This Policy P 33 was last revised in September 2010.Council Motion 2015-517/2016 -007 directed staff “to review Policy P33 as it pertains to the financial reporting requirements of Fire Departments and bring back options to Council for consideration.”During the administrative and legal reviews, it was noted that several other areas of the Policy needed clarification. This review has been completed and revisions to Policy P33 proposed. RECOMMENDATION It is recommended that Council adopt the amendments as contained in Policy P33 dated February 21, 2017. BACKGROUND As outlined in Section XX of the MGA, the fire and emergency service providers within the Municipality have the responsibility to register with the Municipality. They are required to provide information on the services they intend to provide, the district covered and their ability to provide such services. The Municipality shall register the emergency services provider if it is satisfied that the body corporate (a)is capable of providing the services it offers to provide; (b) body corporate carries liability insurance, as required by the Municipality; (c) body corporate does not provide the fire services for profit; and (d)Municipality does not provide the same services for the same area. Council may make policies respecting full-time, volunteer and composite fire departments and emergency service providers in the Municipality and may include policies for requirements and procedures for registration, the manner of accounting to the Council for the use of funds provided by the municipality, and such other matters as are necessary and expedient for the provision of emergency services in the Municipality.Council may require proof of compliance with its policies before advancing any funds. REPORT TO:Municipal Council SUBMITTED BY:Community Development DATE:March 2, 2017 SUBJECT:Amendments to Policy P33 ORIGIN:Council Motion 2015-517/2016-007 Policy P33 September 2010 2 Request For Decision/Direction Policy P33 Fire and Emergency Service Providers-Registration and Annual Updates outlines requirements for registration and annual updates for those organizations providing fire and emergency services within the Municipality. The Fire Commissions have been providing annual registration updates in accordance with Policy P33 and the Municipality through its annual fire services review has maintained the registration approvals for all its registered fire and emergency services providers. Historically the annual registration information focused on operational capability of the fire service provider,i.e. membership, apparatus, equipment, training etc.with intent to assess the overall ability of the organization to provide the services for which it registered.The Municipality maintains this operational information in a data base for ongoing assessment of emergency service capability.Any significant change in service capability was brought to Council’s attention for review. Although Policy P 33 calls for an audited financial statement, the standard of the audit was not defined.Historically annual financial information included several different types of documents, namely,complete Provincially accredited audits (Village Commission),unaudited Financial Reviews from Provincially accredited accounting firms i.e.Grant Thornton and internal audits performed by the organization’s Directors. In May 2015, the Municipal Advisor met with Commission and Department members and outlined the requirements of the audits as contained in legislation.He advised the Province was expecting to have Commissions submit annual financial audits in accordance Provincially accredited accounting principles and firms.It was pointed out that although the Province had not been enforcing the requirement to date, it was not new,as such was outlined in the MGA (Villages),the Rural Fire District Act (Fire Commissions)and applicable to Commissions incorporated under other statutes. In the Registration Approvals of 2015/2016 (Schedule B)of February 2016 the Municipality advised the Fire Commissions that audits meeting the Provincial requirements would be required. The Municipality provided 24 months to meet this requirement. DISCUSSION Policy P33 was reviewed with the objective of defining which organizations are to be registered as fire and emergency services providers within the Municipality and clarifying the requirements and timing for annual registration updates,i.e.financial reporting, insurance coverages and other matters.The review also included reformatting the Schedule A providing for improved maintenance of registration data and easier revisions and updates. The recommended revision to Policy P33 (2010) include; a.Section 1,Definitions,provides, new definitions of several key terms i.e.