B0J2M0 August 15, 2018 Glen Strang, Area Manager Nova Scotia Department of Transportation & Infrastructure Renewal 449 Jubilee Road PO Box 409 Bridgewater, NS B4V2X6 Dear Mr. Strang, RE: July 13, 2018 Forties Road Fatality As you are likely aware, there was a fatal car accident on the Forties Road, (New Ross) on July 13, 2018. A Mother died and her two young sons were seriously injured. This is not the first ca r accident/fatality at this location. In the summer months the traffic on the Forties road increases tremendously due to cottagers traveling to their cottages and also parents traveling to Sherbrooke Lake Camp. The Forties road is a direct route to neighboring communities such as Middleton, New Germany, Bridgewater etc. It is also a main route for large trucks carrying logs across the upper end of this county. With such a high volume of traffic this dangerous section of highway needs to be closely investigated in order to come up with a solution to prevent future accidents. Over the years there have been three fatalities in that same location as well as numerous other accidents where vehicles have gone off the highway. Had there been vehicles coming from the other direction at the same time; the number of fatalities could have been significantly higher.We feel that this location of highway can only lead to more accidents or fatalities if steps to correct the problem are not taken. RECOMMENDATION Give first reading to the “System of Fire Inspections” policy as required by Section 14 of the Nova Scotia Fire Safety Regulations. BACKGROUND Fire inspections have been taking place in the Municipality of Chester for many years without a clear system in place for the frequency of inspections for specific occupancies. DISCUSSION The Nova Scotia Fire Safety Regulations Section 14, states the following; (1)A municipality must inspect an assembly occupancy (Group A) once every 3 years after the inspection under Section 13.* (2)A municipality must carry out a system of fire inspections on all buildings containing the following occupancies: a.A residential occupancy (Group C) that has more than 3 units and is not regulated under the Homes for Special Care Act; b.A business and personal services occupancy (Group D); c.A mercantile occupancy (Group E); d.An industrial occupancy (Group F). * Nova Scotia Fire Safety Regulations Section 13 outlines when the initial inspection of an assembly occupancy (Group A) is required to be completed. The instatement of a Policy Respecting a System of Fire Inspections would continually reinforce the positive image of the Municipality through leadership in public engagement and communication, and promote conditions conducive to fostering economic prosperity. OPTIONS 1.Adopt the draft policy 2.Provide direction for clarifications and direct staff to m ake changes to the draft policy ATTACHMENTS Draft Policy Respecting a System of Fire Inspections COMMUNICATIONS (INTE RNAL/EXTERNAL) Municipality of the District of Chester System of Municipal Fire Inspections Policy P-XX Amended Effective:August 18, 2018 Fees Policy (continued) Notice of Intention to Amend –First Notice –Council –Second Notice –Effective Date –Page 2 MUNICIPALITY OF THE DISTRICT OF CHESTER SYSTEM OF MUNICIPAL FIRE INSPECTIONS POLICY P-20 PURPOSE Section 19 of the Nova Scotia Fire Safety Act requires that a Municipality establish a system of fire inspections of land and premises which comply with the Nova Scotia Fire Safety Regulations. Nova Scotia Fire Safety Regulations Section 13 and 14 sets out the requirements for establishing that System of Inspections for Municipalities. This Policy establishes the System of Inspections as required by the Nova Scotia Fire Safety Act and accompanying Regulations. This policy is entitled the “System of Municipal Fire Inspections”. INTERPRETATION 1)In this Policy; a)“ASSEMBLY OCCUPANCY (Group A)”means the Assembly Occupancy as defined in the National Building Code of Canada (2015), as amended from time to time; b)“BUSINESS and PERSONAL SERVICE OCCUPANCY (Group D)”means a Business and Personal Service Occupancy as defined by the National Building C ode of Canada (2015), as amended from time to time; c)“COUNCIL”means the Council of the Municipality of the District of Chester; d)“FIRE SAFETY ACT” (or “Act”)means “An Act to Promote and Encourage Fire Safety” Chapter 6 of the Acts of 2002, Nova Scotia, as amended from time to time, and any other successor legislation;“INSPECTOR”means the Municipal fire inspector(s) for the Municipality as appointed under the “Act”; e)“FIRE SAFETY REGULATIONS” (or “Regulations”)means the “Regulations Respecting Fire Safety” made by the Governor in Council pursuant to Section 51 of the Fire Safety Act, Chapter 6 of the Acts of 2002, Nova Scotia, as amended from time to time; f)“INDUSTRIAL OCCUPANCY (Group F)”means an Industrial Occupancy as defined in the National Building Code of Canada (2015), as amended from time to time; g)“INSPECTION”means a Fire and Life Safety Inspection as identified in the “ACT”. An inspection is the primary inspection of a regulatory scheduled fire and lif e safety inspection, and for further clarity: h)“RE-INSPECTION”means a follow-up inspection which is carried out to determine if deficiencies identified during an inspection have been corrected. i)“MERCANTILE OCCUPANCY (Group E)”means a Mercantile Occupancy as defined in the National Building Code (2015), as amended from time to time; Fees Policy (continued) Notice of Intention to Amend –First Notice –Council –Second Notice –Effective Date –Page 3 j)“MUNICIPAL FIRE INSPECTOR”means a person appointed by the Municipality as a Municipal Fire Inspector pursuant to the Fire Safety Act, Chapter 6 of the Acts of 2002, Nova Scotia, as amended from time to time; k)“MUNICPALITY”means the Municipality of the District of Chester; l)“RESIDENTIAL OCCUPANCY (Group C)”means the Residential Occupancy as defined in the National Building Code (2015), as amended from time to time; 2)Unless otherwise defined in this policy, terminology that is defined in the "Act" shall have the same meaning when used in this policy. 