WHEREAS the Village of Sussex Corner contracts to provide police protection and fire protection to its inhabitants; AND WHEREAS it is important to the provision of such services that properties be properly identified by number. NOW, THEREFORE, the Council for the Village of Sussex Corner enacts as follows: 1. This by-law may be cited as the "Sussex Corner Civic Numbering By-law". 2. "Building" includes any structure used or intended for supporting or sheltering any use or occupancy. "Village" means the Village of Sussex Corner. "Village Clerk" means the Village Clerk for the Village of Sussex Corner. "Property" includes any parcel of land whether vacant or built upon. "Civic Number" means the number assigned to a property or building by the Village Clerk. "Owner(s)" means the person or persons identified as acquiring the fee simple title to a property in the document which purports to convey such interest and was most recently recorded in the Kings County Registry Office. "Roadway" means that portion of a street improved, designed or ordinarily used for vehicular traffic. "Street" includes a road, lane, crescent, drive, court or avenue, whether public or private. 3. The Village Clerk is responsible for the assigning of civic numbers to properties and buildings fronting upon or abutting a street. The Village shall keep a record of civic numbers which have been assigned. BY-LAW #46 -- CIVIC NUMBERING BY-LAW 4. The owner(s) of a property on which a building is located shall display on the property the civic number(s) of the building in the manner provided herein. 5. An owner shall not display, nor permit to be displayed, upon his property any number which is not its civic number assigned by the Village Clerk pursuant to this By-law. The Village Clerk may, by written notice, require an owner to remove from his (her) property any number which is displayed thereon which is not its civic number and an owner shall comply with such notice within 7 days of receiving said letter. Such letter shall be deemed to have been received by the owner(s) if within three (3) days of the letter being post marked and deposited for mailing at a Canadian post office, the letter is not returned to the Village. 6.(1) Subject to subsection (2) and (3), any civic number shall be displayed upon a property in the following manner: (a) it shall be in digital form; (b) the bottom of the numerals should be at least 1.2 meters (48 inches) above the ground or more in order to be seen during winter conditions; (c) it shall be placed upon the building in such a location that it faces the roadway and is clearly visible from the roadway of the street upon which the street abuts; (d) the colour of each numeral shall be such as to clearly contrast with the colour of the building or post or sign on which it is located; (e) if it is located on a sign or post or on a building which is within 15 metres (49.2 feet) of the roadway, then the numerals shall be not less than 65 millimetres (2 1/2 inches) in height; if it is located on a building which is 15 or more metres (49.2 feet) from the roadway, then the numerals shall be not less than 100 millimetres (4 inches) in height. (2) A civic number shall be displayed on a post or a sign if a civic number which is located on a building cannot be easily read from the roadway from which the building is numbered. The post or sign shall be located on the property within five metres (16.4 feet) of the boundary between the property and the street and the numerals shall face towards, and be clearly visible from, the roadway. (f) BY-LAW # 46 - CIVIC NUMBERING BY-LAW (3) The Village Clerk may, in writing, require an owner to place a civic number on a sign or post located on the property adjacent to the entrance of a driveway which provides emergency vehicle access to a building. 7. No person shall place or display on any property figures making any number which is not the number assigned to the Property hereunder. 8. Any property which is not in compliance with Section 7 hereof may be numbered by Village employees under the direction of the Village Clerk, and the cost of such work will be the responsibility of the owner of such building and such cost shall be a debt due to the Village, recoverable in a court of competent jurisdiction. 9. A person who violates or fails to comply with any provision of this by-law is guilty of an offense and is liable on conviction to a fine of not less than $50.00 and not more than $200.00. Where the violation is not a continuing or ongoing violation, upon payment of the fine so assessed hereunder to the Village Clerk, the Village Clerk shall notify the owner that the owner is not liable to prosecution for the violation.
