A BY-LAW TO STOP UP AND CLOSE A PORTION OF DUKE STREET
IN THE TOWN OF SUSSEX
The Council of the Town Of Sussex, pursuant to Section 187 (2) of the Municipalities
Act, enacts as follows.
The Council of the Town Of Sussex does hereby stop up and close a portion of the
highway located in said Town Of Sussex and known as Duke Street, more particularly
described as follows:
beginning at a point on the eastern boundary of the Province Of New Brunswick
property (Department Of Education) at the terminus of Duke Street; said point having a
N.B. Grid Co-ordinate Value as follows:
X = 376 522.006 and Y = 714 284.054;
thence on a N.B. Grid Azimuth of eighty-three degrees, seventeen minutes, zero zero
seconds (83º 17’ 00”) a distance of fifteen and zero hundred thirty-seven thousandths
(15.037) metres to the North-west corner of the Barbara Campbell property by
Document No. 123621 in Book 96 at Page 659, P.I.D. 265876;
thence on a N.B. Grid Azimuth of three hundred fifty-two degrees, fifty-two minutes,
twenty seconds (352º 52’ 20”) following the western boundary of the Province Of New
Brunswick property (Department Of Education) a distance of ninety-two and one
hundred fifty thousandths (92.150) metres to a point;
thence on a N.B. Grid Azimuth of three hundred fifty-nine degrees,
eighteen minutes, fifty seconds (359º 18’ 50”) following the western
boundary of the Province Of New Brunswick property a distance of sixty-three and four
hundred thirty thousandths (63.430) metres to a survey marker on the southern
boundary of the Kirk Hill Cemetery property, P.I.D. 265884;

thence on a N.B. Grid Azimuth of two hundred fifty-two degrees, forty-nine minutes, fifty
seconds (252º 49’ 50”) following the southern boundary of the Kirk Hill Cemetery
property a distance of fourteen and nine hundred forty thousandths (14.940) metres to
a point;
thence on a N.B. Grid Azimuth of two hundred fifty-two degrees, fourteen minutes, ten
seconds (252º 14’ 10”) following the southern boundary of the Kirk Hill Cemetery
property a distance of fourteen and nine hundred zero thousandths (14.900) metres to
a point on the north-eastern boundary of Duke Street;
thence on a N.B. Grid Azimuth of two hundred twenty-nine degrees, forty-six minutes,
forty seconds (229º 46’ 40”) a distance of fifteen and three hundred fifty-eight
thousandths (15.358) metres to a point on the north-eastern boundary of the Province
Of New Brunswick property (Department Of Education), P.I.D. 267690;
thence on a N.B. Grid Azimuth of one hundred forty-seven degrees, zero three minutes,
fifty seconds (147º 03’ 50”) following the north-eastern boundary of the Province Of
New Brunswick property a distance of fifty-six and nine hundred eighty-five
thousandths (56.985) metres to a survey marker;
thence on a N.B. Grid Azimuth of one hundred seventy-five degrees, fifty-three
minutes, ten seconds (175º 53’ 10”) following the eastern boundary of the Province Of
New Brunswick property a distance of ninety and one hundred fifty-four thousandths
(90.154) metres to the point or place of beginning.
The so-described parcel of land contains an area of two thousand eight hundred and
twelve (2,812) square metres and is delineated as Parcel “D” on a “Plan Of Survey Of A
Portion Of Duke Street To Be Closed, Town Of Sussex, County of Kings, Province Of
New Brunswick”, dated January 22, 1998, prepared by Valley Surveys Ltd..
