HomeMy Public PortalAbout2014-05-29_Dangerous or Unsightly Premises Policy_P-80Dangerous - - - Unsightly Policy Policy P-80 Effective Date: May 29, 2014 Dangerous or Unsightly Premises Policy P-80 (continued) MUNICIPALITY OF THE DISTRICT OF CHESTER DANGEROUS OR UNSIGHTLY PREMISES POLICY POLICY P-80 PURPOSE The purpose of this policy to delegate the Municipality's powers and set priority with regard to Part XV of the Municipal Government Act (Dangerous or Unsightly Premises). Part XV of the Municipal Government Act states, "Every property in a municipality shall be maintained so as not to be Dangerous or Unsightly". POLICY STATEMENT 1. Council delegates its authority to declare a property as Unsightly to the Building and Unsightly Premises Committee. The Committee will determine whether or not a property is considered Unsightly in accordance with the definition of such in the Municipal Government Act. 2. Council delegates its authority to declare a property as Dangerous to the Administrator. The Administrator may utilize any and all tools listed in the Dangerous or Unsightly Premises Procedure or in Section XV of the MGA to achieve compliance. 3. Council delegates its authority to bring into compliance a property which has been declared Dangerous or Unsightly to the Administrator. The Administrator may utilize any and all tools listed in the Dangerous or Unsightly Premises Procedure or in Section XV of the MGA to achieve compliance. 4. Council retains its authority under the Dangerous or Unsightly Premises provisions contained in the Municipal Government Act to conduct appeal hearings when an appeal is launched against an order to demolish a building issued by the Committee. 5. Council retains its authority under the provisions of the Dangerous or Unsightly Premises provisions contained in the Municipal Government Act to order demolitions. 6. There is hereby established a standing Committee of Council, to be called the Building and Unsightly Premises Committee. 7. The Standing Committee membership shall consist of two (2) Councillors and the Warden as ex officio. 8. The quorum will beset at two (2) members of the Building and Unsightly Premises Committee. Policy P-32 and P-15 are hereby repealed.