“Commission”, “Body Corporate”, “Audited Financial Statement” and clarification on terms referencing the registration process, namely “Applicant”, “Application for Registration” and “Registration”.b.Section 2, Forms of Request (renamed), provides for the registration of the Fire Commission itself as the Authority Having Jurisdiction (AHJ) or appropriate Body Corporates that the AHJ provides the service through. Currently within the Municipality the body corporate responsible for the provision of fire and emergency 3 Request For Decision/Direction services is the Fire Commission (Village Commission for Chester). In the absence of such organizations the registration would likely fall to the Fire Departments themselves as they are all body corporates under the Societies Act.c.Section 3,Criteria for Approval of Registration,provides the general criteria for approval of a Registration as outlined in the MGA.Proof of insurance for firefighter accident and sickness or worker’s compensation coverage has been added.Audited financial statements are required for the Commissions as the registered Body Corporate. In Section 1, the “Audited Financial Statement”is defined as “a year-end financial report audited in accordance with the organizations act of incorporation or Provincial requirements.” d.Section 4 Registration Approval has no changes except the Notification process has been moved to Section 6. e.Section 5 (2010) Fire Tax Rate has been removed. Requirements to submit the approved fire tax rate as set by the Commission has been moved to the new Section 5 as a requirement for the annual updates. f.Section 5 Changes in Services and Annual Registration Update, requires that the registered body file immediately any significant changes that may impact the registered services provided. Annual updates including Schedule A operational information,the audited financial statement and proof of insurances are now required no later than June 30 th of each year for the registered body to receive fire taxes as collected by the Municipality on their behalf.The Municipality must provide the Schedule A operational data base information before May 30th to allow the registered bodies to complete their updates. g.Section 6 Notification has no changes as if reflects the Schedule B notification process as originally specified.h.Section 7 Definitions of Service Levels has remained the same as originally published in the MGA Guide. i.Schedule A which outlines the requirements for annual operational updates has been reformatted to provide for better data management. This Schedule may be refined in format without impact on policy from time to time to reflect improvements in data retrieval and maintenance. IMPLICATIONS A recent jurisdictional review of 6 neighboring Municipalities showed varying degrees of controls. All Municipalities surveyed were requesting annual financial statements however only Kings County was requesting these to be audited.Four of the 6 units had policy indicating the ability to hold back on fire tax distribution if appropriate documentation was not provided. There has been no further information from the Province and no indication of them moving away from the initial requirements as outlined in legislation and expressed in 2015. The cost for an annual financial audit from a provincially accredited audit firm is significantly higher than the current internal audits or unaudited financial statements that have been provided in the past. The current estimates for such an audit is a cost not to exceed $10,000. Actual audit fees are Commission specific based on the complexity of the financials and the current state of the controls in place.Although the Provincial requirements are not new, with the exception of the Chester Village Commission, the Commissions have not been in compliance.The associated costs therefore have not been appropriately budgeted and funded through the fire tax revenue.Several Commissions have expressed concern on the new expenditure requirements citing that funds would be better spent on operations. Policy Policy P33 is amended in accordance with Section XX of the MGA. 4 Request For Decision/Direction Financial/Budgetary There are no budgetary implications for MODC as funding comes from the fire tax revenue as levied by the Commissions. Environmental N/A Strategic Plan Maintain a high level of fiscal responsibility; Work Program Implications Staff work carried out in accordance with current fire services work plan. OPTIONS 1.Approve the amendments as outlined in P33 dated February 21, 2017 2.Not approve the amendments as outlined in P33 dated February 21, 2017 and direct staff to provide more information on proposed amendments. ATTACHMENTS Policy P33 as amended as of February 2017 (with changes highlighted) Policy P33 as amended as of February 2017 (final copy for acceptance) Section XX of the Municipal Government Act COMMUNICATIONS (INTERNAL/EXTERNAL) Communications concerning the audit requirements went out initially in February 2016 in which Council provided 24 months to provide such documentation. Reminders went out in February 2017 outlining that audited statements would be required for the fiscal year ending March 31, 2018. Several meetings have been arranged with Grant Thornton and the Commissions providing guidance on the requirements. 