HomeMy Public PortalAbout133-19 POLICE PROTECTION SERVICES (WARD 2)VILLAGE OF SUSSEX CORNER BY-LAW # 133-19 POLICE PROTECTION SERVICES The Council of Sussex Corner, under authority vested in it by Section 10(3) of the Local Governance Act, and amendments thereto of the Province of New Brunswick, enacts this by-law as follows: 1. TITLE This By -Law is titled as the "Police Protection Services By-law". 2. DEFINITIONS 2.1 In this by-law: 2.1.1 "Municipality" means the Village of Sussex Corner, 2.1.2 "Council" means the Council for the Village of Sussex Comer, and includes the Mayor, the Deputy, and all the Councillors; 2.1.3 "Parties" means the Village of Sussex Corner and the Province of New Brunswick; 2.1.4 "Police Act" means the Province of New Brunswick's Police Act Chapter P-9-2 and regulations thereunder and amendments thereto. 2.1.5 "Royal Canadian Mounted Police" or "RCMP" means the police force for Canada continued under the Royal Canadian Mounted Police Act. 3. PROVISION OF POLICING SERVICES The Municipality shall be policed by members of the Royal Canadian Mounted Police under the terms of the Provincial Police Service agreement in a manner consistent with detachment policing and specialized services that operate in support of detachment policing as may be required from time to time. 4. TERMS AND CONDITIONS 4.1 Those Members (RCMP) who form part of the Police Services for the Municipality: (a) will render such services as are necessary to: (i) preserve the peace, protect life and property, prevent crime and offences against the laws of Canada and the laws in force in the Province, apprehend criminals, offenders and others who may be lawfully taken into custody; and (ii) execute all warrants and perform all duties and services in relation thereto that may, under the laws of Canada or the laws in force in the Province or the municipality, be executed and performed by peace officers. (b) may render such services as are necessary to prevent offences against by-laws of the Municipality, after having given due consideration to other demands for enforcement services appropriate to the effective and efficient delivery of police services in the Municipality. S. VALIDITY 6. The invalidity of any section, clause, sentence or provision of this by-law shall not affect the validity of any other part of this by-law which can be given effect without such invalid part or parts. EFFECTIVE DATE This by-law comes into effect on the date of final enactment thereof.
