A BY-LAW TO AMEND A BY-LAW TO. DESIGNATE AND
ESTABLISH A BUSINESS IMPROVEMENT AREA WITHIN
THE BOUNDARIES OF THE TOWN OF SUSSEX
BY-LAW # 153-94-1
THE COUNCIL OF THE TOWN OF SUSSEX, UNDER AUTHORITY VESTED IN IT BY
THE BUSINESS IMPROVEMENT ACT, WHICH CAME INTO FORCE ON THE 15TH OF
JULY, A.D., 1981, HEREBY AMENDS SCHEDULE "A" OF A BY-LAW TO DESIGNATE
AND ESTABLISH A BUSINESS IMPROVEMENT AREA WITHIN THE BOUNDARIES OF
THE TOWN OF SUSSEX BY ADDING THE FOLLOWING TO SCHEDULE "A":
"COMMENCING AT A POINT ON THE NORTHERLY SIDE OF MAIN STREET, SO
CALLED, WHERE IT IS INTERSECTED BY THE CENTER LINE OF WARDS CREEK;
THENCE IN A NORTHWESTERLY DIRECTION AND FOLLOWING THE AFORESAID
CENTER LINE OF WARDS CREEK AND ITS VARIOUS COURSES DOWNSTREAM UNTIL
IT STRIKES THE CENTER LINE OF TROUT CREEK;
THENCE IN AN EASTERLY DIRECTION FOLLOWING THE AFORESAID CENTER LINE
OF TROUT CREEK AND ITS VARIOUS COURSES UPSTREAM UNTIL IT INTERSECTS
THE CENTER LINE OF PARSON'S BROOK;
THENCE IN A SOUTHERLY DIRECTION FOLLOWING THE AFORESAID CENTER LINE
OF PARSON'S BROOK AND ITS VARIOUS COURSES TO A POINT WHERE THE
SOUTHERLY BOUNDARY OF MAIN STREET, SO CALLED, INTERSECTS WITH THE
CENTER LINE OF PARSON'S BROOK;
THENCE IN A WESTERLY DIRECTION ALONG THE SOUTHERN BOUNDARY OF MAIN
STREET TO A POINT -WHERE THE EASTERN BOUNDARY OF O'CONNELL PARK
INTERSECTS THE SOUTHERN BOUNDARY OF MAIN STREET;
THENCE IN A SOUTHERLY DIRECTION ALONG THE EASTERN BOUNDARY OF
O'CONNELL PARK TO THE CENTER LINE OF WARDS CREEK;
THENCE IN A NORTHERLY DIRECTION ALONG THE CENTER OF WARDS CREEK AND
ITS VARIOUS COURSES TO THE PLACE OF BEGINNING;
ALSO COMMENCING AT A POINT ON TI-IE SOUTHERLY SIDE OF WINTER STREET
WHERE THE PROPERTY LINE INTERSECTS THE PROPERTY ON THE WESTERLY SIDE
OF MAGNOLIA AVENUE;
THENCE IN A SOUTHERLY DIRECTION ALONG THE WESTERLY SIDE OF MAGNOLIA
AVENUE TO THE REAR OF THE PROPERTIES FRONTING THE SOUTH SIDE OF
WINTER STREET;
THENCE IN A WESTERLY DIRECTION ALONG THE REAR OF THE PROPERTIES
FRONTING THE SOUTH SIDE OF WINTER STREET;

THENCE IN A NORTHERLY DIRECTION ALONG THE EASTERLY BOUNDARY OF
PREMIER HOLDINGS TO THE SOUTHERLY SIDE OF WINTER STREET;
THENCE IN A WESTERLY DIRECTION ALONG THE SOUTHERLY SIDE OF WINTER
STREET TO THE WESTERN BOUNDARY OF THE SUSSEX MALL ENTRANCE;
THENCE IN A SOUTHERLY DIRECTION ALONG THE WESTERLY BOUNDARY OF THE
SUSSEX MALL ENTRANCE TO THE INTERSECTION OF THE REAR PROPERTY LINE OF
THE DEVELOPMENTS FRONTING THE SOUTHERLY SIDE OF WINTER STREET;
THENCE IN A WESTERLY DIRECTION ALONG THE REAR PROPERTY LINE OF THE
PROPERTIES FRONTING THE SOUTHERLY SIDE OF WINTER STREET;
THENCE IN A NORTHERLY DIRECTION TO THE SOUTHERLY SIDE OF WINTER
STREET;
THENCE IN A WESTERLY DIRECTION TO THE WESTERN BOUNDARY OF THE
SECONDARY SUSSEX MALL ENTRANCE FROM WINTER STREET;
THENCE IN A SOUTHERLY DIRECTION ALONG THE WESTERN BOUNDARY OF THE
SECONDARY SUSSEX MALL ENTRANCE FROM WINTER STREET TO INCLUDE ALL
PROPERTIES FRONTING THE EAST SIDE OF PETER STREET;
THENCE IN A WESTERLY DIRECTION ALONG THE NORTH LINE OF THE PETER
STREET SUSSEX MALL ENTRANCE AND EXTENDING ACROSS PETER STREET TO THE
WESTERN SIDE OF PETER STREET;
THENCE IN A NORTHERLY DIRECTION ALONG THE WESTERN BOUNDARY OF PETER
STREET TO A POINT OPPOSITE THE SOUTHERN LINE OF WINTER STREET; AND
THENCE IN AN EASTERLY DIRECTION TO THE POINT OF ORIGIN AT THE
INTERSECTION OF WINTER STREET AND MAGNOLIA AVENUE."
