In Camera following regular session under Section 22 of the MGA MUNICIPALITY OF THE DISTRICT OF CHESTER REQUEST FOR DECISION/DIRECTION REPORT TO Warden Webber and Members of the Committee of the Whole SUBMITTED BY Tara Maguire, Community Development Director DATE July 15, 2016 SUBJECT Decision on RFP For Purchase and Use of Gold River Western Shore School ORIGIN Procurement Process - T-2016-011Purchase and Use of Gold River Western Shore School ______________________________________________________________________________________________________________________ CURRENT SITUATION: The RFP T-2016-011 for the Purchase and Use of the Gold River Western Shore School closed on June 3, 2016. One submission was received from Heather Brooker. Council directed that the evaluation of the proposal be completed by Council as this is a land disposition subject to negotiation with any successful proponent. Consequently, Council is required to make a decision respecting the proposal. RECOMMENDATION: That Council not award the RFP 2016-11 Purchase and Use of Gold River Western Shore School; and That Council direct staff to up date pricing for demolition and bring forth a demolition plan/timeline DISCUSSION: At the July 7 Committee of the Whole, an in camera report (land negotiations) dated June 23, 2016 was presented by the CAO. The report contained an analysis of the proposal that was received. On July 11, a community meeting was held in Western Shore. A brief overview of the analysis was presented that indicated the strengths and shortfalls of the proposal. Council presented a proposal to the community that involved demolition of the building and keeping the land as municipal property. In 2013, when Council was presented with the initial options regarding the disposal or use of the Gold River Property staff obtained an initial quote from a contractor for the demolition of the building. The cost was in the range of $130,000 to $150,000. The quote was informal and council was informed that a more precise costing would be required if the option to demolish was pursued. In order to proceed with the proposal that was presented to the community on July 11, Council needs to make a final decision regarding the responses to the proposal call. Staff also requires direction regarding trhe next steps for any potential disposal of the property. Options for Consideration The Request for Direction, Re: RFP -Purchase and Use of Gold River Western Shore School dated June 23, 2016 provided an analysis of the advantages and disadvantages of the options for the proposal call. The following options are presented to Committee of the Whole: 1. Recommend that Council refuse to accept the proposal and advise the applicant of the same. 2. Recommend that Council request the applicant to submit information lacking in proposal. 3. Recommend that Council agree to enter into an agreement with the proponent as proposed, with a modifications. Direction to staff is also required regarding the next steps. The following options are presented for consideration: 1. Recommend that Council direct staff to obtain an updated quotation for the cost to demolish the school to present to Council. Further that staff prepare a timeline and proposed action plan for the demolition of the school. 2. If option 2 or 3 above is selected, recommend that Council direct staff to continue to maintain the building and present Council with a report outlining what would be required for winterization of the structure. Director of Engineering & Public Works DATE: July 13, 2016 SUBJECT: Western Shore Pump Station 2 – Vibration Issues ORIGIN: Capital Project – Wastewater Collection System Upgrades ______________________________________________________________________________________________________________________ CURRENT SITUATION: Following the completion of the forcemain upgrades in Western Shore last fall, a resident adjacent to the lift station has been experiencing regular occurrences of noise and vibration within their residence. After completing a number site inspections, with the assistance from our Engineering Consultant at the time as well the Pump Manufacturer, the problem persists. RECOMMENDATION: It is recommended that Staff further investigate and solve the problem, utilizing unbudgeted allowance not to exceed $15,000.00 net HST, reporting to Council if an exceedance is anticipated, for further direction. Options for funding the unbudgeted expense are Sewer Reserves or General Operating Reserves, if required (no surplus at the end of the year) BACKGROUND: On December 1, 2015 a resident, located at 7 Swinamer Road, visited the office with two (2) concerns. They experience regular noise and vibration (i.e. Shaking the pots and pans) within their home, which is most notable during the heavy rain events. Additionally, they are experiencing drainage of road runoff onto their property. The drainage issue was considered a warranty issue with repairs scheduled and completed in the spring. The vibration issue was referred to SNC Lavalin Inc (SLI) for review and comment. On December 8, 2015 a field inspection was completed by MODC and SLI with a subsequent report being received on January 29, 2016. SLI stated that the forcemain was constructed in accordance with the drawings and specifications, therefore they recommended the focus of further investigation be at the pump station. On March 2, 2016 an additional field inspection with both SLI and Xylem (Pump Manufacturer onsite) was completed. The results of the inspection were as follows: 1. Pump 1 was recently serviced and performed without any irregularities. Pump 2 was clogged and had a failed seal. The unit was removed for repairs and a replacement pump was installed to complete the inspection. 2. It was felt that the noise and vibration in house was mostly caused by vibration transmission from the pump station (i.e. pumps), as a result of the pump operating at a lower efficiency. 