HomeMy Public PortalAboutTucelnuit _ Rockcliffe Sewer Connection Bylaw 1097TOWN OF OLIVER BYLAW NO. 1097 A Bylaw to Require Connection of Tucelnuit and Fairview/Rockcliffe Properties to the Municipal Sewer Service WHEREAS: A. The municipal sewer service was extended by the following specified area projects: (1) the Tucelnuit Sewer Extension, completed in 1994; and (2) the Fairview/Rockcliffe Sewer Extension, completed in 1995; B. At the completion of the above specified area projects, council did not impose a deadline for connection to the sewer service and some properties within each specified area remain not connected to the sewer service; C. Section 8(3)(a) of the Municipal Charter authorizes council, by bylaw, to set regulations and impose requirements in relation to municipal services; D. Council wishes to require the connection of existing improvements to the municipal sewer service; NOW THEREFORE, the council of the Town of Oliver, in open meeting assembled, ENACTS AS FOLLOWS: 1. This bylaw may be cited for all purposes as “Tucelnuit and Rockcliffe Sewer Connection By- law No. 1097, 2004.” 2. Any owner of land within the specified area established by Tucelnuit Area Sewer Bylaw No. 602, 1991 must connect all plumbing fixtures on their property to the municipal sewer ser- vice, at the owner’s expense, not later than December 31, 2005. 3. Any owner of land within the specified area established by Fairview/Rockcliffe Area Sewer Bylaw No. 603, 1991 must connect all plumbing fixtures on their property to the municipal sewer service, at the owner’s expense, not later than December 31, 2006. 4. Any person who is connecting to the municipal sewer service must comply with all other ap- plicable enactments. 5. Commencing on the dates set out in sections 3 and 4 of this bylaw, all properties described in sections 3 and 4, which have any improvements containing plumbing fixtures, will be levied the annual sewer user fees prescribed by the sewer fee bylaw as amended from time to time, regardless of whether or not plumbing fixtures on the properties are connected to the munici- pal sewer service. Any person who fails to comply with the requirements of this bylaw is guilty of an offence and on conviction is liable for a fine not less than $100 and not more than $2,000, or to im- prisonment for not more than 6 months, or both a fine and imprisonment. 7. Any violation of this bylaw that continues for a period in excess of 30 days is a new and sep- arate offence. Read a first, second and third time on the 12th day of July, 2004.