3)Unless otherwise defined in this policy, terminology that is defined in the "Code" shall have the same meaning when used in this policy. POLICY STATEMENTS 1.Pursuant to Section 19 of the Fire Safety Act, this Policy establishes a “System o f Municipal Fire Inspections” to provide for compliance with that Act and the Fire Safety Regulations and that recognizes municipal resources, geography and priorities based upon risk assessment. Municipal Fire Inspector 2.Pursuant to Section 19 of the Fire Safety Act, Council shall appoint one or more Municipal Fire Inspectors, whom shall carry out the System of Municipal Fire Inspections in accordance with the requirements of the Nova Scotia Fire Safety Act and Fire Safety Regulations. Systems of Inspection 3.Pursuant to Section 2 of this Policy, Council hereby establishes the following System of Municipal Fire Inspections. A)Assembly Occupancies (Group A) i)As per Section 13 of the Fire Safety Regulations one inspection every three (3) years. B)Residential Occupancies (Group C) i)Buildings with more than three (3) units, and not regulated under the “Homes for Special Care Act”will be inspected every three (3) years, unless the Municipal Fire Inspector deems that, to reduce risk of fire and loss of life, a mor e frequent inspection of one or more buildings is required. C)Business and Personal Service Occupancies (Group D) i)Buildings will be inspected every five years, unless the Municipal Fire Inspector deems, that to reduce risk of fire and loss of life, a more frequent inspection of one or more particular buildings is required. D)Mercantile Occupancies (Group E) Fees Policy (continued) Notice of Intention to Amend –First Notice –Council –Second Notice –Effective Date –Page 4 i)Buildings will be inspected every five (5) years, unless the Municipal Fire Inspector deems, that to reduce risk of fire and loss of life, a more frequent inspection of one or more particular buildings is required. E)Industrial Occupancies-High Hazard (Group F-1) i)Buildings will be inspected every three (3) years, unless the Municipal Fire Inspector deems, that to reduce risk of fire and loss of life, a more frequent inspection of one or more particular buildings is required. F)Industrial Occupancies-Medium/ Low Hazard (Group F-2/ F-3) i)Buildings will be inspected every five (5) years, unless the Municipal Fire Inspector deems, that to reduce risk of fire and loss of life, a more frequent inspection of one or more particular buildings is required. 4.The schedule of inspections will be commencing in 2018. 5.Where a deficiency or issue has been identified during an inspection required under this policy, the inspector may conduct re-inspections as deemed necessary to ensure the outstanding issues, deficiencies or violations are addressed. 6.Occupancies may be inspected more frequently than identified in “Appendix A” if deemed necessary by the Inspector,in order to reduce the risk of fire or loss of life. Violations and Inspections by Complaint or Request 7.Inspections may be carried out on any occupancy required under this policy, if deemed necessary by the inspector upon the receipt of a complaint. 8.To assist in the inspection process, it is preferred that contact information for the complainant be obtained and kept confidential. 9.Complaints received on any occupancy not identified in Section 4 shall be dealt with in accordance with the Act and in coordination with the Nova Scotia Office of the Fire Marshal. 10.Where the inspector deems that a violation or potential violation is a Fire and Life Safety issue the issue shall be visited within 10 business days of receipt of the compliant. 11.Where the inspector deems that a violation or potential violation is a serious Fire and Life Safety issue including, but not limited to, exiting, incorrect storage of flammable/ combustible liquids the issue shall be visited within 24 hours upon receipt of the complaint. 12.If violations, or alleged violations for those occupancy that require inspectionsunder this policy come to the attention of the Municipality the inspector shall investigate the violation. 13.If, during the course of any inspection, the inspector identifies any violation(s) that he/she feels may present a serious or imminent life safety hazard or a recurring deficiency, they may act upon such as provided for by the Act. This may include the immediate issuance of an Order as provided for under the Act. Fees Policy (continued) Notice of Intention to Amend –First Notice –Council –Second Notice –Effective Date –Page 5 14.If, after any re-inspection,there are still outstanding deficiencies, the inspector may issue an Order as provided for under the Act. Failure to Comply with Order Summary Conviction 15.Where the owner of a building, land or premises fails to comply with an order to Comply issued by the Municipal Fire Inspector, the Municipal Fire Inspector may take action as set out in Section 44 of the Fire Safety Act. Carrying on Matters not Done by Owner 16.Pursuant to Section 30 of the Nova Scotia Fire Safety Act, where an owner of a building, land or premises fails to comply with an Order issued by the Municipal Fire Inspector : a.Where the expenditure required to remedy the violation equal to or less than the amount prescribed by the Act and regulations,the Municipal Fire Inspector may carry out or cause to be carried out an Order with the approval of the Fire Marshal and the warden or Chief Administrative Officer; b.Where the expenditure required to remedy the violation is greater than $the amount prescribed by the Act and Regulations, the Municipal Fire Inspector may request the Minister to approval an order for compliance on a case by case basis. 17.The costs incurred with carrying out the work pursuant to Section 16 shall be recovered in accordance with Section 30 and 31 of the Nova Scotia Fire Safety Ac t.
