DISCLOSURE OF CONFLICT OF INTEREST No members present declared a conflict on any of the items on the agenda at this time. 3. APPROVAL OF MINUTES 3.a Regular Meeting September 11, 2023 Moved by: Councillor Nelson Seconded by: Councillor Bobbitt THAT the Committee approve the minutes of meeting 09-23 as circulated. Motion Carried 3.b Special Meeting September 14, 2023 Moved by: Councillor Brenan Seconded by: Councillor MacLeod Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 2 THAT the Committee approve the minutes of meeting 09-14-23 as circulated. Motion Carried 4. DELEGATION 4.a RICHARD PEARSON - ATV USE OF TOWN STREETS Chairman Milner welcomes Mr. Pearson to the meeting. Mr. Pearson wishes to discuss the "flagellant violation of the law". Wants to know where the ATVs are allowed to travel. Chairman Milner describes the By-law and the route on Main Street. Mr. Pearson wishes to speak of an incident in Ward 2 recently. No description of the incident. Concerns about someone possibly getting hurt. Quotes discussion posts on social media from others but provides no information to the Committee. • Quotes an elderly lady related to ATV activity in Ward 2. • Quotes Jack Lynch. • Quotes Bobby -Lee Craft. • Believes the privilege is getting abused by others. • Either enforce the By-law or repeal it. • Many quotes from others. • Quotes his conversation with the RCMP member about tracking of plates ofATV's and the ability to collect plate data. • No respect for the trail ending at All Seasons. Mr. Pearson believes there are 2 choices where Ward 2 begins. Turn around and go back or have the vehicle towed. Believes ATVs on sidewalks are not safe. Mayor Thorne and Chairman Milner thank Mr. Pearson for his recent correspondence on the issue. Brief discussion. Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 3 Sgt. Luc Sampson reviews with the Committee the topic and the possible solution. Sgt. Sampson offers to Mr. Pearson to meet and discuss the incident. 5. POLICE SERVICE REPORT Sergeant Sampson reviews with the Committee the September 2023 statistics: • 1,767 Occurrences year-to-date, 1,491 occurrences for the same period in 2022. • 46 Assaults. • 47 Break and enters. • 7 Arson • 4 Drug offences. • 63 Mental health act. • 21 Fraud calls. • 3 Robbery and extortion. • 5 Theft of a motor vehicle. • 4 Theft over $5,000. • 1,574 All other occurrences. "All other occurrences" includes occurrences that do not fall into the ones highlighted on the map. The ones displayed on the map have been chosen because they are the types of occurrences that communities ask frequently for. The "All Other Occurrences" category may include the following: • Agency defined activities (abandoned 911 calls, false alarms, assistance to the public, assistance to other agencies, suspicious persons, etc.) • Other criminal offences (breach of court order, domestic violence, offences under Federal Acts, etc.) • Traffic -related offences (Motor Vehicle Act offences, traffic collisions, etc.) Sgt. ANIMAL CONTROL REPORT CAO Hatcher indicates there is no Animal Control Report for September 2023. 7. FIRE SERVICE REPORT 7.a IN TOWN CALLS Chief Reicker reviews the in -town calls for September 2023 with the Committee. There were 21 calls in September 2023, 16 calls in September 2022. There were 129 calls year to date September 2023, 90 calls year to date in September 2022. • 2 Alarm Response — Residential — Human Error • 1 Alarm Response — Residential — Technical • 1 Alarm Response — Comm/Ind — Human Error • 1 Alarm Response — Comm/Ind — Technical • 2 Alarm Response — Comm/Ind — Carbon Monoxide • 1 Vehicle Fires • 4MVC • 1 Hazmat • 6 Dumpster/Garbage Fire • 2 Fire Pits 7.b OUT OF TOWN CALLS Chief Reicker reviews the out-of-town calls for September 2023 with the Committee. There were 9 calls in September 2023, 10 calls in September 2022. There were 76 calls year to date 2023, 104 calls year to date in 2022. • 1 Major Structure Fire — Residential • 1 Hydro Pole/Downed Wires • 3MVC • 1 Dumpster/Garbage Fire • 1 Public Assistance Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 5 • 2 Mutual Aid A grand total of 30 calls in September 2023, compared to 26 in September 2022. 205 grand total calls year-to-date, compared to 194 total calls for the same period in 2022. 