1 MUNICIPALITY OF THE DISTRICT OF CHESTER Policy P‐33 TERMS OF REFERENCE FOR REGISTRATION OF FIRE AND EMERGENCY SERVICE PROVIDERS In accordance with the Municipal Government Act, the Municipality of the District of Chester has established a registration system for those organizations who providinge fire and other emergency services in the Municipality. Section 1: Definitions 1) 1) “ Municipality ” means the Municipality of the District of Chester 2) “ Commission” means the organization through its incorporation under the MGA, an Act of Legislature, or the Rural Fire District Act, is authorized and empowered to provide for the inhabitants of the district a good and sufficient system of fire protection. 3) “ Body Corporate “ refers to the organization(s) that provide fire and/or emergency services on a not for profit basis and is incorporated by way of an Act of Legislature, the Rural Fire District Act, the Societies Act, the Companies Act or the Canada Business Corporations Act. 4) “ Application for Registration” refers to the information and supporting documentation as outlined in Schedule A of this Policy. 5) “ Registration ” means the acceptance by the Municipality of the Application for Registration to permit a Body Corporate to provide Fire and/or Emergency Services on a not for profit basis to a prescribed area within the Municipality. 6) “ Applicant ” refers to a Body Corporate applying for registration as a fire and/or emergency service provider within the Municipality. 7) ‘ Audited financial statement ’ means a year-end financial report audited in accordance with the organization’s Act of Incorporation or Provincial requirement. 8) 2) “ Registration ” means the acceptance by the Municipality of the Application to Register to permit an Applicant to provide Fire and/or Emergency Services to a prescribed area within the Municipality 3) “ Applicant ” refers to a Fire Department or Emergency Services Provider who must be a Non Profit entity incorporated by an Act of Legislature or Societies Act to provide Fire and/or Emergency Services 4) “ NFPA” means the National Fire Protection Association which provides generally recognized codes and standards for fire and emergency services Section 2: Forms of Request Criteria for Registration The Municipality will register Commissions themselves or appropriate Body Corporates that the Commissions may choose to engage provide fire and/or emergency services through. Requests for registration as a fire and/or emergency services provider shall be completed on the Application for Registration (Schedule A). The Application for Registration must be accompanied with the organization’s Act of Incorporation and a description of the area of coverage and all required supporting documentation as outlined in Schedule A. The Application for Registration must be signed by the individual(s) as assigned with signing authority under its Act of Incorporation. Section 3 Criteria for Approval of Registration The criteria for Registration of Fire and/or Emergency Service Providers is: 1) 1) An Application for Registration and accompanying supporting documentation, providing sufficient evidence of the Applicant’s ability to provide directly or under agreement with a service provider, the emergency services it intends to provide, and signed by the individual(s) with signing authority under its Act of Incorporation. 2) The Municipality must be satisfied that the Applicant is capable of providing the services and corresponding service levels that it intends to register. 3) The Applicant must be a Body Corporate in good standing intending to provide the services on a not for profit basis and must provide a copy of the organization’s Act of Incorporation. The Applicant must be a Body Corporate in good standing and must provide a copy of the organization’s Act of Incorporation. 2) The Applicant must operate on a not for profit basis. 3) The Municipality does not provide the same service for the same area. 2 4) Evidence that the Body Corporate carries of liability insurance coverage in the minimum amount as required by the Municipality.meeting the minimum Municipal requirements. 4) 5) Evidence that the Body Corporate carries accident and sickness insurance or worker’s compensation coverage for all membership providing emergency services. 5) An audited financial statement, for the Commission as the registered Body Corporate 6) An annual audited financial statement. 