HomeMy Public PortalAboutUniversal Water Metering Bylaw 1237Town of Oliver Bylaw 1237 A bylaw to require the installation of water meters on certain properties receiving the Town of Oliver’s water supply service located inside the municipal boundaries and in Rural Water Systems 2 and 5 WHEREAS: A. The Town of Oliver owns and operates a water supply and distribution service within its municipal boundaries and within Electoral Area C of the Regional District of Okanagan- Similkameen; and B. Council of the Town of Oliver desires to have a water meter installed on each property that receives the Town’s water supply service for non-agricultural use located within the Town’s boundaries and within those portions of Electoral Area C identified as Systems 2 and 5; NOW THEREFORE, the Council of the Town of Oliver, in open meeting assembled, ENACTS AS FOLLOWS: Citation 1. This bylaw may be cited for all purposes as “Universal Water Metering Bylaw 1237”. Definitions 2. In this bylaw: “agricultural irrigation” means seasonal irrigation of agricultural crops grown out-doors, on land that has been assessed “Class 9 – Farm” by the BC Assessment Authority. “director” means the person appointed by council as the Director of Operations and includes employees, contractors or agents working under the supervision or direction of the director for the purpose of administering or enforcing this bylaw. “owner” means the registered owner of a parcel of real property which is serviced or planned to be serviced by the public water system. “private water system” means any system of pipes and fittings to distribute water within a property or a building which is not operated by the Town as part of the public water system, but which obtains its water supply from the public water system. “public water system” means the system of physical works used to supply water under this bylaw and shall include all wells, dams, canals, pipelines, buildings, motors, pumps, Universal Water Metering Bylaw 1237 Page 2 electrical and electronic controls valves, fittings and all other such devices and appurtenances used in the delivery of water by the Town. “Rural Water System 2” means that area in RDOS Electoral Area C located south of the Town and east of the Okanagan River; “Rural Water System 5” means that area in RDOS Electoral Area C located south of the Town, west of Highway 97 and shown outlined in dashed black on the map attached as Schedule “A”; “universal metering area” means all properties within the municipal boundaries of the Town of Oliver, Rural Water System 2 and Rural Water System 5; “water meter” means an apparatus or device used for measuring the volume of water passing through it; “water supply service” means the municipal service of procuring, treating, selling and delivering water to members of the public. Universal Metering Area 3. A water meter shall be installed by July 31, 2009 on each property that receives the Town’s water supply service within the universal metering area and which does not already have a water meter installed pursuant to any other bylaw.. 4. Section 3 does not apply to private water systems within the universal metering area that use the Town’s water supply service only for agricultural irrigation. Installation of Water Meter 5. Every water meter shall be installed by the Town or by the Town’s agent or contractor. Water Meter Size and Location 6. The most appropriate size and location of each meter to be placed within a building or at another location on private property shall be determined by the director so that all water supplied by the Town’s water supply service for that property is measured by the water meter. Cost of Water Meters 7. Subject to sections 8, 9 and 10, the Town shall be responsible for the cost of supplying and installing water meters on private property pursuant to this bylaw. For clarity, water meters installed for new construction, change of use or plumbing service modifications pursuant Water Meter Installation Bylaw No. 1059, 2003 shall continue to be installed at the owner’s expense. Alternate Meter Location 9. If an owner fails or refuses to allow the Town access onto their property for the purposes of installing a water meter by July 31, 2009, the director may authorize the installation of a meter pit and an underground water meter within the public road right of way or other public land at or near the junction of the public water system and the private water system for the property. Fees for Water Meters on Public Property 10. In the event a meter pit and underground water meter is installed on the public road right of way or other public land under section 8, the property owner shall pay to the Town the applicable fee, set out below, representing the average additional cost of installing a water meter on the public road right of way or other public land calculated as the difference between a water meter installed inside a building on private property and a similar-sized water meter installed in a meter pit on the public road right of way or other public land: (1) 5/8” meter: $750 (2) 3/4” meter: $800 (3) 1” meter: $1,400 (4) 1.5” meter: $3,000 (5) 2” meter: $6,000 Unpaid Fees Transferred to Taxes 11. The fees levied under section 10 are in addition to other water fees and charges levied under the Town’s other bylaws, and if unpaid by December 31st of the year they are levied, shall be deemed to be taxes in arrears against the property to which they apply. Meters are Town Property 12. All water meters installed under this bylaw shall at all times remain the property of the Town of Oliver, regardless of whether they are installed on private or public property. Read a first, and second time on the 23rd day of February, 2009. Read a third time by unanimous consent of all members of council on the 9th day of March, 2009.
