The By -Law shall be known as the Tax Exemption By -Law. 2. The real property of the organizations or institutions named in Schedules "A", "B", "C", "D", & "E" to this by-law that would otherwise be classified as commercial property shall be exempt or taxed in accordance with the particular schedule as well as the business occupancy of licensed day cares named in Schedule "E". 3. The partial or total exemption provided in Section 2 shall apply only to that portion of the real property specified in the schedule. 4. When a property, or part thereof, listed in a schedule ceases to be occupied by the association or for the purposes set out in the schedule then the partial or total exemption from taxation shall cease and the owner of the real property shall immediately be liable for the real property tax on such real property or part thereof for the portion of the year unexpired. S. This amended By -Law shall have the effect commencing in the Municipal taxation year 2014/15. In 2014, we had significant issues with the electrical components of this device which put the unit out of service for approximately 6 months of the year. I have expressed my displeasure with our vender for what I viewed as unacceptable repair times however I was told the delay was due to a shortage of parts. In any event, we received the unit back approximately 3 months ago from the repair shop and I have been assured the problems have been rectified. My fingers are crossed. The amount of snow since January has resulted in a lack of appropriate and/or safe locations to place this unit without causing more risk for damage. Unfortunately, for this reason I don't foresee getting the unit back on the road until May when hopefully the snow/salt/road shoulders are cleared up. My commitment at that time is to use it on a weekly basis throughout the May - December time -frame (weather permitting). Please don't hesitate to send me a list of desired deployment locations where Council would like to see this unit placed. Based on the calculations the overall availability percentage of 94.46% for the fiscal year (Enercon guaranteed 95%) we should receive a credit of $3,926.92. The actual revenue received by NS Power may be slightly different from the Enercon figure as they "read the meter" on a date that may not coincide with the Enercon report. CARRIED. 2015-109 ADJOURNMENT REPORT TO SUBMITTED BY DATE SUBJECT ORIGIN CURRENT SITUATION: MUNICIPALITY OF THE DISTRICT OF CHESTER Tammy Wilson, CAO Sarah MacKelvie, Civic Address Coordinator April 8, 2015 New Road Name off of Highway 3, Marriotts Cove 5.1 An easement has been registered to give access to 6 recently subdivided properties off of Highway 3 in Marriotts Cove. The developer has proposed to name the road "Cove Ridge Road". RECOMMENDATION: It is recommended that Municipal Council approve the road name "COVE RIDGE ROAD". BACKGROUND: Road names can be proposed through the subdivision process, where the road will be accessing three or more addressable locations. When this particular petition process started, the new road led to four properties, one of which had an assigned civic address off of Highway 3. Two more properties have since been subdivided which will be accessed by the new road. There are two property owners involved in the petition. R® erred, MAR 19 H15 04011W to --- RevleMd by March, 8, 2015 Warden,Allen Webber, and Councillors of Chester Municipality Chester District Municipality, PO box 369,151 King St. Chester NS B.OJ 1 JO Warden Webber, I am contacting you at the direction of the membership of Fox Point Lake Nome/Lot Owners Association , further referred to as: FPLHA, At our most recent meeting a motion was passed to ask the Chester Municipal Council to request the Minister of the Environment, Nova Scotia to intervene strongly in the matter of ongoing and extensive slltaticn/runoff from The Aspotogan Ridge Golf and Residential Development project site. As you are aware we have been subjected to ongoing and relatively unabated run off of silt and other contaminants into Fox Point lake for approximately 9 years,since the beginning of construction phases of this project. The damage is the result of construction of an 18 hole golf course adjacent to Fox Point Lake which is intimately associated with the lake watershed. We are convinced that the actions of the developers have seriously compromised and damaged the area adjacent to the watercourses which run through the project site and then downstream into Fox Point Lake. it is very clear that whenever construction is underway and there is even minimal rainfall the lake is inundated with huge amounts of silt etc... to the point of rendering the water opaque in the two southern coves. The silt gradually disperses throughout the entire body of water. We are very unhappy with the efforts of the developer to mediate this situation and are in grave fear for the health of our otherwise very clear and bountiful lake. All of our efforts to be pro -active and avoid possible environmental disaster In the lake have appeared to fall on deaf ears whether it be the developer, the Nova Scotia Department of the Environment ,Dept. of Fisheries, Coast Guard. We feel that our overtures to the Minister would be reinforced with the active support of the Municipality. We know that several councillors are sympathetic to our dilemma and we feel the Municlpality's support of our efforts would have positive impact on our further communications with the Minister's office, Could you please respond with any decisions Council makes in regard to our request.