7.c VOLUNTEER HOURS Chief Reicker reviews the report which indicated that the number of volunteer hours by fire service personnel for the month of September 2023 totaled 193.50 hours. Volunteer hours for the same period last year totaled 194.00 hours. Details of volunteer hours include the following: • 17.00 Monthly Meetings • 5.00 Officers' meetings • 2.00 Zone 1 meetings • 5.00 Royal meetings • 2.00 EMO radio • 87.50 In-house training • 75.00 Tours/Public events • $3,200.49 cost equivalent of volunteer hours The volunteer hours for this year to date totaled 1,659.50 hours, and in the same year to date in 2022 were 1,296.50 hours. Total hours for fire calls in September 2023 are 389.00 hours in comparison to 262.00 hours for the same period in 2022. There were 2,983.00 total hours this year to date, and 2,200.00 hours for the same period 2022. 7.d SUSSEX FIRE DEPARTMENT - 3rd QUARTER QUINT USAGE REPORT Chief Reicker reviews with the Committee the 3rd quarter quint usage report. 7.e SUSSEX FIRE OFFICIERS MEETING MINUTES -AUGUST 31ST, 2023 Chief Reicker reviews with the Committee the Officer's Meeting minutes held on August 31st, 2023. • Highlights gas detectors. Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 • Recruitment scheduled for October 17, 2023. 7.f SUSSEX FIRE REGULAR MEETING MINUTES - SEPTEMBER 07, 2023 Chief Reicker reviews with the Committee the September 7, 2023, Regular Meeting minutes. Brief discussion and highlights the meeting topics. 7.g FIRE PREVENTION - SAFETY EDUCATION REPORT - SEPTEMBER 07, 2023 Chief Reicker reviews with the Committee the Fire Prevention Safety Education Report dated September 7, 2023. Report received and filed by the Committee. 7.h FIRE CALL DISCUSSION - RECENT INCREASE IN OCCURRENCES AND ADDED RESPONSES Lengthy discussion on the increase in fire responses to various areas of the Town and the concern that this may be the prelude to something more significant. The Committee had a number of questions for Chief Reicker and Sgt. Sampson related to this concerning trend. 8. BUILDING INSPECTION / BY-LAW ENFORCEMENT REPORT 8.a MONTHLY BUILDING PERMIT REPORT TO COMMITTEE The Monthly Building Permit Report indicated that 13 permits were issued during the month of September 2023 with a total evaluation of $9,616,132 while September 2022 permits were valued at $3,101,946 in Ward 1 and $85,000 in Ward 2. 8.b MONTHLY BUILDING PERMIT REPORT TO COUNCIL Report to Council will be filed with Council at their regular meeting. 8.c BUILDING PERMIT ENFORCEMENT There is nothing new to report on this item at this time. 8.d ENFORCEMENT AND BY-LAWS 8.d.1 23 - 25 PETER STREET PID 00263558 CAO Hatcher provides a status update. The Notice to Comply was posted on the building at 23-25 Peter Street on Wednesday, September 27th, 2023. A letter of appeal has been received from the property owner therefore an Appeals Committee must be set up. Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 8.d.2 102 PARK STREET PID 00264606 A demolition permit was taken out on Tuesday, October 2, 2023, and the house was torn down that same day. An inspection was performed Wednesday, October 3, 2023, to assure the property has been cleaned up. It is recommended that this be removed from the dangerous and unsightly list. Moved by: Deputy Mayor Wilson Seconded by: Councillor MacLeod THAT the Committee recommend to Council that Council remove this item from the dangerous and unsightly list. Motion Carried 8.e BY-LAW ENFORCEMENT 8.e.1 12 STEWARTAVENUE - FIERCE AND DANGEROUS ANIMAL Ongoing and pending hearing scheduled for November 1, 2023. 8.e,2 82 PARK STREET - FIERCE AND DANGEROUS ANIMAL The letter was hand delivered on September 19th, 2023. The letter detailed the requirements under the By-law and gave the animal owner until November 20th, 2023, to comply and at that time an inspection will be done. CAO Hatcher advises of the steps taken to provide a written notice to both the dog owner and the property owner. 8.f GENERAL Nothing to report at this time. 8.g REQUESTS FOR APPROVAL Nothing to report at this time. 9. BUSINESS ARISING OUT OF MINUTES 9.a 23 - 25 PETER STREET - NOTICE TO COMPLY CAO Hatcher advises of the pending appeal of the Notice to Comply to secure added/needed time to implement the required improvements. The property owner has indicated their commitment to have all work done by April 30, 2024. On that date, the owner is expecting habitation. An appeals Committee meeting will soon be convened to hear this appeal. Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 10. NEW BUSINESS 10.a IOM CHIEF REICKER - PAGER RECOMENDATION Chief Reicker reviews with the Committee the purchase of 4 Minitor VI single channel VHF pagers to replace faulty units. Moved by: Councillor Maguire Seconded by: Councillor MacLeod THAT the Committee recommend to Council that Council approve the procurement of 4 Minitor VI single channel VHF pagers from Custom Communications for the purchase price of $2,380.00 exclusive of HST and programming costs. Motion Carried 10.b IOM CHIEF REICKER - QUINT TIRE REPLACEMENT RECOMENDATION Chief Reicker reviews with the Committee the scheduled Quint tire replacement recommended within the NFPA guidelines to replace tired on emergency apparatus ever 7 to 10 years. Brief discussion. Moved by: Councillor Brenan Seconded by: Councillor Bobbitt THAT the Committee recommend to Council that Council authorize the replacement of the Quint tires from Sussex Tire at a cost of $6,150.00 exclusive of HST. Motion Carried 10.c IOM CHIEF REICKER - STRUCTURAL FIREFIGHTING BOOT RECOMENDATION Chief Reicker reviews with the Committee the recommendation to retire 10 pairs of structural firefighter ensembles/boots in accordance with the NFPA 1851 guidelines. Brief discussion on the procurement of this item and the consolidation with Treasurer Moffett related to budget reallocation to fund this purchase. Moved by: Councillor MacLeod Seconded by: Councillor Bobbitt THAT the Committee recommend to Council that Council authorize the purchase of 10 pairs of structural firefighting boots at a cost of $6,035.00 excluding HST and freight FOB Sussex from Safety Source Fire. Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 9 Motion Carried 10.d IOM CHIEF REICKER - THERMAL IMAGING CAMERA RECOMENDATION Chief Reicker reviews with the Committee the recommendation to purchase a thermal imaging camera and to retire an existing camera and to offer the same as a trade in considering the new purchase. Chief Reicker highlights the budgeting reallocation authorized by Treasurer Moffett to consider this purchase. Brief discussion. Moved by: Councillor Bobbitt Seconded by: Councillor Nelson THAT the Committee recommend to Council that Council authorize the purchase of a Bullard NXT-Bundle from Safety Source Fire at a cost of $13,500 exclusive of HST. Motion Carried Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT the Committee recommend to Council that Council authorize the disposal and trade in of the existing thermal imaging camera in the amount of $750.00. Motion Carried 10.e NBEMO PLANNING SESSION UPCOMING CAO Hatcher advises of the upcoming planning session with NBEMO to discuss all aspects of emergency planning and the integration of climate change in future emergency responses. Correspondence received and filed by the Committee. 10.f SUSSEX LEGION BRANCH 20 - 2023 REQUESTS CAO Hatcher reviews with the Committee the 2 requests received from the Sussex Legion related to the upcoming 2023 Remembrance Day ceremony. Mayor Thorne has indicated he will be in attendance for the 2023 first poppy and flag raising at Town Hall on October 27th, 2023, beginning at 10am. Protective Services Committee Minutes Meeting 10-23 October 16th, 2023 10 CAO Hatcher reviewed the Sussex Legion Branch 20 request for the Remembrance Day ceremony on Broad Street as well as the necessary road closure and parade route in support of this event. Moved by: Councillor Brenan Seconded by: Mayor Thorne THAT the Committee recommend to Council that Council authorize • To hold a gathering commemorating the 2023 Remembrance Day Event on Saturday, November 11th, 2023, beginning at 10:OOAM and ending at 12:30 PM. • To permit a mid -block street closure of Broad Street between Queen Street and Main Street. • To authorize a Parade to the Cenotaph scheduled to commence Saturday, November 11, 2023, beginning at 10:15AM. • Commencing in the parking lot of the Royal Canadian Legion on Magnolia Avenue; thence along Magnolia Avenue from the Royal Canadian Legion parking lot to Main Street; thence along Main Street from Magnolia Avenue to the intersection of Main Street and Broad Street; thence along Broad Street to the Cenotaph; thence, after the Ceremony at the Cenotaph, parade from the Cenotaph to Main Street; thence along Main Street from Broad Street to Magnolia Avenue; thence along Magnolia Avenue from Main Street to the parking lot of the Royal Canadian Legion." In addition, the Town will undertake the necessary traffic control to maintain barricaded control with a person controlling ingress and egress to the closure section and as well the Town will supply the necessary traffic control devices, manpower and signage for the November 11th event.
