BY-LAW NUMBER 2016-78
A by-law to amend Schedule A to By-law No.
2011-103 being a by-law for the imposition of
sewage charges in the North Talbot Road Outlet
Sewer Area.
WHEREAS Sections 8 and 11 of the Municipal Act, 2009, S.O.2001, provides broad
and specific powers to municipalities to regulate, prohibit or require persons to do
things within the public utilities sphere of jurisdiction;
AND WHEREAS The Corporation of the Town of Tecumseh (Corporation) has
undertaken the installation of sanitary sewage works to provide municipal sanitary
sewage services to certain lands within the Oldcastle Hamlet area of the Town of
Tecumseh, hereinafter referred to as the North Talbot Road Outlet Sewer Area,
pursuant to its authority under the Municipal Act, 2009, S.O.2001, c. 25, as amended;
AND WHEREAS the Owners of land in the North Talbot Road Outlet Sewer Area will
receive a benefit from the installation of the sanitary sewage works;
AND WHEREAS the Corporation has determined that it is desirable to recover the
capital cost of the construction of the sanitary sewage works within the North Talbot
Road Outlet Sewer Area by imposing a charge pursuant to Section 391 of the Municipal
Act, 2009, S.O.2001, c. 25, as amended, upon the Owners who receive or will receive
a benefit therefrom;
AND WHEREAS the charges imposed by this By-law constitute a debt to the Town that
may be added to the tax roll and collected in like manner and with the same priority as
municipal taxes;
AND WHEREAS the Council of the Corporation passed By-law No. 2011-103 for the
purpose of imposing charges against the benefitting lands in the North Talbot Road
Outlet Sewer Area;
AND WHEREAS the Council of the Corporation passed By-law No. 2014-85 to amend
By-law No. 2011-103 for the purpose of adjusting the Schedule 'B' charges to reflect
the current cost of construction for the sewer laterals;
AND WHEREAS the Council of the Corporation is desirous of further amending By-law
No. 2011-103 for the purpose of expanding the North Talbot Road Outlet Sewer
Benefitting Area;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
TECUMSEH ENACTS AS FOLLOWS:
1. That Schedule A to By-law No. 2011-103 is hereby deleted in its entirety and
replaced with Schedule A attached hereto and forming part of this By-law.
2. This By-law shall take effect from the date of passage by Council and shall come
into force and take effect upon third and final reading of this By-law.
