A BY-LAW TO STOP UP AND CLOSE A PORTION OF
MOFFETT AVENUE IN THE TOWN OF SUSSEX
TO VEHICULAR TRAFFIC
BY-LAW # 1008-96
The Council of the Town of Sussex pursuant to Secti on 187 (5) of the
Municipalities Act enacts as follows.
The Council of the Town of Sussex does hereby stop up and close to
vehicular traffic a portion of the highway located in the said Town of
Sussex and known as Moffett Avenue, more particularly described as
follows.
Beginning at a survey marker at the intersection of the southern boundary
of Moffett Avenue with the north-eastern corner of Lot 73-1 as shown on
Plan No. 6158, the Gerode Holdings Ltd. property by Document No. 235535
in Book 572 at Page 784 and the north-west corner of Lot A as shown on
Plan No. 3536, the Bethany Bible College property by Document No. 301903
in Book 1095 at Page 554; said point having a N.B. Grid Co-ordinate Value
as follows: X=375 754.756 and Y=714 569.096.
Thence on a N.B. Grid Azimuth of seventy-five degrees, zero five minutes,
twenty seconds (75º 05’ 20”) following the northern boundary of Lot A, the
Bethany Bible College property a distance of one hundred zero nine and
zero hundred fifty-three thousandths (109.053) metr es to a survey marker
at the north-west corner of Lot 126 as shown on Plan No. 1735, the Jean
Paul LeBlanc and Shirley LeBlanc property by Document No. 229488 in
Book 541 at Page 7, P.I.D. 267856.

Thence on an Azimuth of three hundred forty-five degrees, fourteen
minutes, thirty seconds (345º 14’ 30”) following the western boundary of
Summit Avenue a distance of twenty and one hundred seventeen
thousandths (20.117) metres to a point at the south-east corner of Lot B as
shown on Plan No. 3536, the Bethany Bible College property by Document
No. 148064 in Book 174 at Page 252, P.I.D. 84384; said point having a N.B.
Grid Co-ordinate Value as follows: X=375 855.012 and Y=714 616.611.
Thence on an Azimuth of two hundred fifty-five degr ees, zero five minutes,
twenty seconds (255º 05’ 20”) following the southern boundary of Lot B,
the Bethany Bible College property a distance of one hundred zero nine and
six hundred fifty-three thousandths (109.653) metres to a point.
Thence on an Azimuth of one hundred sixty-three degrees, thirty-two
minutes, zero zero seconds (163º 32’ 00”) following the eastern boundary
of Moffett Avenue a distance of twenty and one hundred twenty-four
thousandths (20.124) metres to the point of beginning.
The so-described parcel of land contains an area of two thousand two
hundred (2,200) square metres, delineates a portion of Moffett Avenue
which is to be closed and is shown on a “Plan of Survey of a Portion of
Moffett Avenue, to be closed, Town of Sussex, County of Kings, Province of
New Brunswick”, prepared by Valley Surveys Ltd., dated January 8, 1996.

IN WITNESS WHEREOF the Town of Sussex has caused the Corporate Seal
of the said Town to be affixed to this by-law the 21st day of March, 1996,
