BY-LAW 93-5
being a by-law to prohibit the parking
of vehicles on Municipal Highways
WHEREAS the Municipal Act, R.S.O. 1990 Chap. M45, Section 210, paragraph 131
provides that a Council of a municipality may pass a by-law to prohibit the parking of any
vehicles on municipal property;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
TOWNSHIP OF SANDWICH SOUTH HEREBY ENACTS AS FOLLOWS:
Definitions:
'Park' or 'Parking' means the standing of a vehicle, whether occupied or not, except
when standing temporarily for the purpose of and while actually engaged in loading
or unloading merchandise or passengers.
'Street' or 'Highway' includes a common or public highway, street, road, avenue,
parkway, lane driveway, square, place, bridge, viaduct or trestle, designed or
intended for or used by the general public for the passage of vehicles.
'Vehicle' includes a motor vehicle, traction engine, farm tractor, road building
machine, motorcycle, trailer, bicycle and any vehicle drawn, propelled or driven by
any kind of power, including muscular power, but does not include a motorized snow
vehicle.
Offences: No person shall park a vehicle on a municipal highway or road
allowance in such a manner as to interfere with the (a) movement of traffic on the
highway, Co) clearing of snow from the highway or road allowance, or (c) movement
of traffic into or from any private or public driveway or public area contiguous to the
highway.
Removal of Vehicle: Upon discovery of any vehicle parked or standing in
contravention of section 2, of this by-law, any Municipal Law Enforcement Officer
appointed by Council to enforce the provisions of this by-law may cause the vehicle
to be moved or taken to and placed or stored in a suitable place. All costs and
charges for removal, care and storage, if any, shall be paid by the owner of the
vehicle so removed and are a lien upon the vehicle and may be enforced in the
manner provided by the Repair and Storage Liens Act.
That this by-law comes into force and takes effect upon the final passing thereof.
