BY-LAW NO. 86-40
WHEREAS Section 298(1)(a) of The Municipal Act,
Chapter 302, R.S.O. 1980, empowers Councils of local municipalities
to enact by-laws for establishing and laying out highways;
AND WHEREAS the land required to be established
as a highway has been acquired by The Corporation of the Township
of Sandwich South by deed dated the 5th day of March, 1982 and
registered on the 23rd day of June, 1982 as Instrument Number
857520; Deed dated March 20th, 1986 and registered on the 22nd
of May 1986 as Instrument No. 971761; and Deed dated March 24th,
1986 and registered on the 22nd of May 1986 as Instrument No.
971763;
AND WHEREAS Section 302 of The Municipal Act
provides that where land required for establishing and laying out
highways has been acquired by the corporation, then no notice or
pbulication of the proposed by-law to establish or lay out the
highway or proposed highway is required under Section 301 of The
Municipal Act.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF
SANDWICH SOUTH hereby enacts as follows:
1. That the land conveyed to The Corporation of the Town-
ship of Sandwich South from Emilio Eugeni by deed dated the 5th
day of March 1982 and registered on the 23rd day of June 1982 as
Instrument Number 857520; the land conveyed to the Corporation of
the Township of Sandwich South from Continental Bank of Canada
by deed dated March 20th, 1986 and registered on the 22nd day of
May 1986 as Instrument No. 971761; and the land conveyed to the
Corporation of the Township of Sandwich South from 530939 Ontario
Ltd. (Ron Moro) by deed dated March 24th, 1986 and registered on
May 22nd, 1986 as Instrument No. 971763, is hereby established as
a highway (Burke Street);
2. Said lands to be established as a highway, is composed
of Part of Farm Lot Three Hundred and five (305), in the range
of lots North of Talbot Road, designated as Parts 2B & 5, on
Reference Plan 12R-3555, in the Township of Sandwich South, in
the County of Essex and Province of Ontario, and more particularly
described in Exhibit "A" attached hereto.
By-Law No. 86-40 continued ......
3. This by-law shall come ~nto force and take effect upon
the final passing thereof.

llth day of August 1986.
