In Camera following regular session under Section 22 of the MGA if required APPLICATION TO RECONFIRM NUMBER OF COUNCILLO RS AND BOUNDARIES OF POLLING DISTRICTS Municipality of the District of Chester NOVA SCOTIA UTILITY AND REVIEW BOARD IN THE MATTER OF AN APPLICATION PURSUANT TO SECTION 369 OF THE MUNICIPAL GOVERNMENT ACT The Municipality of the District of Chester (the Municipality) has conducted a study of the number and boundaries of Polling Districts. The study considered factors such as: effectiveness and efficiency of Council Size, voter parity, community of interest and geography. The Council of the Municipality of the District of Chester therefore makes Application to the Nova Scotia Utility and Review Board to: a) Confirm the number of Councillors at seven (7) b) Confirm the number and boundaries of polling districts. 1. There are, at present, seven (7) Polling Districts in the Municipality and seven (7) Councillors. 2. The following is a brief outline of each Polling District in the Municipality including the names of the larger communities, the geographic size and somewhat relevant geographic features, and any factors which establish a particular Community of Interest in the Polling District. District #1: This District includes the communities Aspotogan, Bayswater, Northwest Cove, Blandford, Deep Cove, East River, East River Point, Otter Point, and part of East Chester. It was created in 1994 when the Board reduced the number of Districts and Councillors from ten (10) to seven (7). It has an approximate area of 114 km2. Most of this District is made up of the Eastern portion of the Aspotogan Peninsula which is generally considered to have a common Community of Interest. In 1994, this District was enlarged to include the Eastern portion of East Chester and East River. In 2006, the boundary between District 1 and 3 was slightly adjusted to reflect the Chester Village and Area planning boundary. The Fire Department in Blandford serves this District with the exception East River and East Chester, which are served by the Chester Fire Department. The Community of East Chester has its own Community Hall. There is a large Community Centre located in Blandford along with various sports fields. The Community of Northwest Cove also has as Community Hall as does the Community of East River. The district is also home the East River Provincial Picnic Park and Graves Island Provincial Park. At Northwest Cove there is a municipally owned wharf which provides access to the water. The Swiss Flight III Memorial Site is located at Bayswater as is a Provincial Picnic Park and Beach. A number of new residential developments have been approved in this area but development has been slow mainly due to economic conditions and market demand. Polling District #2: This District extends from Hubbards to Mill Cove area and includes the western part of Hubbards, Mill Cove, Fox Point, Duaphinee Mill Lake, Simms Settlement, Mill Lake, The Lodge, and Birchy Head. It is approximately 22,034 acres in size. District #2 has an approximate area of 88 km2. There is a Fire Department in Hubbards which includes the hall that serves this District. A new mini home park is under construction in this District which will accommodate just over 70 new housing units. There is a fund called the Shatford Trust Fund for which many residents of District #2 qualify. This fund provides University Tuition and other funding to various organizations and is generally considered one of the factors that attracts younger families to this area. On the former Canadian Forces Base at Mill Cove there are residential complexes served by a municipally-owned sewer system and a Municipal Public Road. In March 2011, the Utility and Review Board approved an application to abandon the Municipal water utility. The former base (Mill Cover Park) is also the location of Aspotogan Consolidated Elementary School and a ball field. Mill Cove Park is also the location of a redevelopment proposal for a residential housing subdivision and golf course. The golf course is currently under construction with the first nine holes scheduled for completion in 2015. Council has also approved amendments to the Municipal Planning Strategy and Land Use by-law that would enable the development of a large residential development. The most recent redevelopment concept for the former Mill Cove Base comprises over 500 additional residential units. Due to its proximity to HRM and Highway 103, combined with the proposed residential development it is anticipated that there could be some growth in this District. The variance in this District is 4.14%, thus it can support additional growth between now and the next review. Polling District #3 This District includes the Incorporated Village of Chester, the Chester Commons area and the Western portion of East Chester. The boundaries of this District were created by the Board in 1994 and amended in 2006 to reflect the Chester Village and Area planning boundary. As the smallest district in geographic size, District #3 is approximately 7 km2. This District also includes a number of Islands in the immediate vicinity. The Village of Chester is home to many of the major recreational facilities for the whole Municipality including the Chester Skate Park, and the Church Memorial Park Arena complex, which incorporates a hockey /skating rink, curling rink, tennis courts, ball field and Chester Brass Band facilities. There is another municipally owned wharf within the Village along with a boat ramp. Within the Village there is also located a Family Resource Center, Shoreham Village Senior Citizens Complex, Chester Golf Course, Chester Yacht Club, the Lido Pool as well as the Chester Area Middle School and the Chester District Elementary School. Much of the shopping and services for the Municipality are located within this District. The Village Commissioners for the Village of Chester operate the Fire Department which in addition to the Village also serves the Chester