CURRENT SITUATION
Ten Beaches Estate’s 74-unit mini home park in Simms Settlement which currently has 13 mini
homes located on site. Staff presented a report to Council in September regarding outstanding
issues and requested direction on fencing. Council instructed staff to give the developer 30 days
for seeding and the chain link fencing to be completed.
Fencing and Rock Wall
The installation of the remaining chain link fence is IN PROGRESS. The chain link fence along the
Watts side property line was being installed October 26, 2016. The developers have stated to
staff that all the missing sections of chain link fence will be installed by mid-November.
Landscaping
The seedings of park areas and the stormwater management pond is COMPLETE. The small park
areas at the back area of the development have have topsoil and mulch applied and have been
seeded with grass seed. The stormwater management pond has been reseeded for a total of 2
applications. The installer has told the developer the grass will grow when there is more
moisture and proper temperatures. The area appeared more green this week than it did in
August.
Conclusion
Staff will perform another site inspection mid-November to confirm whether the chain link
fence has been completed as approved under the site plan.
Staff consider the matter of vegetation/landscaping complete for now but will confirm the
seeding has taken root next spring. If there is still no grow, further steps may need to be taken.

BACKGROUND
The site plan was approved on appeal to Council with a provision that a 4-foot chain link fence
be installed between the Ten Beaches Estates development and the neighbouring properties:
Seaboyer (PID 60084746), Hannam (PID 60084753) and Watts (PIDs 60410412 & 60084761).
Fencing and Rock Wall:
Portions of the property lines between the development and the neighbouring properties have
been fenced with chain link, one section contains a rock wall and one section has no fencing or
rock wall between the properties.
The developers requested approval from the Municipality in 2013 to install a rock wall in place
of a chain link fence. The development officer (DO) of the time granted this approval. The
request from the developer was worded in such a way it that it implied they were replacing the
entire length of the chain link fence with a rock wall.
Since that time the developers have stated that they did not intend to replace the entire chain
link fence with rock wall but only a portion of it. Staff feels that had this been the case originally
that the DO’s approval would not have been granted for such a fragmented barrier.
Prior to this update there was a black chain link fence behind the Seaboyer property, a rock wall
behind the Hannam property and a mix of aluminum and black chain link fences behind the
Watts property with the side property line having no fence or rock wall. The rock wall has been
installed behind the Hannam property (PID 60084753) and is 4 feet or more on the Hannam’s
side. However, on the development’s side a large portion of the rock wall has been infilled level
with the rock wall. This section is the western side of the rock wall for a little over 100 feet in
length. There is one area where the rock wall meets the chain link fence to the east that the
rock wall is not 4 feet from either side of the property line. The shared side property line
between the development and the Hannam property has a rock wall with infill and an
aluminum chain link fence that is part of the stormwater management pond. The aluminum
portion of the fence behind the Watts property is also part of the stormwater management
pond’s fencing, once beyond the pond the fencing changes to the blank chain link. Infilling is
not prohibited within the Municipality’s General Basic zone.
Staff felt that the mixture of part chain link fence and part rock wall is not suitable and that
there should be a consistency of one style to maintain a cohesive appearance.
Council’s decision to uphold the Development Officer’s original approval of the site plan was
granted with a provision that a 4-foot chain link fence be installed between the Ten Beaches

Estates development and the neighbouring properties: Seaboyer (PID 60084746), Hannam (PID
60084753) and Watts (PIDs 60410412 & 60084761).
Landscaping
The site plan criteria require all common areas, sewer easement areas and the stormwater
management area to be seeded with vegetation.
To date the sewer areas have been seeded and are growing, with the drought this summer the
cover is not as thick as one would want but they do have a good cover of vegetation growing
over the holding tanks and field beds.
The hydro-seeding on the stormwater management pond has not taken hold and needed to be
redone.
The small park areas and any other common areas of the development appear to have not been
seeded or the seeding has not grown as they were bare dirt in August of this year when the DO
visited the site.
These matters remained unfinished. While it is understandable why any seeding this summer
has not been successful, staff felt it is reasonable to require the developers to reseed this fall to
bring the landscaping into compliance. The majority of the construction is complete and
seeding the park areas and pond will not impact any work that may be remaining at the site.
On September 29, 2016 Council directed staff to inform the developer they needed to complete
the seeding and install the chain link fence along the entire boundary line between the
developer’s property and the Seaboyer, Hannam and Watts properties as was approved under
the amendmend site plan which was approved by Council at the appeal hearing. Council did not
find the mixuture of rock wall and chain link fence a satisfactory substitute to the original
approved chain link fence.
Timeline:
Below is a short timeline of key select events as they relate to the Ten Beaches Estates
development and fencing:
June 29, 2010 Application received for a proposed 74-unit mini home park.
April 13, 2012 DO grants site plan approval for a mini home park. Letters sent to
neighbours
April 30, 2012 Appeal received from Seaboyers, Hannams & Watts’

