APPROVAL OF AGENDA Moved by: Councillor MacLeod Seconded by: Councillor Nelson THAT the Committee approve the agenda as presented. Motion Carried 2. RECORDING OF ATTENDANCE 3. DISCLOSURE OF CONFLICT OF INTEREST No members present declared a conflict on any of the items on the agenda at this time. 4. APPROVAL OF MINUTES Moved by: Councillor Maguire Seconded by: Councillor Brenan THAT the Committee approve the minutes of meeting 01-23 as circulated. Motion Carried 5. DELEGATION 6. POLICE SERVICE REPORT Sergeant Tyson Nelson reviews with the Committee the January 2023 statistics: 2 - 235 Total calls for services in January. - 1 call on O'Connell set on fire. - 1 call, fight at high school - 1 Assault between 2 women - 4 Break & Enters - seem to be up in numbers. - 1 Church Avenue - 8 speed patrols, 1 ticket & 5 warnings & 1 check stop. - 1 Arrest - Breach of Conditions. - 1 Drug trafficking arrest, Canada wide warrant. - 1 Scanning calls. - 1 Community mailbox break & enter. - 1 Impaired driver - 1 Suspension of license. - 1 Operation of motor vehicle without license. - 9 Shop lifting. - 6 Calls on man dressed as an animal. - 2 Drug possession - 1 Robbing in town. Stolen laptop and phone returned. - 1 Theft of a motor vehicle. - 16 Accidents, non -serious. 38 tickets and 38 warnings - Patrols on south of Main Street completed in January. - 3 new positions approved. Mr. Brian Seymour spoke of concerns related to an RCMP inquiry in 2018 related to his phone being hacked. Another question on who to contact at the RCMP. Sgt. Nelson to contact Mr. Seymour on February 14th, 2023, if he is able to provide his contact number. 432-5885 was provided to the Sergeant. Mr. Seymour commented that he has concerns related to RCMP "soldiers", believed to be in reference to an RCMP member, as he left the Council Chambers. Brief discussion on the recent patrols on Church Avenue and the speed radar checks. Mr. Chris Weston presented the Committee a petition related to Church Avenue. His perception is the speed is so critical that someone is going to get killed. Brief discussion on issues. Ongoing patrols planned. 6.a RCMP Quarterly Report RSC 8 4th Quarter 2022 RCMP 3rd Quarter 2022 RSC8 Report received and filed by the Committee. 3 7. ANIMAL CONTROL REPORT By-law Enforcement Officer Butcher reviews with the Committee the January 2023 Animal Control Report. 7.a ANIMAL (DOG) BITE - 80 ALBERT STREET By-law Enforcement Officer Butcher reviews the 80 Albert Street Report filed by the Animal Control Officer. Moved by: Councillor Nelson Seconded by: Deputy Mayor Wilson THAT By-law Enforcement Butcher proceed with investigation of the dog bite at 80 Albert Street. 7.b EMAIL WINNIE KELLY SHARP ZONING CONFIRMATION REQUEST By-law Enforcement Officer Butcher reviews the email received from Winnie Kelly Sharp related to the zoning confirmation for NBSPCA for her dog kennel at 1105 Main Street. 7.c IOM BY-LAW ENFORCEMENT OFFICER -1105 MAIN STREET - DOG BREEDER CAO Hatcher reviews the zoning confirmation letter requirement. The Committee requests town administration review the issue and draft a response at a future meeting for Committee consideration. 8. FIRE SERVICE REPORT 8.a IN TOWN CALLS Chief Reicker reviews the in -town calls for January 2023 with the Committee. There were 16 calls in January 2023, 7 calls in January 2022. There were 16 calls year to date January 2023, 7 calls year to date in January 2022. - 1 Alarm Response — Residential — Non -Human Error - 3 Alarm Response — Comm/Ind — Human Error - 1 Alarm Response — Comm/Ind — Carbon Monoxide - 2 Major Structure Fire — Residential - 3 Flue Fires - 2 Vehicle Fires - 1 MVC - 1 Hazmat - 1 Public Assistance - 1 Medical Assistance 4 8.b OUT OF TOWN CALLS Chief Reicker reviews the out-of-town calls for January 2023 with the Committee. There were 8 calls in January 2023, 14 calls in January 2022. There were 8 calls year to date 2023, 14 calls year to date in 2022. - 2 Minor Structure Fire — Residential - 1 Hydro Pole/Downed Wires - 1 Vehicle Fires - 2 MVC - 1 Grass/Brush/Mulch Fire - 1 Medical Assistance Grand total of 24 calls in January 2023, compared to 21 in January 2022. 24 grand total calls year-to-date, compared to 21 total calls for the same period in 2022. 