anaerobic digestion issued. Report to Council in
September regarding results of EOI. A decision has
been made by Council to defer any decision on
moving forward with the Anaerobic Digestion until
such time as the status of the COMFIT approval has
been determined, and there is more clarity around
volumes

been submitted to the Department of Energy.

have continued to meet with Ad Hoc Committee to
complete this review. On July 20, 2015 the Committee
deferred further work until a decision was made by
Council respecting the recent withdraws from the
FAC. Council has deferred this matter.

geared towards managers and supervisors. It was

It is much harder to accomplish these milestones in solitude; working together with the
appropriate people in the FAC provided a framework for synergism.

WHEREAS the Municipality of the District of Chester ("Municipality"), on
behalf of the Mill Cove Park Water Utility ("Utility"), made an Application to the Nova
Scotia Utility and Review Board ("Board") for approval to abandon the delivery of water
to its customers pursuant to the Public Utilities Act ("Act");
AND WHEREAS after due public notice a hearing was held on January 19,
2011, and the Board issued its Decision on the 28th day of March, 2011;
AND WHEREAS the Board directed the Utility that conditions be met prior
to granting approval of abandonment;
AND WHEREAS by letter dated October 22, 2015, the Board confirmed it
considers that the conditions have been satisfied;

I write to follow LIP on the commitment I made at the October 22n" UNSM/Provincial
Roundtable Meeting to continue dialogue on the issue of the alternate dispute resolution
mechanisms. Specifically, the UNSM request for the Province to establish legislation/regulation
which would allow "unilaterally imposed" binding arbitration to determine cost sharing
between municipal units for services and facilities; and, to determine land use planning
matters,
During Our discussion at the Roundtable meeting I indicated I Was not Supportive of the
proposal. I reiterated the concerns raised in my September 3, 2015 correspondence; and,
Minister Furey's June 11, 2015 correspondence (attached),
As Minister of Municipal Affairs I have, and will continue, to promote principles that support
municipalities as an order of government with elected Councils that are responsible and
accountable for making decisions for the communities and citizens they represent. A recent
example of my commitment to these principles, and the associated role of the Department,
relates to fhe delivery of fire and emergency services in the Windsor/West Hants area, As you
may know, the West Hants Council has decided to discontinue a service sharing arrangement
with the Windsor Fire Department and has established additional capacity to deliver fire
services with the Municipality,

The Department supported a collaborative decision making approach for the matter including
the provision of financial support for a mediation process that both parties willingly
participated in. The mediation process did not produce a long term solution so the mediator
provided a series of eight recommendations developed to form the basis of a new contact.
The West Hants Council accepted the mediator's recommendation but the Windsor Fire
Department did not. I did not intervene, and the Department of Municipal Affairs did not
intervene, in the decision making process. Moreover, I did not support the establishment of a
mechanism for a decision to be imposed on either the Windsor Fire Department or the
Municipality of West Hants. local governance and decision making was respected and service
delivery continues under a new arrangement. Those responsible for the services made the
decisions and the communities and citizens they represent will hold them accountable for their
decisions.
The Department will continue to be supportive of municipalities that have agreed to work
together to find solutions for cost shared services, facilities, planning and governance, etc.
Examples of bold and courageous leadership such as the governance and structure initiatives in
Springhill, Bridgetown, Hantsport, Parrsboro, Mulgrave and Pictou County have received the
support of the Department and Government. The Department will continue to provide human
and financial resources for significant collaborative initiatives that advance regional service
delivery for local government. This is aligned with the Call to Action to Nova Scotians presented
In the One Nova Scotia Report; and, this is the approach that I will take as the Minister of
Municipal Affairs.
The Department is supportive of robust alternate dispute resolution mechanisms for shared
services, etc. In that regard, I will agree to advance legislative change to the MGA that would
establish a requirement for dispute resolution mechanisms in intermunicipal service
agreements created pursuant to Section 60. This will allow the elected councils of the
municipalities that are party to these agreements to decide whether or not binding arbitration
is a suitable mechanism when the need arises.
The UNSM can also advance binding arbitration as a dispute resolution mechanism for
intermunicipal agreements without the requirement for new provincial legislation/regulation.
The work the UNSM did in establishing a model code of conduct for municipal councils is an
example of UNSM Leadership on an initiative important to the UNSM membership.

If there is strong, or indeed unanimous, support from the UNSM membership for the binding
arbitration mechanism then the UNSM might consider the option to develop an intermunicipal
agreement to establish the requirement. The agreement could be entered to municipalities
within regions that support it; or, even by all municipalities in the Province. I will leave the
decision as to how the UNSM might pursue municipal leadership on this matter to the Board,

I am writing in response to your July 30, 2015 letter on behalf of the Union of Nova
Scotia Municipalities (UNSM) regarding the topic of binding arbitration. Let me begin by
thanking you and Mayor Corkum, along with all municipal staff and elected officials who
helped develop the Towns Task Force recommendations.
I support to goal of creating less confrontational ways to resolve service delivery issues
and the Towns Task Force recommendation to strengthen inter -municipal agreements.
Our hope is that through the Partnership Agreement, we can advance a set of proposals
that will require municipalities to include mutually agreed upon dispute resolution clause
into inter -municipal agreements.
However, I am concerned that allowing municipalities to impose binding arbitration on
their neighbours will lead to unwanted outcomes and run contrary to the foundations of
democracy. Instead, I support facilitated mediation as a path to achieving mutual trust
and common goals.
I appreciate your position on this issue, and we look forward to developing a mutually
agreed upon dispute resolution framework through the Partnership Agreement,

