Approval of Agenda Moved by: Councillor MacLeod Seconded by: Councillor Nelson THAT the agenda for this regular Council meeting be approved as circulated. Motion Carried 2. Disclosure of Conflict of Interest No members present declared a conflict of interest on any items on the agenda at this time. 3. Approval of Minutes 3.a July 17, 2023 Special Council Meeting Moved by: Councillor Brenan Seconded by: Councillor Milner THAT the minutes of the special meeting of the Council of the town of Sussex, held on July 17, 2023 be approved as circulated. Motion Carried 3.b July 17, 2023 Regular Council Minutes Moved by: Councillor Maguire Seconded by: Councillor Nelson THAT the minutes of the regular meeting of the Council of the town of Sussex, held on July 17, 2023 be approved as circulated. Motion Carried 4. Business Arising out of Committee of the Whole 2 5. Delegations, Petitions and Correspondence: 5.a CN Rail Safety Week His Worship Mayor Thorne read the correspondence from CN regarding Rail Safety Week. Moved by: Councillor Brenan Seconded by: Deputy Mayor Wilson THAT the letter from CN regarding rail safety week be filed and that the information be posted on the town's social media and website. Motion Carried 5.b fasdNL Atlantic - FASD Awareness Month Moved by: Councillor Brenan Seconded by: Councillor Nelson THAT the correspondence from fasdNL regarding FASD Awareness Month be filed Motion Carried 6. Fire Report Moved by: Councillor MacLeod Seconded by: Councillor Nelson THAT the Fire Report for the month of July 2023 be received as circulated. Motion Carried The report indicated that during the month the Fire Department responded to 16 calls with 6 calls originating within the boundaries of Sussex and 10 calls outside of the boundaries of Sussex. 7. Building Inspector's Report Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT the Building inspector's Report for the month of July 2023 be received as circulated. Motion Carried The reportindicated that during the month, the Building inspector issued 2 permits for New Construction totaling $604,300 and 16 permits for Renovations, Repairs and Alterations totaling of $155,000 8. Development Officer's Report Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT the Development Officer's Report for the month of July 2023 be received as circulated. Motion Carried The report indicated that during the month, there were 2 tentative subdivision plans submitted for approval. 3 9. Planning Advisory Committee Minutes August 9, 2023 Moved by: Councillor Milner Seconded by: Deputy Mayor Wilson THAT the minutes of the Planning Advisory Committee meeting of August 9, 2023 be received as circulated. Motion Carried 10. Unfinished Business 10.a Proposed Municipal Plan Amendment, By-law 704-20-02 10.a.1 Reading in it's Entirety Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT Council have a reading in its entirety of proposed Municipal Plan Amendment, By-law #704-20-02. Motion Carried The Clerk then read the by-law in its entirety. 10.a.2 3rd Reading by Title and Enactment Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT Council have a 3rd reading by title of proposed Municipal Plan Amendment, By-law #704-20-02. Motion Carried The Clerk then read the by-law for the 3rd time by title and His Worship Mayor Thorne declared the by-law duly enacted. 10.b Proposed Zoning By-Iaw Amendment, By-Iaw 1350-21-03 10.b.1 Reading in its Entirety Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT Council have a reading in its entirety of proposed Zoning By-Iaw Amendment, By-law 1350-21-03 Motion Carried The Clerk then read the by-law in its entirety. 10.b.2 3rd Reading by Title and Enactment Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT Council have a 3rd reading by title of proposed Zoning By-law Amendment, By-law 1350-21-03. Motion Carried The Clerk then read the by-law for the 3rd time by title and His Worship Mayor Thorne declared the by-Iaw duly enacted. 4 11. Report of Committees 11.a Community Services Committee Moved by: Councillor MacLeod Seconded by: Deputy Mayor Wilson THAT the report of the Community Services Committee Meeting 08-23 of August 15, 2023 be received as circulated Motion Carried Moved by: Councillor MacLeod Seconded by: Councillor Brenan THAT Council approve Policy CS -17: Schedule A2 - Facilities showing the proposed rental fees for the 8th Hussars Sports Centre. Motion Carried Moved by: Councillor MacLeod Seconded by: Deputy Mayor Wilson THAT Council approve the disposal by auction of a fleet vehicle, a 2008 Dodge 1 Ton, which is deemed obsolete. Motion Carried Moved by: Councillor MacLeod Seconded by: Councillor Milner THAT Council approve sponsorship support in the amount of $3,500 in support of the Atlantic Balloon Fiesta annual brunch. Motion Carried Moved by: Councillor MacLeod Seconded by: Councillor Milner THAT Council authorize the closure of Main Street