Commons/East Chester area, and the Marriott’s Cove/Robinson’s Corner area under contract with the Municipality. Currently the Village is the largest area in the Municipality with comprehensive zoning. Development in the Village of Chester occurs mostly in the form of infill or replacement of existing structures. The Municipality recently developed a Highway 3 Streetscape plan. The plan, and subsequent amendments to the Municipal Planning Strategy and Land Use By-law provide for addition residential density along the Highway 3 Corridor. It is anticipated that number of key parcels of land will be developed with multi- unit residential. These developments can be accommodated in the variance of -4%. Many of the residents in the village are seasonal residents who have permanent residences in other areas. It is significant to note that these residents, although not necessarily reflected in the number of electors represented by the District’s Councillors, often require the attention of the local councillor Polling District #4 This District extends from Chester Basin - Chester Grant area and includes Chester Basin, Chester Grant, Borgels Point, and part of Middle River. It is approximately 80 km2 in size. This District has its own Fire Department, Royal Canadian Legion, and Credit Union. It is home to the Basin and Recreational Park, Croft Road playground and green gym, and the Forest Heights Community School. This District also has a restaurant, gas station and pharmacy located within the Community of Chester Basin. There is a busy municipally owned wharf in Chester Basin providing public access to the water and some parking for boaters and nearby businesses. A small municipal sewage treatment facility services several commercial properties in the community of Chester Basin. There is also a municipally owned waterfront property available to the public commonly used to launch small boats. Polling District #5 This includes the communities of Gold River, Western Shore, Martin's Point, Beech Hill and the East side of Martin's River. It is served by a Fire Department located in Western Shore. This District was created in 1994 by combining the former Polling Districts #5 and # 10 and has an area of 131 km2. The major commercial establishments are primarily in the Western Shore area and includes the Atlantica-Oak Island Inn and Marina. This District has a Royal Canadian Legion and a number of Community Halls. In 2013, the Gold River /Western Shore Consolidated Elementary School closed and was the building was transferred back to the Municipality per a deed requirement. Municipal Council recently passed a motion to renovate the former school to house the Community Development and Recreation departments and to provide community recreational facilities. Western Shore also has a fifteen unit Senior Citizens Complex. There has also been a major waterfront development called Wild Rose Park located in the Western Shore /Gold River area and which has become a focal point for residents and tourists alike. Nearby is another municipally owned wharf which accommodates both commercial and recreational activity. Polling District #6 This District includes the communities of New Ross, Seffernville, Leville, New Russell, Aldersville, Harriston, Lake Ramsay, Forties, Franey Corner, and Fraxville. Its current boundaries were created by the Board in 1994. Geographically this is the largest District at approximately 555 km2 and is probably the most rural. District #6 contains many non-resident cottage owners who require services but are not electors. It has its own Fire Department which is located in New Ross. The major community facilities include the Ross Farm Museum, a ten-unit senior citizens housing complex, Royal Canadian Legion, Credit Union, the Greater New Ross and District Community Hall, New Ross Consolidated School, New Ross and Area Family Resource Centre and The Forties Community Centre. This district is also home to the South Canoe Wind Energy Facility, a 102 megawatt facility that is the largest wind energy project in the province. Polling District #7 This District includes the communities lying between the Village of Chester on the East and the communities of Chester Basin on the West. It includes the communities of Marriot’s Cove, Robinson's Corner, Middle River, and the Windsor Road and Canaan. It is approximately 212 km2 in size. It is served under contract by the Chester Fire Department. Some of the major facilities in the District include the Chester Shore Mall, Kaizer Meadow Landfill and Ecopark, and the Community Centre at Canaan. Bonny Lea Farm a residential education facility for special needs individuals is also located within this District. Due to its proximity to Chester, as well as the presence of Highway 14 and Exit 8 off Highway 103, it is anticipated that this area may be a future growth site. The variance of -9.55% will allow for this future growth. The Municipality of the District of was required by Section 369(1} of the Municipal Government Act to conduct a study of the number of polling districts and their boundaries within the Municipality, which considers their fairness and reasonableness and the number of Councillors during 2006. The 2006 recommendation was that the status quo be preserved and this recommendation was approved by the Nova Scotia Utility and Review. Council in this application is proposing to reconfirm the number of Councillors and existing boundaries of the polling districts that presently exist in the Municipality of the District of Chester. The proposal maintains Council with seven (7) Councillors. This is consistent with Section 10 {2) of the Municipal Government Act. 3. The Review Process Prior to this recommendation being made, Council undertook a Governance Review in 2013, to consider the merits of the mayor versus warden systems. In 2014 Council completed the Boundary Review by reviewing both the Size of Council and the Number of Polling District and Polling District