Objectives of Service Exchange
To create strong, financially viable local government.
To develop a clearer, fairer provincial- municipal
partnership.
To rationalize service provision by all governments.
Background
Rationalization of shared services in Health, Justice,
Environment, Transportation, and Social Services, with
services provided by Municipal Governments.
Various services were transferred from municipal
jurisdiction to provincial jurisdiction and vice versa.
Municipalities pay a fee to the province to offset the costs of
the service exchange with neither unit to experience
undue gain or loss at the expense of the other through
the service exchange.
The fee paid by the municipalities is based on a specified
number of kilometers of local roads within each
municipality.

The Agreement
The agreement specifically states:
The Municipality and the Province agree that the province
shall maintain, including snow and ice control, 35.47 km of
highway.
The Municipality shall pay the Province the sum of $3,500
per km, plus GST (1996 number, not adjusted to $ 5,145 per
km, 2016 agreement). This is a fee to balance the service
exchange, not a fee for maintenance of the 35.47 km of
roads.
As TIR is the owner of these roads, TIR will determine the
level of maintenance to be performed on these roads.
Service Exchange Fee
The fee is not a fee paid to TIR for maintenance of local
roads.
The Municipalities may cease paying the fee by assuming
ownership of the local roads listed in the agreements. If
they assume ownership, they will become responsible for
all future maintenance and capital construction costs
associated with these roads.
Written notice must be given six months before the end of
the fiscal year that the agreement is not to be renewed for
the next fiscal year. Termination of the agreement will
entitle the Province to transfer ownership and
responsibility for local roads within the Municipality.
Cost Sharing
Pursuant to provisions of the Public Highways Act and the
Provincial-Municipal Service Exchange, sharing of cost for
the paving of local roads may be undertaken.
The Department has expanded this paving to also include
chip sealing of these roads.

Local Roads, J-Class Streets & Village Streets
Policy Statement
The Department may carry out cost-shared paving, chip
sealing of Local Roads, J-Class Streets and Village
Streets (see definition TIR Type ‘B’ Local Roads below),
on a cost-shared basis:
1) when requested by a Municipal Unit to undertake such work;
2) when the Department’s budget appropriations permit such
work to be undertaken; and
3) where it is practicable and reasonable to carry out such
work on a cost-shared basis.
All costs related to paving of local roads and streets will be shared equally between the Department and the Municipal Unit except as outlined in #3 below.
Definition of a Local Road:
The following definitions are to be applied to Local Roads, J-Class Streets and Village Streets:
# 1 Municipal Type ‘A’ Local Roads: all Local Roads constructed after April 1, 1995, under the administration and control of the Municipal Unit in which the road is constructed.
# 2 TIR Type ‘B’ Local Roads: all Local Roads, J-Class Streets and Village Streets constructed prior to April 1, 1995, under the administration and control of the Department.
#3 Cost-Shared Paving of Local Roads: there will be no cost-sharing of Municipal Type ‘A’ Local Roads. Such roads are under the administration and control of the Municipal Unit in which they are constructed and all improvements are the responsibility of the Municipal Unit.
The Department may allow work to be done with the
Municipality paying greater then 50% of the cost with the
approval of the District Director; however, under no
circumstances will the Department pay more than 50% of
the cost.
In situations where the roadbed or drainage system has
suffered damage, has not been properly maintained, or
requires upgrading, the cost-sharing formula may be
adjusted to reflect the cost of improvements required prior
to paving. Such situations may require the Department to
carry out improvements to bring the road up to the
standard for paving or chip sealing, thus increasing the
Department’s share of the project. Adjustment to the cost-
sharing formula will be at the discretion of the District
Director.
Low Volume Road Ratings
Surface treatments are determined based on traffic
volumes as well as development density.
Overall rating will determine appropriate surface.
TIR is currently in the process of rating all 35.47 km of cost
share roads, as well many other local roads within
Lunenburg County to determine priorities.
Also to be determined is existing surface and if an
improvement is a cost share item.
