STREET DISTURBANCE PERMITS
NON - REFUNDABLE FEES AND SECURITY DEPOSIT
A non - refundable fee of $ 200.00 will be charged in all cases when the permit is required solely
because of an obstruction to the pedestrian or vehicular traffic in a street, without breaking or
damaging the surface or subsurface of a street or to Municipal infrastructure or property in, on
or under a Street (ref 24(1) (2) of the Municipal Street By -Law).
2. A security deposit of $ 1,000,00 or $30.00 per square meter, whichever is greater will be required,
of the area to be disturbed will be required where an excavation or other construction activity
is involved that may, in the opinion of the engineer, cause damage to a street (ref 24(3) and
28 (2) of the Municipal Street By -Law).

NO PERSON SHALL (Section 23 of the Municipal Street By -Law)
A. Make any excavation in a street;
B. Cause or permit the breaking of the surface of a street or other physical damage to a street by construction activities in or near a street
or;
C. Otherwise engage in construction activity or other temporary activity that is likely to obstruct pedestrian or vehicular traffic in a street
without first obtaining a Street Disturbance Permit from the Engineer.
CONDITIONS
The Holder of Permit Shall:
1. Save and hold harmless the Municipality against any and all claims for personal injury and /or property damage of whatsoever nature,
both during and afterthe execution of the work covered by this Permitwhere, In the opinion of the Municipality, any such claims arises
from the execution of the work.
2. BearALLdamagecostsduringtheconstructionofundergroundservice ,abovegroundservice, driveway, or other entrance or other work
undertaken to the road shoulders, ditches, culverts, pavements and other installations and all subsequent damage coststo the highway
that are, In the opinion of the Municipality, attributable to the work under the permit.
3. Bear ALL damage and repairs costs to private property or access that, in the opinion of the Municipality, are attributable to the work
described above.
4. Bear ALL costs and relocation of underground service, aboveground service, driveway, or other entrance or damage to the other
Municipal installation, whenever required by the Municipality.
5. Bear ALL costs during the work described above in connection with:
a. All claims for damage due to accidents.
b. Direction of all traffic, including barricades, lights, signs and supply of properly equipped and trained Traffic Control personnel
for protection of traffic according to the Temporary Workplace Traffic Control Manual.
C. Maintaining road surface and ditches adjacent to project.
d. Inspection charges.
6. Provide that all backfill material placed in the sections of the trenches that are under the road or under the road shoulder contain no
stones over 160 mm in largest dimension from a point two diameters above the said pipe until the existing grade is reached. All such
backfill -is to be vibratory tamped in layers of 160 mm layers of which is to be composed of clean gravel containing no stones over 80
mm in largest dimension.
7. Provide that upon completion of the work, the road shoulder shall be left in a neat condition and dressed with gravel containing no
stones over 20 mm in largest dimension.
8. Carry out the work with minimal interruption to highway traffic and provide the Municipal Engineer with a work schedule.
Carry out the work and maintenance of the project in every respect satisfactory to the Municipality of the District of Chester.

Repave immediately or when applicable, maintain the backfilled excavation to the satisfaction of the Municipality of the District of
Chester until such time as the excavated trench is repaved at 160kg /m2 orsuch thickness as to match the existing pavement, whichever
is the greater.