6) An Application to Register in the form of Schedule “A” and accompanying data base, providing appropriate evidence for the Municipality of its ability to provide the service it intends to provide, and signed by the individual(s) with signing authority in its Act of Incorporation. Section 43: Registration Approval and Notification 4.1 The Municipality may ask for a review, by an appropriate agency, to determine if an Applicant is capable of providing the services it intends to provide. 4.2 The Municipality, if satisfied with information and evidence provided for all items in Section 2, shall register the Applicant as a Fire and/or Emergency Services Provider for the Municipality. This Registration shall continue in force until withdrawn by the Municipality for cause or the Applicant requests that the Registration be revoked. The Municipality shall advise the Applicant by providing a letter (Schedule B) stating approval of the Registration. Section 54: Changes in Services and Annual Registration Update Annual Registration Update 5.1 Any significant changes that may impact the registered services provided by the registered Body Corporate shall be filed immediately with the Municipality. 5.2. Annual Updates of the registration form for each registered Body Corporate shall be submitted to the Municipality no later than June 30th of each year for the registered Body Corporate to receive fire taxes, in accordance with the rates as set by the Commission (Schedule C) and collected on their behalf by the Municipality and / or other Municipal funding. 5.3. In addition to the update of organizational and operational information (Schedule A) and Fire Tax Rates (Schedule C), proof of the renewal of liability insurance coverage, firefighter accident and sickness insurance coverage and an audited annual financial statement must be provided. 5.4 To facilitate the annual Registration update, the Municipality shall maintain a registry/data base of information s ubmitted by the registered Body Corporate. Fire and/or Emergency Services Providers. The most current Registration information on file with the Municipality will be provided in advance to each registered Body Corporate for review and update no later than May 30th of each year. Applicant. As there are typically changes in the organizational and operational areas of fire and/or emergency services, each Applicant will update the Registration information contained in Schedule A an annual basis. Section 5: Fire Tax Rate The Fire Tax Rate is set annually by the appropriate Fire Commission or Village Commission. The Applicant must provide or ensure it is provided, the approved rate (Schedule C) with certified copies of the estimates to the Municipality, within 60 days of the end of the previous fiscal year, for inclusion in the approved Municipal tax schedules for the current fiscal year. Section 6 Notification The Municipality shall advise the Body Corporate by providing a letter (Schedule B) stating approval by Council of the Registration and/or the Annual Registration update. Section 76: Definitions of Service Levels NFPA 1500 should be the corner stone upon which each Applicant attempts to meet the highest standard of safety. When evaluating the services to be provided, the Applicant shall refer to the general definitions of service levels following: Structural: means the activities of rescue, fire suppression, and property conservation in buildings, enclosed structures, vehicles, vessels, or like properties that are involved in a fire or emergency situation. The Applicant should have as a minimum: firefighters trained to NFPA 1001, protective personal equipment, PASS alarms, a personnel accountability system, adequate water supply, pumping capacity and an Incident Command (IC) system. The Applicant should also have the proper training and protective clothing for wild land fires in accordance with the Nova Scotia Department of Natural Resources’ provincial standard. Defensive: means actions that are intended to control a fire by limiting its spread to a defined area, avoiding the commitment of personnel and equipment to dangerous hazard areas. Defensive operations are generally performed from the exterior of structures and are based on a determination that the risk to personnel exceeds the potential benefits of offensive actions. The Applicant without the ability to carry out structural firefighting may register as providing property protection through defensive strategies. Rescue may be undertaken if the benefit warrants the risk. The Applicant should have proper training and protective clothing for wild land fires in accordance with the Nova Scotia Department of Natural Resources’ provincial standard. N/A: means the Applicant does not respond to these calls. Registered Medical First Responder: means the Applicant is registered with the Nova Scotia Department of Health through the Emergency Health Services (EHS) Medical First Responder (MFR) program and responds to medical calls or provides medical assistance at the scene of an incident. Medical Assistance: means the Applicant who has standard or emergency first aid and responds to medical emergencies or provides medical assistance at the scene of an incident. Equipment includes basic first aid supplies. The activities of vehicle rescue, water/ice rescue, structural/excavation collapse and high angle rescue should be carried out in accordance with NFPA 1670. Vehicle Rescue: means removal of victims from a vehicle following an accident. This may require elaborate or simple tools and knowledge depending upon the incident. The Applicant should be aware of its abilities and when it is necessary to request a higher level of service. 