Spring Conference regarding the topic of binding arbitration,
It was obvious that your passion for this topic highlights your position that binding arbitration is an
imperative component of the Partnership Agreement. Further, you express that binding arbitration ba
"hill to die on". VVN|a | admire your conviction, the matter of binding arbitration roqu|nou careful
consideration and | am not certain that |t/uthe solution bosolving disputes between municipalities.
In my speech | noted an eXgnnphe of the Mariners Centre located in the Town of Yarmouth. While the
Town has been the sole financial contributor (nterms ofoperational and capital expenditures, there was
evidence that the centre has been used by residents of the Town and County of Yarmouth as well as the
District ofArgyle. Through negotiation, all parties found a solution whereby all could agree onthe mutual
share ofthe financial contributions.
The fact that the elected bodies found compromise in a shared service agreement sends a clear message,
The consultative manner that enabled a mutually beneficial solution represents the democratic
foundation which rests with municipal government.
| fear that an approach such as binding arbitration will be counterproductive and contrary to the
foundations of democracy as well as my principal position of progressive and productive dialogue,
instead, facilitated mediation may be an approach that is more comparable to one that is premised on
mutual trust and common goals.
The insertion that binding arbitration must be included hlthe Partnership Agreement isunfortunate. The
essence of partnership will require careful negotiation and consideration from both the Province and
UNSM. Municipal Affairs supports a dispute -solution framework.

At the October 14, 2015 regular monthly meeting of the Village of Chester
Commission, I was asked to contact the Municipality concerning the Village of
Chester's interest in the fate of the Annex Building. The Village of Chester
Commission would respectfully request that any decision to demolish the Annex
Building be postponed until such time as possible alternatives can be fully explored.
One of the suggestions that I believe is already before Council has been a proposal
by Nancy Green, working with Affordable Housing NS and CMHC, to explore the
possibility of converting the Annex Building to affordable housing. The Village
Commissioners would strongly support this move.

SUBJECT: Otter Point Lift Station Improvements
BACKGROUND:
The relocation of the lift station in the Otter Point Subdivision was part of this year's capital budget, at
an estimated cost of $40,000, net HST. The purpose of this project was to relocate the station away
from the road surface to minimize infiltration and the amount of debris entering the lift station which
is causing the pumps to prematurely fail. Furthermore, the pumps themselves do not seem to working
properly due to incorrect sizing. The project included the redesign of a new submersible lift station,
the supply and installation of new pumps, piping and hardware, with its installation on the same plot
of land, own by the Municipality, as the existing station. The work was planned to be completed in
September, when the demand on the lift station is reduced, due to seasonal occupancy.
RECOMMENDATION
That Municipal Council approve a Phased Work Plan for the Otter Point Lift Station Improvements,
with Phase 1 to be completed this fiscal year, at an estimated costs $20,000, net HST; and Phase 2 to
be completed in 2016/17 at an estimated costs of $25,000, net HST.
DISCUSSION:
To date, this project has not been started, and staff are concerned that we will run into serious
operational issues this winter if the lift station is not repaired to some extent as soon as possible.
Therefore, in order to deal with the immediate issue of improving pump operation and ensuring
service to public; staff are suggesting a phased approach to the repairs, which would take place over
two (2) fiscal years.
Phase 1 (Fiscal 2015-16) - this will general include the removal of pumps, piping and hardware from
within the existing lift station, install new pumps, piping and hardware, along with new electrical
conduit to the pump house, and reconnection to the existing forcemain. Service will not be interrupted
for the public and site safety will be of upmost importance for staff, contractor and public. It should be
noted that at this time, we will complete a geotechnical investigation and to ascertain the height of the
water table in order to determine if the next phase is feasible. The cost to the complete this work is
estimated to be $20,000 net HST.
Phase 2 (Fiscal 2016-2017) - this will include the installation of new wet well, the connection of the
new wet well and existing station via a 300 mm (12 inch) main line, the removal of the pumping,
piping and hardware and their re -installation into the new wet well, converting the old station into a
storage wet well to increase capacity of the lift station and installing a new cover. The cost to complete
this work is estimated to be $25,000 net HST.
IMPLICATIONS:
1 Policy:
Staff has contacted other reputable companies who have experience retrofitting an existing live lift
station, to date only one (1) company has shown any interest, 1. R. Eisener' s Contracting Ltd.
Therefore, due to both the criticalness of the work and the lack of interested contractors staff will
be awarding the work under the Alternative Procurement Method , as per MODC Procurement
Policy (P-04).
2 Financial/Budgetary:
The Capital Budget for 2015/16 included funds in the amount of $40,000 for the completion of
this project. By employing a phase approach, it is estimated that the total project costs will exceed
the project budget by approximately $5,000, with costs to be incurred as follows:.
2015/16: $20,000
2016/17: $25,000
3 Environmental:
By not completing the repairs as detailed above, as soon as possible, we risk the loss of service to a
majority of the systems customers and an uncontrolled overflow.

The winter season is quickly approaching and winter weather conditions can only exasperate an
already bad situation.

being considered will include service structures, service standards, mutual aid, and
financing.
Another area for consideration is the governance structure of villages as well as the
mechanisms that ensure the effective delivery of village services. Topics for
consideration will include but not be limited to: governance and service structures,
service standards and the election process.