Boundaries. a) Governance Review At the September 19, 2013 Committee of the Whole meeting there was a discussion on the Mayor and Warden systems. A staff report was prepared that described the advantages and disadvantages of each system of governance. The minutes from all meetings are attached as Schedule "D". Staff was directed to prepare a public engagement strategy, which was presented to them on October 3 at a Committee of the Whole meeting. Staff reports are attached as Schedule “E”. Public Consultation Ads, Newlsletter website, etc. are attached as Schedule “F”. Council directed staff to undertake a public engagement process which would include dissemination of the information through flyers that were distributed throughout the municipality, social media, the municipal website, and through newsletters. The subject was highlighted in the October 2013 municipal newsletter. An explanation of the two systems was provided along with possible implications. The article appeared on the front page and feedback from the public was solicited. A report on the feedback was prepared for Council. In total there were 50 responses received with 70% in favor of maintaining the warden systems. Most of the concerns on the mayoral system were around the additional costs associated with adding an additional person to Council. b) Size of Council At the May 15, 2014 Council meeting, Council received a staff report and presentation on the Boundary Review and they adopted a process for conducting the required municipal boundary review. Council’s first step in the boundary review process was to determine the ideal number of Councillors to be represented on Council and to then solicit public input on their preferred option. At the May 22 Committee of the Whole meeting, a staff report was presented on the size of Council. During the meeting Council discussed factors such as the number of electors, relative parity of voting power, population density, communities of interest and geographic size. Based on the feedback received during the mayor/warden discussion and the information in the staff report, Council indicated that they preferred the option of seven (7) members of Council. 4. Public Consultation Public consultation for this phase of the project included an articles in the newsletter as well as on the website, however, there were no comments or responses from the public. One council member noted the feedback they received indicated satisfaction with the existing number of Councillors and boundaries. The results of this public consultation were provided to Council at the July 31, 2014 Council meeting. Council noted that in their discussions within their respective communities, there have been no concerns expressed about keeping the size of council at seven (7) and the number of Polling Districts at seven (7), thus one Councillor per Polling District. c) Number of Polling District and Polling District Boundaries Given the amount of information that had been provided to the public on the size of Council and the Polling District number and boundaries, Council felt prepared submit an application to keep the existing number of Districts and the existing boundaries. Development Trends Schedule “H” is a table that shows the data for building permits for new construction from 2008- November 2014. Prior to 2008 the format of the data does not allow for comparable analysis. Based on the data, the following chart provides an illustration of development trends by Polling District. It should be noted that the housing market collapse that occurred around 2008 has affected new housing starts and construction. Given that the overall number of permits is down since 2008, a comparison of the percentage of permits issued in each Polling District is used to help illustrate development trends. The percentage of permits issued in District 1 and District 3 have seen a slight decrease. District 6 has seen some growth. Anecdotally, there has been a strong market in this District for cottages on the inland lakes. District 5 has also seen growth in new construction. Although the trends may not show growth in Districts 1, 7 or 2, each of these districts are potential growth areas due to their proximity to exits off of Highway 103 as well as their proximity to Chester Village and Hubbards respectively. Relative Parity In the process of preparing this application, Council took the number of districts into account. Council was cognizant of the need to conform to the guideline of +/- 10% variance of the number of electors in each polling district. They also realize the importance of geographic boundaries and community identities and communities of interest. In 2006 the Municipality made application to the UARB to confirm the number of Councillors at seven (7). The rationale was that the number of polling districts and Councillors had been operating satisfactorily since being created 1994 and there had been no major changes in either the population or the areas that the population resided in since that time to warrant a change. It was determined by the Council of the day that the factors that were relevant in the reduction of the number of Councillors and polling districts from 10 to 7 in 1994 remained relevant and valid in 2006. 