Approval of Agenda Moved by: Councillor Nelson Seconded by: Councillor MacLeod THAT the agenda for this regular Council meeting be approved as circulated. Motion Carried 2. Disclosure of Conflict of Interest No members present declared a conflict of interest on any items on the agenda at this time. 3. Approval of Minutes 3.a Regular Council Meeting - January 16, 2023 Moved by: Councillor Milner Seconded by: Councillor Brenan THAT the minutes of the regular meeting of the Council of the town of Sussex, held on January 16, 2023 be approved as circulated. Motion Carried 3.b Special Council Meeting January 31, 2023 Moved by: Councillor Bobbitt Seconded by: Councillor Maguire THAT the minutes of the special meeting of the Council of the town of Sussex, held on January 31, 2023 be approved as circulated. Motion Carried 4. Business Arising Out of Committee -Of -The -Whole There was no business arising out of Committee of the Whole. 5. Delegations, Petitions and Correspondence: 5.a Heart & Stroke Foundation Moved by: Councillor Brenan Seconded by: Councillor Nelson 2 THAT the correspondence from the NB Heart and Stroke Foundation be recieved and filed. Motion Carried 5.b Fibromyalgia Awareness Day Request THAT the gates at O'Connell Park be lit purple to raise awareness of fibromyalgia from dusk on May 12th until dawn on May 13th, 2023 and that the correspondence be received and filed. 5.c Elementary Literacy Moved by: Councillor Milner Seconded by: Councillor Bobbitt THAT the correspondence from Elementary Literacy be received and filed. Motion Carried 5.d 2023-02-07 Letter Honorable Rob Moore P.C. M.P. Fundy Royal Moved by: Councillor Nelson Seconded by: Councillor Brenan THAT the correspondence from the Honorable Rob Moore be received and filed. Motion Carried 5.e Rezoning Application - Lucy Creighton Subdivision The Council received a rezoning request from Don More Surveys. & Engineering Ltd. acting as a agent for Lucy Creighton to rezone the Lucy Creighton Property, PID 00201129 and a portion of the Lucy Creighton Property, PID 00461673 from the current zoning RA to R2. Moved by: Councillor Maguire Seconded by: Deputy Mayor Wilson THAT Council accept the rezoning request from Don -More Surveys & Engineering Ltd, acting as an agent for Lucy Creighton, the current property owner of PID 00201129 and PID 00461673 and forward :the application to the Administration Committee to start the rezoning process. Motion Carried 6. Fire Report Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT the Fire Report for the month of January 2023 be received as circulated. Motion Carried During the month the Fire Department responded to 24 calls, with 16 calls originating within Sussex and 8 calls outside of the boundaries of Sussex. 3 7. Building Inspector's Report Moved by: Councillor MacLeod Seconded by: Councillor Bobbitt THAT the Building Inspector's Report for the month of January 2023 be received as circulated. Motion Carried The report indicated that during the month the Building Inspector issued'6 permits for renovations, repairs, alterations and additions for a value of $121,501. 8. Development Officer's Report Moved by: Councillor Nelson Seconded by: Councillor Milner THAT the Development Officer's Report for the month of January, 2023 be received as circulated. Motion Carried The report indicated that during the month there were numerous enquiries relating to zoning and subdivision regulations but there were no plans submitted for approval. 9. Planning Advisory Committee Minutes The Planning Advisory Committee did not meet in February. 10. Unfinished Business: 10.a A By -Law To Amend Schedule "A" of A By -Law to Regulate Water, Sanitary and Storm Sewer Systems, By -Law #1203-10-11 10.a.1 Reading in it's Entirety Moved by: Deputy Mayor Wilson Seconded by: Councillor Milner THAT Council have a Reading in it's Entirety of A By -Law To Amend Schedule "A" of A By -Law to Regulate Water, Sanitary and Storm Sewer Systems, By -Law #1203-10-11 Motion Carried The Clerk then read the by-law by Summary. 10.a.2 3rd Reading by. Motion Carried Moved by: Councillor MacLeod Seconded by: Councillor Milner THAT Council authorize the closure of Broad Street on May 21, 2023, for as long as is deemed necessary for support of the 8th Hussars Anniversary event being held at the Intercolonial Railway Station., Motion Carried 5 Moved by: Councillor MacLeod Seconded by: Councillor Milner THAT Council accept the quotation of $41,675.43, HST included, from Hansen Signs for the supply and install of LED sign panels, locations to be determined at a later date. Memorandum of Understanding for the use of the Train Station by the 8th Hussars Museum for a 10 year period on behalf of the Town. Motion Carried Moved by: Councillor MacLeod Seconded by: Deputy Mayor Wilson THAT Council authorize the Mayor and Clerk to sign the updated Rental Agreement for the use of the Train Station by Sully's Ice Cream Parlour on behalf of the Town. Motion Carried 9 Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT Council award Tender T-01-23 Single Axle Plow/Dump Truck to the low bidder Applied Pressure Inc for the tender amount of $356,000 exclusive of HST, subject to Municipal Capital Borrowing Board approval. Motion Carried Moved by: Councillor Brenan Seconded by: Deputy Mayor Wilson THAT Council authorize the Municipality of Sussex submit to the Municipal Capital Borrowing Board an application for authorization to borrow for a capital expense for the following terms and amounts: Community Services: 8th Hussars Facility Upgrade at $180,000 for 10 years. Transportation Services: Plow/Dump Truck at $375,000 for 10 years. 2 Half -ton Trucks at $102,000 for 5 years. One -ton Truck c/w Plow at $125,000 for 10 years. Drainage Improvements - Maxwell Drive at $55,000 for 10 years. Traffic Lights, Signs, for Signals at $81,000 for 10 years. Utility Water: Watermain Extensions - Leonard Drive at $225,000 for 10 years. Water Quality - St. George Street at $125,000 for 10 years. Clerk's Office Job Motion Carried Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT Council adopt the draft Assistant Building Inspector / By-law Enforcement Officer Job Description as presented. Motion Carried 10 Moved by: Councillor Brenan Seconded by: Councillor Milner THAT Council adopt the draft Facilities Manager Job Description as presented. Motion Carried Moved by: Councillor Brenan Seconded by: Councillor MacLeod THAT Council hereby designate the Town Clerk to serve as the "Head of Public Body", that being Sussex pursuant to the right to Information and Protection of Privacy Act of the Province of New Brunswick; and Be it further resolved that the Council of Sussex acknowledge the Town Clerk as "Head of Public Body", may delegate in writing a duty orpower of the "Head of Public Body" under the Act for a member of the Municipal Staff, except the power to delegate, and can impose terms and conditions as considered appropriate and as prescribed under the Act. Roland Gagnon as members of the Planning Advisory Committee effective March 1, 2023 for a three-year term expiring in March 2026. New Business There was no new business before Council. 13. Open Discussion: Councillor Maguire expressed his sorrow upon hearing of the sudden passing of Peter Blakeney and sent condolences to his family on behalf of Council.; Mr. Blakeney was a valued member of the Sussex team for over 30 years in building inspection, by-law enforcement and public works, all being very demanding roles. He was a fixture in the community, giving countless hours of his time to the Sussex Lions Club and St. Johns United Church. Mayor Thorne echoed these comments adding that Peter always showed unwavering dedication to the community and spent many long nights monitoring river levels during flood events and street conditions during winter storm; season. Peter will be missed by many including past and present members of Council, staff and members of our community. 11 14.
