HomeMy Public PortalAbout1999-10-25_By-Law Adoption Procedure for New By-Laws or Amendments to Existing By-Laws_P-06MUNICIPALITY OF THE DISTRICT OF CHESTER POLICY P -6 BY -LAW ADOPTION PROCEDURE FOR NEW BY -LAWS OR AMENDMENTS TO EXISTING BY -LAWS The By -Law or amendment is drafted by Solicitor and Staff and presented to the By -Law Committee. The Committee makes a recommendation to Council. If favourable, the title and object of the by-law or amendment will be read. Council will then state that the by -law will proceed to Second Reading and in the resolution establish the date for Second Reading. Notice of Council's intent to consider the by -law shall be published in a newspaper circulating in the Municipality fourteen (14) days before Second Reading. The notice shall state the object of the by-law, the date and time of the meeting at which Council proposes to consider it, and where the proposed by -law may be inspected. After Second Reading and if Council approves the by-law: 5.1 The by -law will be sent to a Minister of the Crown for approval if required. 5.2 Notice is published in a newspaper circulating in the Municipality stating the object of the by -law and the place where it may be read. Where Ministerial approval is required notice is published following Ministerial approval. 5.3 When the by -law is published, the Clerk shall file a certified copy of the by-law and notice of publication with the Minister. 5.4 One copy of the by -law, certified by the Clerk under seal, along with a certified copy of the notice of publication of the by -law shall be entered in the by -law records. 6• The Clerk will update all printed copies of the by -laws of the Municipality as required.