2 3 Policy P‐33 (continued) Notice of Intention ‐ By‐Law Committee – September 2, 2010 (2010‐418) Council ‐ 1st Notice – September 9, 2010 (2010‐426) Council ‐ 2nd Notice – September 30, 2010 (2010‐462) Amended Effective September 30, 2010 4 Policy P‐33 (continued) o Technician: properly maintained complete set of heavy hydraulic extrication equipment and associated spreaders, cutters, rams, chains, cribbing etc. and trained as a team to use the equipment, recognize hazards and protect the victim. o Operations: hand tools, manual hydraulic tools, air tools and trained as a team to use the equipment, recognize hazards and protect the victim. o Awareness: Does not have the equipment for extrication but does respond to motor vehicle accidents. Water Rescue: means rescue of individuals from rivers, lakes, ponds, and may include body retrieval. o Technician: survival suits, water rescue kit, if diving is provided‐‐ appropriate equipment for conditions, a boat including life jackets. Training to a level for the service provided, either surface rescue or diving. Ropes and other similar equipment should meet NFPA 1983. o Operations: approved life jackets for each rescuer, throw ropes, life ring with rope, a boat. Training should include boating safety. Ropes and other similar equipment should meet NFPA 1983. o Awareness: Responds but does not have the equipment or training. Ice Rescue: means rescue of individuals from extremely cold water or ice o Technician: complete ice rescue kit including floatation suit and ice board or equivalent. Training for cold water rescue. Ropes and other similar equipment should meet NFPA 1983. o Operations: approved life jackets for each rescuer, throw ropes, life ring with rope. Trained respecting safety of rescuer and victim. Ropes and other similar equipment should meet NFPA 1983. o Awareness: Responds but does not have the equipment or training. High Angle Rescue: means rescue of persons from building faces, cliffs trees or other locations where individuals must be lowered or raised by the rescuer. o Technician: equipment recommended by and training provided by a recognized high angle rescue organization. o Operations: Ropes and other similar equipment should meet NFPA Standards. gloves, protective clothing required for the incident. Training on knot tying. o Awareness: secures the scene, stabilizes the incident. Structural/ Excavation Collapse: means rescue of persons from collapsed ditches, etc. or collapsed structures. o Technician: providing this service should meet the full requirements of NFPA 1670. o Operations: provides a medium level of service in accordance to NFPA 1670. o Awareness: assists visible victims; prevents further collapse. All levels of HAZMAT response should carried out in accordance with NFPA 472 Hazardous Materials: means response to chemical incidents or other HAZMAT incidents in accordance with NFPA 472. Fuel spills such as oil, gas and diesel may be handled by all three levels if the spill is minor and stabilized. There is a wide range of service, from a domestic oil spill to an upset gasoline tanker. The important fact is recognizing the Applicant’s limitations. o Technician: Hazardous materials technicians are those persons who respond to releases or potential releases of hazardous materials for the purpose of controlling the release. The Applicant is not a municipal enterprise pursuant to the Municipal Finance Corporation Act. Section 1:Definitions 1)“Municipality ” means the Municipality of the District of Chester. 2)“ Commission” means the organization through its incorporation under the MGA, an Act of Legislature, or the Rural Fire District Act, is authorized and empowered to provide for the inhabitants of the district a good and sufficient system of fire protection.3)“ Body Corporate “ refers to the organization(s) that provide fire and/or emergency services on a not for profit basis and is incorporated by way of an Act of Legislature,the Rural Fire District Act,the Societies Act,the Companies Act or the Canada Business Corporations Act. 4)“ Application for Registration” refers to the information and supporting documentation as outlined in Schedule A of this Policy. 