0.0% 5.0% 10.0% 15.0% 20.0% 25.0% 30.0% 2007 2008 2009 2010 2011 2012 2013 2014 2015 Building Permits for New Construction 2008-2014 District 1 District 2 District 3 District 4 District 5 District 6 District 7 The population of the Municipality, and its distribution, remain fairly unchanged from its circumstances in 2006. Based on data from Statistics Canada, the population of the Municipality in 2006 was 10,741 and in 2011 the population witnessed a slight decline of 1% to 10,599. This indicates that the population for the municipality has remained fairly stable. Using municipal voting data from 2008 and 2012, the distribution of the population of the Municipality, based on the number of electors in each polling district as a gauge, has also remained fairly stable, with a few exceptions. The following table shows results from the 2012 Municipal Election. It shows a comparison of the number of electors per polling district between the 2008 and 2012 elections, both of which encompass the boundary changes made in 2006. Although all districts saw a slight decrease in the number of electors, the major decreases were witnessed in District 3, primarily due to a decrease in electors at the Shoreham polling division and in District 2 due to a decrease in electors primarily in the Mill Cove area polling division. In the Municipality, the average number of electors per District is 1117.71 (rounded to 1,118). Rationale for Reconfirming Numbers of Councillors The chart below illustrates the changes in representation if the size of Council were to increase or decrease by up to two Councillors. The Proposal a) It is proposed that the current number of Polling Districts at seven (7), the current number of Councillors at seven (7), and the current District Boundaries be confirmed. The current number of Polling Districts and Councillors has been operating satisfactorily since being created in 1994 and there have been no major changes in either the population or in the areas that the population resides since that time which would warrant a change in the number of Polling Districts and Councillors. The factors that were relevant to the reduction from ten (10) to seven (7) Polling Districts in 1994 remain relevant and valid at this time. b) The existing boundaries were confirmed by the Utility and Review Board in 2006. The boundaries continue to correspond both with Community of Interest and fall within the ten (10) percent variance of the mean as directed by the Board. c) Descriptions for each of the Polling Districts are attached as Schedule "A". The Recreation Committee would like to distribute these funds to the community through a fair and equitable process. RECOMMENDATION: It is recommended that Council amend motion 2014-512 so that the recreation committee can make better use of the remaining grant funds available. The recommendation is first, to use $6,150 for a second call for grant applications with a deadline of Friday, February 6, 2015. Second, that $500 be kept for new group start-up and third, that prior to year end, if there are any remaining recreation grant funds, they be reallocated to PRO Kids. BACKGROUND: On October 30, 2014 Council made a motion (motion 2014-512) to approve the recreation committee’s grant recommendation: It was decided that if the remaining $6,650 was designated only for new group startup the funding would most likely not get used by the community. However, a second call for applications would probably generate interest in the community and the ability for the recreation committee to allocate most of the budgeted funds for this fiscal year. Amongst various projects, Minas Energy was to complete a feasibility study for anaerobic digestion at Kaizer Meadows. The electricity that would be the final product from such a process, would then be fed into the electrical distribution system. MODC would receive a rate per megawatt hour (MWh) for the same. On behalf of MODC, a COMFIT application has been made and approval is pending. The COMFIT application process requires that the applicant demonstrates community support for such a project RECOMMENDATION: That Municipal Council provide a letter to support the COMFIT application, indicating is opinion of the presence of community support for the project BACKGROUND: In April 2014 MODC engaged Minas Energy to undertake the exploration of potential renewable energy opportunities. Part of this involved a feasibility study for Anaerobic Digestion for Source Separated Organic Material. Biogas produced from the process would be combusted in an internal combustion engine, combined heat and power unit, which will ultimately produce electrical energy which will be fed into the electrical grid system. MODC would receive a rate for this of $175 /MWh. This would take place at the Kaizer Meadows site. An Environment Impact Statement completed by Strum Consulting notes that the estimated daily fuel input rating would be less than what is required for the Environment Assessment and as such is an Environmental Assessment is not required. 2. Municipal Planning Process / Designations. Planning Designations /LUB Zones provide an indication of how a community wishes to see development occur in a particular community. Any uses of concern are normally controlled. The designation / zone for this area is General Basic. The General Basic Zone requires any uses that require an Environmental Assessment or an Approval under the Activities Designation Regulations to be permitted by Development Agreement. The use will required an amendment to the Industrial Approval for the Kaizer Meadows site under the Activities Designation Regulations. The Municipality owns the lands upon which the development is to occur. The Development Officer has confirmed that the proposed processing use would be permitted as of right. 3. Community Meetings- Prior to COMFIT approval the applicant is required to host two community meetings. This has not yet been done. It has been suggested by Minas Energy that a letter from Municipal Council outlining its position that there is community support will suffice at this point. IMPLICATIONS: 1 Policy: n/a. 2 Financial/Budgetary: • The feasibility study is still under review and thus a decision respecting the project and the financial benefits / costs has yet to be finalized. 3 Environmental: • An Environmental Impact Statement prepared by Strum Consulting notes that “the project is expected to have little to no effects on the environment” any impacts will be able to mitigated through management practices 4 Strategic Plan: • Maintain a high level of fiscal responsibility • Ensure sufficient infrastructure is available to best serve our residents and businesses 5 Work Program Implications • Undetermined.