3. SLI recommended to fully open the interconnection (i.e. isolation valve) between the two (2) forcemains in the wet well and confirm that all valves are fully open 4. SLI recommended to raise the pump on/off floats On April 27, 2016 staff manipulated the isolation valve, where it currently resides fully open. It was confirmed with the resident that this change had no effect on the noise or vibration, furthermore, by utilizing both forcemains simultaneously, we have removed the design duplicity which would be an issue if there was a forcemain break. On June 3, 2016 staff issued a RFP to the three pre-qualified firms. Upon review, based on the evaluation criteria, staff have recommended to the CAO the award of work to Stantec Consulting Inc in the amount of $6,800 plus HST. The award of this work is pending CAO approval (subject to approval of unbudgeted expense.) On June 17, 2016 staff performed another inspection in relation to the resident’s service connection, since it was thought that the forcemain may have been inadvertently installed very close. It was confirmed that this situation was not the source of vibration and noise. DISCUSSION: N/A IMPLICATIONS: 1 Policy: P-04 Procurement Policy 2 Financial/Budgetary: Recommended an unbudgeted expense of $15,000 net HST for the FY 2016-2017. The unbudgeted expense provides both a consultant allowance as well as a contractor allowance. In this case, since the project is still under warranty, staff plans to work with the contractor who installed the forcemain last fall, G.K. Morse Trucking Ltd. It should be noted that the capital project completed last year was under budget by approximately $275,000. Options to fund this unbudgeted expense are Sewer Reserves or Operating Reserves if required (i.e. no surplus at the end of the fiscal year) 3 Environmental: N/A 4 Strategic Plan: 1.Ensure sufficient infrastructure is available to best serve our residents and businesses 5 Work Program Implications: ATTACHMENTS: OPTIONS: 1. This Policy is entitled "Fees Policy ". 2. This Policy applies except to the extent of any conflict with applicable provincial legislation, and, where the fee amounts in this Policy differ from those set out in a By -Law, Recorded Resolution, Policy or Resolution of the Municipality of Chester in effect on the effective date of this Policy, the fee amounts set out in this Policy shall amend those previously in effect. 3. The fees to be paid to the Municipality of Chester for licenses, inspections, permits, applications, approvals, animal impoundments, or services are set in, or amended to, the respective amounts shown in the Schedule A attached. 4. Staff will review Schedule A on an annual basis and recommend changes, if any, to council. 5. Provision is available to waive fees for non-profit groups or associations that do not have the ability to raise revenue via taxation, with the exception of Fire Commissions for Letters of Concurrence. It is number 11 Herbert Road. The building has been on the unsightly premise list before and is currently off the list based on the owner securing the building. Policy P-20 does not enable exemption for non-profit organizations that have taxing powers of which Fire Commissions do. The Fire Commission has been advised of this and would like Council to consider revisions to Policy P-20 (see email attached) OPTIONS There are three options for consideration. 1. To grant full exemption for tip fees approximately $1200 (will require an amendment to Policy P-20) 2. To grant partial exemption on to these at 50% approximately $600 (will require an amendment to Policy P-20) 3. To not grant an exemption approximately $1200 (Complies with Policy P-20 as written) BACKGROUND: This property is a former residential two-story house and has not been inhabited for a number of years. This property was on a the unsightly premise list number of years ago and was secured from entry at that time as well as the same solution utilized in his most recent appearance on the list DISCUSSION: IMPLICATIONS: 1 Policy: Policy P-20 does not enable an exemption to tipping fees for Fire Departments. The Policy would require revision to enable an exemption. 2 Financial/Budgetary: The tip fee being considered would be approximately $1200. The on-site work by staff and equipment is minimal. This material would be deposited in our mixed CD site. The only requirement would be to eventually cover this material with ground. 3 Environmental: There are no environmental negative impacts in this decision. It is a total loss and he did not have insurance based on a requirement to repair the roof to the satisfaction of the insurance company. He was waiting to get this work done at a future date when a carpenter became available. RECOMMENDATION: Based on the condition of the structure there'll be a fairly small amount of material to deposit in the mixed C&D site. The financial impact is minimal. Council’s Policy – P-20, enables consideration for the waiving of tip fees for non-profit organizations and associations that do not have the ability to raise revenue through taxation. The request is being made by Community Group – East River Village Hall (a registered non-profit group) It is my recommendation that we accept this material at no charge and thus waive the tipping fee as provided for in Section 5 of Policy P-20 BACKGROUND: Staff received a call from Tony Hirtle representing the community group. He explained that George Zink is willing to tear down what's left of the home and bring it landfill. He's doing it at a reduced cost and Tony asked if the municipality could waive the tip fee. He explained that the community is raising money for Harold and was hopeful that the municipality contribute their tip fee so the donations could be used for other needed items. DISCUSSION: Our municipality has granted exemptions in the past based on hardship or other contributing factors. The fact that a community based organization is make the request and is contributing by collecting donations and raising funds, it seems logical that we would do our part. IMPLICATIONS: 1 Policy: Policy P-20 ,Miscellaneous Fee Policy 2 Financial/Budgetary: Based on the condition of the building which is two thirds consumed by fire there will be a minimal amount of material for disposal. And this is material designed for our mixed C&D site which operates for significantly less than the landfill the financial back would be approximately $600.00 to $800.00.