5)“Registration ” means the acceptance by the Municipality of the Application for Registration to permit aBody Corporate to provide Fire and/or Emergency Services on a not for profit basis to a prescribed area within the Municipality. 6)“Applicant ” refers to a Body Corporate applying for registration as a fire and/oremergency service provider within the Municipality. 7)‘ Audited financial statement ’ means a year-end financial report audited in accordance with the organization’s Act of Incorporationor Provincial requirement. 8)“NFPA” means the National Fire Protection Association which provides generally recognized codes and standards for fire and emergency services. Section 2: Forms of Request The Municipality will register Commissions themselves or appropriate Body Corporates that the Commissionsmay choose to engage to provide fire and/or emergency services.Requests for registration as a fire and/or emergency services provider shall be completed on the Application for Registration (Schedule A). The Application for Registration must be accompanied with the organization’s Act of Incorporation and a description of the area of coverage and all required supporting documentation as outlined in Schedule A. The Application for Registration must be signed by the individual(s) as assigned with signing authority under its Act of Incorporation. Section 3:Criteria for Approval of Registration The criteria for Registration of Fire and/or Emergency Service Providers is: 1)An Application for Registration and accompanying supporting documentation,providing sufficient evidence ofthe Applicant’s abilityto provide directly or under agreement with a service provider,the emergency services it intends to provide,and signed by the individual(s) with signing authority under its Act of Incorporation. 2)The Municipality must be satisfied that the Applicant is capable of providing the services and corresponding service levels that it intends to register. 3)TheApplicant must be a Body Corporate in good standing intending to provide the services on a not for profit basisand must provide a copy of the organization’s Act of Incorporation. 4)The Municipality does not provide the same services for the same area. 5)Evidence that the Body Corporate carries liability insurance coverage in the minimum amount as required by the Municipality.6)Evidence that the Body Corporate carries accident and sickness insurance or worker’s compensation coverage for all membership providing emergency services. 7)An audited financial statement, for the Commission as the registered Body Corporate Section 4:Registration Approval 4.1 The Municipality may ask for a review, by an appropriate agency, to determine if an Applicant is capable of providing the services it intends to provide. 4.2 The Municipality, if satisfied with information and evidence provided for all items in Section 2, shall register the Applicant as a Fire and/or Emergency ServicesProvider for the Municipality. MUNICIPALITY OF THE DISTRICT OF CHESTER P-33 FIRE AND EMERGENCY SERVICE PROVIDERS –Registration and Annual Updates Notice of Intention - Council -1st Notice – Council -2nd Notice -Amended Effective Section 5:Changes in Services and Annual Registration Update 5.1.Any significant changes that may impact theregisteredservices provided by theregistered Body Corporate shall be filed immediately with the Municipality. 5.2.Annual Updates of the registration form for each registered Body Corporate shall be submitted to the Municipality no later than June 30th of each year for the registered Body Corporate to receive fire taxes, in accordance with the rates as set by the Commission (Schedule C) and collected on their behalf by the Municipality and / or other Municipal funding. 5.3.In addition to the update of organizational and operational information (Schedule A)and Fire Tax Rates (Schedule C),proof of the renewal 0f liability insurance coverage, firefighter accident and sickness insurance coverage and an audited annual financial statement must be provided. 5.4.To facilitate the annual Registration update, the Municipality shall maintain a data base ofinformation submitted by the registered Body Corporate.The most current Registration information on file with the Municipality will be provided in advance and no later than May 30 th of each year to each registered Body Corporate for review and update. Section 6:Notification The Municipality shall advise the Body Corporate by providing a letter (Schedule B)stating approvalby Councilof theRegistration and/or the Annual Registration update. Section 7:Definitions of Service Levels NFPA 1500 should be the corner stone upon which each Applicant attempts to meet the highest standard of safety.When evaluating the services to be provided,the Applicant shall refer to the general definitions of service levels following: Structural:means the activities of rescue,fire suppression, and property conservation in buildings, enclosed structures, vehicles, vessels, or