from Church Avenue to Winter Street from 2:00 pm to 9:00 pm on October 21st for the Sussex portion of the Rising Tides Festival. Motion Carried Moved by: Councillor MacLeod Seconded by: Councillor Nelson THAT the Council authorize that Sussex partners with the Sussex Skating Club in their grant request through the Sussex & Area Community Foundation for their Elvis and Kurt Clinic. Motion Carried Moved by: Councillor MacLeod Seconded by: Deputy Mayor Wilson THAT Sussex provides a sponsorship in the amount of $5,000 for the Rising Tides Festival taking place in Sussex on October 21, 2023 Motion Carried 5 11.b Economic Development and Long Range Planning Committee Moved by: Councillor Nelson Seconded by: Councillor Brenan THAT the report of the Econonimc Development and Long Range Planning Committee Meeting 08-23 of August 15, 2023 be received as circulated Motion Carried Moved by: Councillor Nelson Seconded by: Councillor Milner THAT Council approve the Flo quotation for the purchase of 2 level 2 EV charging station equipment in the amount of $16,200.00 exclusive of HST for Jubilee Hall. Motion Carried Moved by: Councillor Nelson Seconded by: Councillor Brenan THAT Council authorize the Mayor and the Town Clerk to execute the 2023 Participation Agreement for Plug -In Charging Rebates for the Business Rebate Initiative Motion Carried Moved by: Councillor Nelson Seconded by: Councillor MacLeod THAT Council authorize Town Administration to execute the CMHC Integrity Declaration on behalf of Sussex. Motion Carried 6 11.d Protective Services Committee Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT the report of the Protective Services Committee Meeting 08-23 of August 14, 2023 be received as circulated Motion Carried Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT Council direct DPW Butcher to send a letter to the parties involved to commence a hearing at the next Protective Services meeting to review the 82 Park Street dog incident. Motion Carried Moved by: Councillor Milner Seconded by: Councillor Nelson THAT Council direct By-law Enforcement Officer Butcher to send a letter to the property owner of 102 Park Street relating to maintenance and occupancy standards in accordance with By-law #701-19. Motion Carried Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT Council approve Shannon Graham to attend the NBBOA Communications Skills for Building Officials Level 1 course, from October 24, 2023, to October 26th, 2023, for a total price of $1,137.43 inclusive of HST. Motion Carried Moved by: Councillor Milner Seconded by: Councillor MacLeod THAT Council authorize the purchase of 6 chairs at a cost of $6,174.00 exclusive of HST from Sussex Horne Building Design Centre for the Fire Department Common Room. Motion Carried 11.e Administration Committee Moved by: Councillor Brenan Seconded by: Councillor Milner THAT the report of the Administration Committee Meeting 08-23 of August 17, 2023 be received as circulated Motion Carried Moved by: Councillor Brenan Seconded by: Councillor Milner THAT Council approve the replacement of eight (8) cables for the quint following the 2022 adjustment of the ladder cables and to engage G. LeBlanc Fire Truck Repair Ltd. inclusive of labor and material in the 7 amount of $13,884.52, exclusive of HST and exclusive of shipping of the cables from Sutphen, USA. Motion Carried Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT Council authorize an expenditure of up to $60,000.00 for the purchase and installation of monitoring equipment and training required for staff for continuous chlorine monitoring in Ward 2 and continuous turbidity monitors on 4 wells in both Ward 1 and Ward 2. New Business 13. Open Discussion Councillor MacLeod attended the Ark Health Collective's Grand Opening and expressed to Council how impressed she is with the facility which contains 5 doctors as well as physiotherapists and psychological therapists as well as a pharmacy. She also spoke on the NB Day celebrations and 2023 Merit Award presentations held at O'Connell Park which are always free of charge and very well attended. Councillor Brenan and Councillor Nelson attended the Sussex Health Care Initiative meeting with stakeholders from the community. The communities of Sussex, Sackville and Fredericton have each been identified a candidates for health care reform. They found the meeting to be very informative and are pleased with some of the recommendations and initiatives discussed. Councillor Brenan also spoke on the success of the Sussex Regional Library's Summer Reading Program and commended the staff and summer students for their hard work in bringing this important educational program to the children of our community. 14. Date of Next Scheduled Regular Meeting September 18, 2023 His Worship Mayor Thorne noted that the next regularly scheduled meeting of the Council will be held on September 18, 2023 8 15.