June 14, 2012 Council heard appeal. Decision delayed to receive revised site plan.
June 28, 2012 DO’s approval of the site plan upheld by Council with the revised plan
that included a 4-foot chain link fence between neighbouring
properties and the development.
June 17, 2013 Email request from developers to change the chain link fence to a
stone wall
Summer/Fall 2013 Previous development officer (DO) grants approval to change the 4-
foot chain link fence to a stone wall. DO requests pictures and design
details of proposed rock wall. Approval is granted under the
assumption the entire chain link fence will change to a rock wall of 4
feet or higher.
November 2013 Site visit performed by the Municipality on another matter, rock wall
behind Hannam property is already constructed.
Late 2014/Early
2015
Developers inquire whether the rock wall needs to extend over the
mound behind the Seaboyers’ property. DO advised it was part of the
site plan but would check with the Seaboyers to confirm their
preference. Previous verbal discussions with Mr. Seaboyer indicated
they did not wish to have a stone wall along their property line.
January 15, 2015 Report for Council prepared. Within the report issues related to the
rock wall, the developer’s request to not construct it along the
Seaboyer’s property, the DO waiting for letter from the Seaboyers.
January 20, 2015 DO mailed letter to developers stating need to finish rock wall as
requested in lieu of the 4-foot chain link fence. DO advised she was
waiting for a letter from the Seaboyers stating whether they wanted a
rock wall and that Council direction would be needed prior to allowing
the rock wall to not be constructed behind the Seaboyers property.
January 22, 2015 Discussion with Council regarding the rock wall. It is determined that
before Council would consider exempting this area from the
requirement of the rock wall/fence all appellant parties would need to
agree.
January 29, 2015 Seaboyers email DO and confirm they wish to see a nicely designed 8-
foot rock wall behind their property. With the confirmation that the
Seaboyers still want the division between properties, the DO does not
seek agreement of the other property owners to not install a division
behind the Seaboyer property.
July 28, 2016 DO advised by the Municipal Fire Services Coordinator that local fire
department’s pressure test on the hydrant was not successful and
that the developer’s engineer stated the issue is related to the two

DISCUSSION
This report provides an update on the grass seeding and chain link fence installation as required
for the development under the approved site plan.

August 2016 Council seeks update on Ten Beaches. Local councilor has received
comments of concern from public regarding the infilled portion of the
rock wall and how someone could walk right over it onto the Hannam
property.
August 5 & 10, 2016 DO performs site visit to development, pictures and measurements
taken. Determines a little over 100 feet of the rock wall has been
infilled on the developer’s side to a level that would allow a person to
walk over the rock wall.
September 29, 2016 Report submitted to Council regarding outstanding issues and
requested direction on fencing. Council instructed to give 30 days for
seeding and fencing to be completed.
October 26, 2016 Site Visit to property. Seeding completed. Fencing in progress.

To Councillors of the Municipality of the District of Chester,
RE: Chester Visitor Information Centre
As a costumer for the Chester Drama Society which uses space upstairs at the Chester Train Station for costume
storage, the other costumer and I were often at the train station when the Visitor Information Centre was closed
after September 4th. When we worked there we locked the door behind us, so we did not see who came when
we were working upstairs. However, almost every time we arrived or left (at oddly different hours), there were
people wanting to access the VIC. When we could, we helped by handing out maps and brochures and
answering questions (or once in a while just letting them use the washroom). Often times there were more than
one group of people looking for VIC services. It’s too bad that they couldn’t be served by people who knew
what they were doing.
I think the VIC provides an important service for visitors to Chester municipality, Lunenburg County and Nova
Scotia. I certainly hope the service continues and that the season of operation is longer than it was this year. I’m
sure that many people came and were disappointed while we were locked in upstairs.