like properties that are involved in a fire or emergency situation.The Applicant should have as a minimum: firefighters trained to NFPA 1001, protective personal equipment, PASS alarms,a personnel accountability system, adequate water supply, pumping capacity and an Incident Command (IC)system.The Applicant should also have the proper training and protective clothing for wild land fires in accordance with the Nova Scotia Department of Natural Resources’ provincial standard. Defensive:means actions that are intended to control a fire by limiting its spread to a defined area, avoiding the commitment ofpersonnel and equipment to dangerous hazard areas.Defensive operations are generally performed from the exterior of structures and are based on a determination that the risk to personnel exceeds the potential benefits of offensive actions.The Applicant without the ability to carry out structural firefighting may register as providing property protection through defensive strategies. Rescue may be undertaken if the benefit warrants the risk.The Applicant should have proper training and protective clothing for wild land fires in accordance with the Nova Scotia Department of Natural Resources’ provincial standard. N/A: means the Applicant does not respond to these calls. Registered Medical First Responder: means the Applicant is registered with the Nova Scotia Department of Health through the Emergency Health Services (EHS)Medical First Responder (MFR)program and responds to medical calls or provides medical assistance at the scene of an incident. Medical Assistance:means the Applicant who has standard or emergency first aid and responds to medical emergencies or provides medical assistance at the scene of an incident. Equipment includes basic first aid supplies. The activities of vehicle rescue, water/ice rescue, structural/excavation collapse and high angle rescue should be carried out with reference to best practices outlined NFPA 1670 and associated standards. Vehicle Rescue: means removal of victims from a vehicle following an accident. This may require elaborate or simple tools and knowledge depending upon the incident. The Applicant should be aware of its abilities and when it is necessary to request a higher level of service. Water Rescue:means rescue of individuals from rivers, lakes, ponds, and may include body retrieval. o Technician: survival suits, water rescue kit, if diving is provided--appropriate equipment for conditions, a boat includinglife jackets. Training to a level for the service provided, either surface rescue or diving.Ropes and other similar equipment should meet NFPA 1983. o Operations: approved life jackets for each rescuer, throw ropes, life ring with rope, a boat. Hazardous Materials:means response to chemical incidents or other HAZMAT incidents in accordance with NFPA 472. Fuel spills such as oil, gas and diesel may be handled by all three levels if the spill is minor and stabilized. There is a wide range of service, from a domestic oil spill to an upset gasoline tanker. The important fact is recognizing the Applicant’s limitations. o Technician: Hazardous materials technicians are those persons who respond to releases or potential releases of hazardous materials for the purpose of controlling the release. Hazardous materials technicians are expected to use specialized chemical protective clothing and specialized control equipment. o Operations:First responders at the operations level are expected to respond defensively to control the release and spread from a safe distance. o Awareness: First responders at the awareness level are those persons who could be the first on the scene of an emergency involving hazardous materials. RECOMMENDATION For discussion and direction. BACKGROUND Provincial regulations are in place concerning advertising signage on or near public highways.To construct advertising signage along a public highway, a permit is required from Transportation and Infrastructure Renewal.Additionally, advertising signage is not permitted within 1,000 metres of a controlled access highway, which includes the access road to Highway 103 at exit 7. Thus, the existing signage at Exit 7 is illegal. Staff at NSTIR have indicated that they do not actively seek out illegal signage but they will remove it if it interferes with official signage, or if a complaint is received. Mill Lake 1 Road (Exit 6), Highway 14 (Exit 8), and Highway 12 (Exit 9) are not controlled access highways, so advertising signage is permitted where these roads intersect with Highway 3, though signage without a license from NSTIR is still illegal. In 2011, an amendment to the Public Highways Act enabled municipalities to enact a by-law regulating most aspects of advertising signage on non-100-series provincially owned highways. This allows the municipality to have greater control over signage that is erected, and allows the