A BY-LAW TO STOP UP AND CLOSE A PORTION OF
VAIL CRESCENT IN THE TOWN OF SUSSEX
TO VEHICULAR TRAFFIC
BY-LAW # 1800-97
The Council of the Town of Sussex pursuant to Secti on 187(2) of the
Municipalities Act enacts as follows.
The Council of the Town of Sussex does hereby stop up and close a portion
of the highway located in the said Town of Sussex and known as more
particularly described as follows:
beginning at a survey marker at the intersection of the south-east corner of
Lot 79-12 as shown on Plan No. 6633, the Way Bar Feed & Farm Supplies
Ltd. property and the south-west corner of Lot 94-2 as shown on Plan No.
200385, the Weyerhaeuser Canada Ltd. property on the northern boundary
of Vail Crescent; said point having a N.B. Grid Co-ordinate Value as follows:
Z=378 756.691 and Y=715 048.897;
thence on a N.B. Grid Azimuth of seventy-four degrees, thirty-eight
minutes, ten seconds (74º 38’ 10”) along the southern boundary of Lot 94-
2 a distance of one hundred thirteen and nine hundred twenty-four
thousandths (113.924) metres to a point at the beginning of a curve to the
right;
thence in a south-easterly direction following the arc of a curve along the
south-western boundary of Lot 94-2 a distance of seventy-one and eight
hundred nineteen thousandths (71.819) metres to a point; said curve havng
a radius of 45.720 metres, a chord Azimuth of 119º 38’ 00” and a chord
distance of 64.660 metres;

thence on a N.B Grid Azimuth of one hundred and sixty-four degrees,
thirty-eight minutes, zero zero seconds (164º 38’ 00”) following the
western boundary of Lot 94-2 and continuing along the western boundary
of the Town of Sussex property a distance of one hundred zero six and four
hundred ninety-six thousandths (106.496) metres to a point at the north-
west corner of Lot 81-18A as shown on Plan No. 7276, the Town of Sussex
property;
thence on a N.B. Grid Azimuth of two hundred fifty-three degrees, fourteen
minutes, fifty seconds (253º 14’ 50”) a distance of thirty and four hundred
ninety-one thousandths (30.491) metres to a survey marker at the north-
east corner of Lot 89-06 as shown on Plan No. 10107, the Sussex Machine
Shop Ltd. property; said point having a N.B. Grid Co-ordinate Value as
follows: X=378 921.773 and Y=714 935.631;
thence on a N.B. Grid Azimuth of three hundred forty-four degrees, thirty-
eight minutes, zero zero seconds (344º 38’ 00”) following the eastern
boundary of the Town of Sussex property a distance of one hundred zero
seven and two hundred thirty-seven thousandths (107.237) metres to a
point at the beginning of a curve to the left;
thence in a north-westerly direction along the arc of a curve a distance of
twenty-three and nine hundred forty thousandths (23.940) metres to a
point, said curve having a radius of 15.240 metres, a chord Azimuth of
299º 38’ 00” and a chord distance of 21.553 metres;
thence on a N.B. Grid Azimuth of two hundred fifty-four degrees, thirty-
eight minutes, ten seconds (254º 38’ 10”) following the northern boundary
of the Town of Sussex property a distance of seventy-three and one
hundred forty-eight thousandths (73.148) metres to a survey marker at the
north-east corner of Lot 86-1 as shown on Plan No. 9037, the Sussex
Distributors Ltd. property;
thence on a N.B. Grid Azimuth of two hundred fifty-four degrees, thirty-
eight minutes, ten seconds (254º 38’ 10”) following the northern boundary
of Lot 86-1 a distance of forty and seven hundred seventy-eight
thousandths (40.778) metres to a point; and

thence on a N.B. Grid Azimuth of three hundred forty-four degrees, thirty-
eight minutes, ten seconds (344º 38’ 10”) a distance of thirty and four
hundred eighty-one thousandths (30.481) metres to the point of beginning.
The so-described parcel of land contains an area of eight thousand one
hundred eighty-nine (8,189) square metres and is delineated on a “Plan of
Survey of a Portion of Vail Crescent to be Closed, Town of Sussex, County of
Kings, Province of New Brunswick”, dated January 2, 1997, prepared by
Valley Surveys Ltd.
IN WITNESS WHEREOF the Town of Sussex has caused the Corporate Seal
of the said Town to be affixed to this by-law on the 18th day of February,
