlin Bridge (Structure 50) located on Kinlin Road; and
Dowling Bridge (Structure 51) located on East Hungerford Road
as described in this Schedule.
Effective as of the date of approval of this By-law, I agree with the recommended
gross vehicle weight Eirnits as Seto t in Section 2 of By -Law : 2f2-7 for a period