Municipality to remove signage that is not in compliance with the by-law.However, the provincial REPORT TO:Municipal Council SUBMITTED BY:Community Development Department DATE:3/17/2017 SUBJECT:Enforcement of Highway Signage Regulations at Exit 7 ORIGIN:Council Motion 2017-106 2 request for d 1,000 metre prohibition from the centre line of a controlled access highway would still apply, meaning the Municipality could not allow any signage at exit 7. In 2012, the Municipality drafted a Highway Signage By-law, but it was abandoned before second reading as Council was looking for a way to replace signage for Uniform directional signage (i.e signage directing traffic to galleries, shops, restaurants etc).At the time, it was explained that signage could not be replaced at controlled access highways. Nova Scotia Power also prohibits signage from being installed on utility poles, which is currently present at some highway exits. DISCUSSION Ensuring that the exits from the 103 provide an attractive, welcoming gateway into our communities must be balanced with the needs of local businesses to advertise their locations. While the current state of advertising signage is quite cluttered, the removal of all signage could be detrimental to local businesses.If the Municipality were to ask NSTIR to remove advertising signage, it would likely mean all illegal signage would have to be removed, rather than just the derelict or cluttered signage.This would mean all signage at the intersection of exit 7 with Highway 3 would have to be removed. Creating a Highway Advertising Signage By-law would allow the municipality to set standards for signage at all highway exits in the municipality except for Exit 7, which is controlled access.Many jurisdictions have created uniform advertising programs, where businesses pay to have directional signage installed on a combined advertising structure, rather than installing their own billboard.Halifax has taken this approach for a section of Highway 333 between Tantallon and Ragged Lake. Unfortunately, it appears that under the current regulations,the only options available for exit 7 are making a complaint to NSTIR, which would likely result in the removal of all signage, or leaving the status quo. OPTIONS 1.Direct staff to write a letter to Nova Scotia Transportation and Infrastructure Renewal requesting that advertising signage located on Highway 3 where is intersects with Exit 7, which is not in compliance with the regulations be removed by NSTIR.Under this option, signage would not be replaced with uniform signage. 2.Direct staff to write a letter to Nova Scotia Transportation and Infrastructure Renewal requesting that advertising signage located on Highway 3 where is intersects with Exit 7, Trunk 12, Trunk 14 and Mill Lake 1 Rd.,which is not in compliance with the regulations be removed by NSTIR.Under this option, signage would not be replaced with uniform signage. 3.Draft a Highway Advertising Signage By-law that would allow the Municipality to regulate signage and remove illegal signage.This would allow the Municipality to regulate signage and to consider replacement with uniform signage in all areas except Exit 7. 4.Do nothing (Status quo). The Capital Budget reflects the replacement of 5 cylinders per year. Bunker Gear Washer $15,000 Fire Rate -Capital 15,000 The CVFD currently does not reach the recommended standard for bunker gear cleaning and inspection. The bunker gear washer will reduce contamination of PPE and prolong the life of equipment. The purchase of this washer will bring the CVFD in line with national standards and will reflect a decrease in operating expenses. E-Draulic Spreaders $22,000 Fire Rate -Capital 22,000 As part of Village of Chester’s asset management plan, the E-Draulic spreaders is identified to upgrade our Jaws of Life equipment and will replace current aging equipment (25 years old). 521 Cascade Upgrade to 6000 psi $15,000 Fire Rate -Capital 15,000 The current cascade system on 521-Rescue Truck is unable to fill full SCBA cylinders after 4 tanks. This upgrade from 4,500 to 6000 psi will allow the continued filling of essential equipment while at an emergency scene. Light Upgrades $8,000 Fire Rate -Capital 8,000 The funds will be used to upgrade the halogen lights that currently make up the portable generator fed scene lights. As well an upgrade of the halogen emergency lights on the rear of 521 to larger LED lights. Inland Boat Equipment $4,000 Fire Rate -Capital 4,000 The funds will provide a custom quick remove cover constructed with multiple zipper access doors and a zipper hatch to allow the motor to be raised and lowered without removal. This cover will be on the boat for 90% of it's service only to be removed for emergency situations. We will also be purchasing handheld re-chargeable battery LED search lights. The current ones no longer hold a charge and use legacy bulbs.
