A BY-LAW RELATING TO THE ENFORCEMENT OF BY-LAWS FOR THE MUNICIPALITY
OF THE VILLAGE OF SUSSEX CORNER
WHEREAS under the authority of the Municipalities Act, R.S.N.B.,
1973, C. M-22, s.11(1)(a), the Village of Sussex Corner is authorized to enact a
By-law "regulating its procedure";
AND WHEREAS pursuant to the Municipalities Act, R.S.N.B., 1973,
C. M-22, s.101 "an information for the breach of a by-law shall be laid in the
name of the clerk of the municipality or such other person as is designated for
that purpose by the council";
AND WHEREAS it is not expedient for the clerk of the municipality
to lay informations for the breach of by-laws;
BE IT THEREFORE ENACTED by the Council of the Municipality of the
Village of Sussex Corner, as follows:
1. This By-law shall be known as By-law No. a ri and may be cited
as the "Enforcement By-law".
2. in this By-law:
(a) "Village" means the Village of Sussex Corner;
(b) "Peace Officer" means a member of the Royal Canadian Mounted
Police or the New Brunswick Highway Patrol;
(c) "By-law" means a by-law of the Municipality of the Village
of Sussex Corner.
3. Any Peace Officer is designated and may lay an information for
the breach of a by-law.