8.c VOLUNTEER HOURS Chief Reicker reviews the report which indicated that the number of volunteer hours by fire service personnel for the month of January 2023 totaled 131.50 hours. Volunteer hours for the same period last year totaled 2.00 hours. Details of volunteer hours include the following: - 17.00 Monthly Meetings - 9.00 Officers' meetings - 2.00 EMO radio - 103.50 In-house training - $2,175.01 cost equivalent of volunteer hours. The volunteer hours for this year to date totaled 131.50 hours, and in the same year to date in 2022 were 2.00 hours. Total hours for fire calls in January 2023 are 504.00 hours in comparison to 309.00 hours for the same period in 2022. There were 504.00 total hours this year to date, and 309.00 hours for the same period 2022. 8.d SUSSEX FIRE DEPARTMENT - REGULAR MEETING MINUTES JANUARY 05, 2023 Chief Reicker reviews Regular Meeting Minutes from January 5, 2023. Minutes received and filed by the Committee. 8.e SUSSEX FIRE DEPARTMENT OFFICER'S MEETING MINUTES - DECEMBER 29TH, 2022 Chief Reicker reviews the Officer Meeting Minutes of December 29, 2022. Minutes received and filed by the Committee. 5 8.f SUSSEX FIRE - FIRE PREVENTION & SAFETY EDUCATION REPORT JANUARY 05, 2023 Chief Reicker reviews the January 5, 2023, Fire Prevention Report. Received and filed by the Committee. 9. BUILDING INSPECTION / BY-LAW ENFORCEMENT REPORT 9.a MONTHLY BUILDING PERMIT REPORT TO COMMITTEE The Monthly Building Permit Report indicated that 6 permits were issued during the month of January 2023 with a total evaluation of $121,501.00 while January 2022 permits were valued at $6,830,561.00 in Ward 1 and $0.00 in Ward 2. 9.b MONTHLY BUILDING PERMIT REPORT TO COUNCIL Report to Council will be filed with Council at their regular meeting. 9.c BUILDING PERMIT ENFORCEMENT Building Inspector Butcher indicated that there is nothing new to report on this item at this time. 9.d ENFORCEMENT AND BY-LAWS 9.e BY-LAW ENFORCEMENT Nothing new to report at this time. 9.f GENERAL 9.g REQUESTS FOR APPROVAL 9.g.1 NBBOA - ANNUAL CONVENTION & MAINTENANCE TRAINING COURSE Moved by: Councillor Brenan Seconded by: Deputy Mayor Wilson THAT Committee recommend to Council that Council approve the registration of two staff members to attend the NBBOA Annual Convention and Maintenance Training set to be held in Dieppe, NB. from March 29th to March 31st, 2023, at an estimated cost of $2,371.60 inclusive of HST. Motion Carried 10. BUSINESS ARISING OUT OF MINUTES 6 11. NEW BUSINESS 11.a FIREFIGHTER HELMET PROCUREMENT 11.a.1 IOM CHEF REICKER FEBRUARY 13, 2023 Chief Reicker reviews with the Committee the equipment purchase recommendation. 11.a.2 IOM PURCHASER SCOTT - QUOTATION PURCHASE RECOMMENDATION Moved by: Deputy Mayor Wilson Seconded by: Councillor MacLeod THAT the Committee recommend to Council that Council approve the purchase of 8 MSA Cairns 664 Invader Firefighter Helmets from Levitt Safety fora cost of $4,772.32, HST included. Motion Carried 11.b RISING STARS DAYCARE 11.b.1 Regional Services Commission Approval - 17-01-2022 Councillor MacLeod expresses concern related to the 2022 approval of the Rising Star Daycare at the intersection of Main Street and the entrance of Skyline Avenue. CAO Hatcher and Building Inspector Butcher review the two approvals granted to the owner/operator of the Daycare by the Regional Service Commission 8. On January 17, 2022 the RSC granted approval of a "similar to a legal non -conforming" use application without Council review or input during the approval process. 11.b.2 RISING STAR DAYCARE - VARIANCE APPROVAL - JULY 12, 2022 A second variance was granted in July 2022 related to fence height for a playground enclosure. Lengthy discussion on the approval process. Additionally, Councillor MacLeod expressed concern on the on -street parking at times of day where ingress and egress is very difficult entering the subdivision. By-law Enforcement Officer Butcher has spoken to the business owner related to the on -street parking. Ongoing monitoring will continue. Councillor MacLeod expresses concerns on the number of children using the playground at Skyline Avenue. 7 12. PERSONNEL 13. ACCOUNTS Moved by: Councillor MacLeod Seconded by: Councillor Nelson THAT the Committee recommend to Council that Council approve for payment the Protective Services Committee accounts for the month of January 2023 totaling $38,123.22. 14. DATE OF NEXT SCHEDULED MEETING - MARCH 13, 2023 The next regular meeting is scheduled for March 13th, 2023, at 6:00 pm. 15.
