The Council of the Town of Sussex; under and by authority vested in it by
the Local Governance Act, Section 10 (1) (11) hereby enacts as follows:
I. DEFINITIONS;
(1) "closed " means not open for the service of a customer;
(ii) "open" means open for the service of a customer;
(iii) "retail business" means the renting of offering for rent,
selling or offering for sale any goods, chattels or services by
retail, as defined in the Days of Rest Act, R.S.N.B 1985, c D-
4.2, and all amendments thereto;
(iv) "weekly day of rest" means Sunday, as defined in the Days of
Rest Act, R.S.N.B 1985, c D-4.2, and all amendments thereto;
II. HOURS OF OPERATION:
(i)
All retail businesses are permitted to open or cause to be open
on the weekly day of rest.
(ii) No retail business shall open, or cause to be opened a retail
business on the following holiday's falling on Sunday in any
year:
a. New Year's Day,
b. Easter Sunday,
c. Canada Day, unless the Province of New Brunswick declares
a specific day of observation for Canada Day in which case
the day declared by the Province of New Brunswick shall
prevail.

d. Remembrance Day,
e. Christmas Day, and
f. Boxing Day.
III. PLURAL OR FEMININE TERMS
Plural or feminine terms may apply whenever the singular,
masculine or feminine is used in this By -Law. It shall be considered
as if the plural, feminine or masculine has been used, where the
context of the party or parties hereto so requires.
IV. REPEAL
(1)
The repeal of "Sunday Shopping By -Law, By -Law #1020-17"
shall not affect any penalty, forfeiture or liability incurred
before such repeal or any proceeding for enforcing the same,
completed or pending at the time of repeal; nor shall it repeal,
defeat, disturb, invalidate or prejudicially affect any manner
or thing whatsoever, completed, existing or pending, at the
time of repeal.
(ii) The By -Law entitled "Sunday Shopping By -Law, By -Law
#1020-17" that came into force on the 07th day of December,
2017, and amendments thereto, are hereby repealed.
