HomeMy Public PortalAboutBy-law 2023-86 Water and Sewer Arrears Collection PolicyCORPORATION OF THE MUNICIPALITY OF TWEED BY-LAW NO. 2023-86 Being a By -Law to Adopt a Policy for the Collection of Water and Sewer Arrears Associated With the Supply of Municipal Water and Sewer Services in the Municipality of Tweed, and to Repeal By-law No. 2006-12. WHEREAS Section 391 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality may pass by-laws imposing fees or charges on persons for services or activities provided or done by or on behalf of it; AND WHEREAS Section 398 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that fees and charges imposed by a municipality on a person constitute a debt of the person to the municipality; AND WHEREAS Section 398 (2) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that the treasurer of a local municipality may add fees and charges imposed by the municipality to the tax roll for the property to which the supply or service was supplied and collect them in the same manner as municipal taxes; AND WHEREAS the Council of the Municipality of Tweed deems it expedient to establish a policy for the collection of water and sewer arrears for the supply of water and sewer services associated with the Municipality of Tweed's water and sewer system; NOW THEREFORE the Council of the Corporation of the Municipality of Tweed enacts as follows: 1, THAT the Policy for the Collection of Water and Sewer Arrears attached hereto as Schedule 'A' to this By-law is hereby adopted as the Policy for the Collection of Water and Sewer Arrears in the Municipality of Tweed. 2. THAT Schedule 'A' fawns part of this By-law, 3. THAT By-law No. 2006-12 is hereby repealed in its entirety. 4. THAT this By-law shall come into force and take effect immediately upon the passing thereof by the Council of the Corporation of the Municipality of Tweed. L ,ewer MAYOR Schedule 'A' to By-law No. 2023-86 Corporation of the Municipality of Tweed Policy for the Collection of Water and Sewer Arrears This Policy for the Collection of Water and Sewer Arrears is issued under the authority of the Council of the Corporation of the Municipality of Tweed in accordance with By-law No. 2023-86 dated November 14, 2023. (1''' Page 1 of 3 The Corporation of the Municipality of Tweed Policy for Collection of Water and Sewer Arrears This policy sets out the procedures to be followed for the collection of outstanding water and sewer amounts for all accounts, both residential and commercial, applicable to the Municipality of Tweed's water and sewer billing system. General Account Collection The following procedures shall be followed for water and sewer accounts. 1 Water and sewer bills are sent the first week of the month in each of the following quarters in each year: January, April, July, and October. Each bill is for the 3 - month period ending on December 31st, March 31st, June 30th, and September 30th (respectively). Amounts billed are due on the last business day of each of these billing months. 2. If the account is not paid within one week following the due date a "notice of past due amounts" will be sent to the property owner reminding of the unpaid bill and the addition of penalty. 3. If the account is not paid by the end of the month following the due date, a letter will be sent to the property owner by registered mail, advising that outstanding water and sewer amounts may be added to the tax roll and will be collected in the same manner as taxes if not paid by the end of the second month following the due date and additional administrative fees shall apply. 4. If water and sewer arrears remain unpaid at the end of the second month following the due date, the total outstanding amount will be added to the tax roll for the applicable property including an administrative fee of $50.00 and the property owner shall be notified. Final Billings The following procedures will be followed for the issuance of final water and sewer bills for a property. 1. Final water and sewer bills will be forwarded to the owner's solicitor where possible. Where the owner and/or solicitor have indicated that a final bill should be forwarded to an owner, owner's solicitor (whenever possible) will be provided an estimated amount of the final bill. (''b Page2of3 2. If water and sewer final bill amounts are not paid within one week following the due date, a reminder notice will be sent to the owner and the new owner by registered mail. 3. If the final bill amount remains unpaid at the end of the month following the due date the total outstanding amount of the final bill will be added to the tax roll for the applicable property and the property owner and new property owner shall be notified by registered mail. Miscellaneous 1. The Treasurer, or their designate, may at their discretion negotiate an acceptable payment schedule for outstanding water and sewer amounts with an owner of a property. 2. Where an acceptable payment schedule for outstanding water and sewer amounts has been negotiated with an owner of a property, all outstanding amounts including the administrative fee of $50.00 shall be added to the tax roll for the property in the event of a breach of the terms of the payment schedule. 3. Any notices sent by registered mail shall be deemed delivered 3 business days after mailing. The Municipality shall not be held responsible for uncollected or lost mail. Page 3 of 3