CURRENT SITUATION
At the September 29th, 2016 Municipal Council meeting, whereby members of the Village
Commission were in attendance, motion 2016-402 was approved. The motion read “MOVED by
Councillor Armstrong, SECONDED by Deputy Warden Shatford that Municipal Council direct staff
to work with the Village Commission to draft a Scope of Work for a Needs Assessment and
options analysis, with estimates of costs to address the need.”

BACKGROUND
At the February 4th, 2016 Committee of Whole meeting, Council requested staff to list and
summarize the various reports regarding the future water system for the Village of Chester. The
summarized list was provided as part of a Request for Direction, dated April 20th, 2016 and
reviewed by Council at the May 19th, 2016 Committee of the Whole.
At the May 19th meeting, The Director of Engineering and Public Works was instructed to provide
Councillor Armstrong with a ball-park figure for providing water to the village, based on full cost
recovery.At the August 18th, 2016 Committee of the Whole, an updated cost estimate of
$22,000,000 (2016 Dollars, Net HST) was presented to Council.
DISCUSSION
Staff has discussed Council’s request with one (1) of our pre-qualified Consultants to gain insight
on the process completed for the Village of Pugwash Water system, as well as advice on the
specific steps the Municipality of the District of Chester and the Village of Chester should
complete to ensure the need and options available are fully scoped.

IMPLICATIONS
Policy
Procurement would follow P-04, Procurement Policy as recently amended for Engineering
Services. It is expected that this project would be classified as Low-Value Procurement, and the
project award can be completed by the CAO.
Financial/Budgetary
This project would be an unbudgeted expenditure, therefore, it would be funded through
Operational Reserves. The project budget is estimated at $35,000, Net HST.

Work Program Implications
The current capital works program did not account for VOC Water System project. The addition
of this project will increase the Engineering & Public Works Department’s workload along with
other recently added projects. Therefore, staff will be preparing a report to update Municipal
Council on capital projects and requesting direction on their reprioritization.

-Complete a desktop review to determine the overall aquifer yield to determine if the aquifer can support the
needs of community on a long term basis. Consultants are to reference the NS Guide to Groundwater
Assessments for Subdivisions Serviced by Private Wells.
-Water Quality Sampling Program
o Complete a sampling program based on 10% of the responses received from the survey, with a
maximum of 40 participants
o Consideration must be given to obtaining representative results, based on the roughly determined need,

-Public Information Session –one (1) session only
o Present the findings the findings of the survey and sampling program, as well as request feedback
o MODC will arrange meeting place in the Village of Chester and evening time, mutually agreed upon with
the Consultant
-If it is determined the need is not there either from the survey, sampling program, public information session and
or the desktop review, project would end
-Source Water Review, with the goal to select a water source between groundwater (within reasonable distance
from the Village or existing well rehabilitation) and surface water for the determined need
-Complete interim and final draft reports, summarization the assessed need and the available options with
costing (Opinion of Probable Cost) for a central water system.
-MODC may require an insurance premium increase beyond the basic insurance required for the REI pre-
qualification
-The Municipality reserves the right to award subsequent phases (i.e. Analyze ground water test wells, predesign
report, rate studies, design and construction) to the successful proponent.
-The award of work is subject to Budget and Council approval.
RFP Submission Evaluation Criteria
50 % Price
o Proponents are asked to submit a detailed cost estimate (i.e. quantity of hours, unit rates, key
personnel, expenses etc.) based on the milestones and schedule of the project, broken down per month,
accompanied by a list of key personnel roles and responsibilities, any project assumptions and or
limitations. Proponents are encouraged to provide a written summary explaining their cost estimate.
50% Experience: Provide five (5) recent (completed in or after 2010) examples and similar water projects,
highlighting the various aspects mentioned above including design and construction. Furthermore, provide the
project team, showing they were integrally involved in the listed projects.
