HomeMy Public PortalAboutFreedom of Information and Protection of Privacy Bylaw 1413TOWN OF OLIVER BYLAW 1413 A Bylaw for the Administration of the Freedom of Information and Protection of Privacy Act The Council of the Town of Oliver, in open meeting assembled, hereby enacts as follows: 1. This Bylaw shall be cited for all purposes as “Freedom of Information and Protection of Privacy Bylaw 1413”. 2. Town of Oliver Freedom of Information Bylaw No. 784, 1995, is hereby repealed. 3. In this Bylaw: “Act” means the Freedom of Information and Protection of Privacy Act, Chapter 165 [RSBC 1996], as amended from time to time; “Head” means the person designated as the head of the public body for the purposes of the Act in accordance with Section 77 of the Act; and “Public body” means the Town of Oliver. 4. The definitions contained in Schedule 1 of the Act, shall apply to this bylaw except where the context requires otherwise. 5. The Corporate Officer is designated as the Head for the purposes of the Act. 6. The Head is authorized to delegate to any person any duty, power or function of the head, except that the delegation: a) Must be in writing; b) May be subject to such conditions or restrictions as the head considers appropriate; and c) Must comply with section 66 of the Act. 7. Fees must be in accordance with Fees and Charges Bylaw 1383, as amended from time to time. 8. A decision by a court that any part of this Bylaw is illegal, void, or unenforceable severs that part from the Bylaw, and is not to affect the balance of this Bylaw. 2 | P a g e Read a first, second and third time on the 14th day of November, 2022.
