A BY-LAW TO STOP UP AND CLOSE SUSSEX STREET AND A
PORTION OF PRINCESS STREET IN THE TOWN OF SUSSEX
BY-LAW # 1004
BE IT ENACTED by the Council of the Town of Sussex pursuant to Section 186A of
the Municipalities Act as follows.
1. The Council of the Town of Sussex does hereby stop up and close the
highways located in the said Town of Sussex and known as Sussex Street
and a portion of Princess Street, more particularly described as follows.
DESCRIPTION OF SUSSEX STREET
TOWN OF SUSSEX, KINGS COUNTY, N.B.
All that certain lot piece or parcel of land situate lying and being west of
Magnolia Street, in the Town of Sussex, County of Kings and Province of
New Brunswick, being a portion of street that was formerly used as a public
street and being more particularly described as follows:
“beginning at a point in the eastern sideline of Princess Street and located
easterly along the Southern boundary of Princess Street, a distance of
twenty-three and seventy-five hundredths (23.75) feet more or less from
the northern boundary of property owned by the Roman Catholic Bishop of
Saint John; thence in a northerly direction along the eastern sideline of
Princess Street a distance of fifty (50) feet; thence in an easterly direction a
distance of three hundred sixty-four and twenty-five hundredths (364.25)
feet or to the western sideline of Magnolia Street; thence in a southerly
direction along the aforesaid sideline of Magnolia Street a distance of fifty
(50) feet; thence in a westerly direction a distance of three hundred and
sixty four and twenty five hundredths (364.25) feet or to the place of
beginning”. The above described parcel of land contains an area of 18,212
square feet more or less; and is shown on a Subdivision Plan, Franklin &
Herschorn Limited Property dated March 18, 1970; prepared by Alan A.
Hicks, N.B.L.S.

BEING DISCONTINUED AS A PUBLIC STREET
TOWN OF SUSSEX, KINGS COUNTY, N.B.
All that certain lot, piece, or parcel of land, situate, lying and being south of
Winter Street, in the Town of Sussex, County of Kings, and Province of New
Brunswick, being a portion of Princess Street that was formerly used as a public
street, and being more particularly described as follows.
Beginning at an iron stake at the southeast corner of property now owned by
Martin & Stewart Ltd. at the intersection of the southern boundary of the
aforesaid Martin & Stewart Ltd. property with the western sideline of Princess
Street; the said iron stake being located southerly along the aforesaid sideline of
Princess Street a distance of two hundred thirty-one and two tenths (231.2) feet
from its intersection thereof with the southern sideline of Winter Street; thence
south 82 degrees and 34 minutes east, crossing the aforesaid Princess Street a
distance of forty-six and seven tenths (46.7) feet to the eastern sideline of
Princess Street; thence in a southerly direction along the eastern sideline of
Princess Street, a distance of eight hundred and seven (807) feet more or less,
thence north 82 degrees and fifteen minutes west, crossing the aforesaid Princess
Street, a distance of fifty (50) feet to the western sideline of the aforesaid Princess
Street; thence north 8 degrees and two minutes east, along the western sideline of
Princess Street a distance of eight hundred six and forty-six hundredths (806.56)
feet to the place of beginning.
The above described parcel of land contains and area of 39,000 square feet more
or less and is a portion of lot “Y” as shown on a Subdivision Plan, Franklin &
Herschorn Ltd. property dated September 28, 1970, and revised October 22, 1970,
prepared by Alan A. Hicks, N.B.L.S., duly approved by the Town of Sussex
Planning Commission and filed in the Kings County Registry Office as No. 3538.

2. The closure of the highways described in Section 1 is permanent.
IN WITNESS WHEREOF the Town of Sussex has caused the Corporate Seal of the
said Town to be affixed to this by-law the thirtieth day of August, A.D., 1971, and
