HomeMy Public PortalAboutWater Service Establishment Bylaw 1066Town of Oliver Bylaw No. 1066 A bylaw to establish a water supply service operated by the Town of Oliver WHEREAS: A. The Town of Oliver owns and operates water supply and distribution facilities within its municipal boundaries and within Electoral Area C of the Regional District of Okanagan- Similkameen; B. By Order of the Lieutenant Governor in Council number 1870 (“OIC 1870”), dated December 15, 1989 and validated by section 1 of the Municipal Enabling and Validating Act (No. 2) [SBC 1990] Chapter 61, the Town of Oliver was granted the authority to operate a public water system outside its municipal boundaries including the right to enforce, amend or repeal bylaws of the former South Okanagan Lands Irrigation District (“SOLID”) in the same manner as if they were enacted by the municipality; and C. Council desires to consolidate its water supply operations into a single service for the purpose of establishing a simplified set of regulations to apply throughout its water service area; NOW THEREFORE, the Council of the Town of Oliver, in open meeting assembled, ENACTS AS FOLLOWS: Citation 1. This bylaw may be cited for all purposes as “Water Service Establishment Bylaw No. 1066, 2003”. Establishment of service 2. Council hereby establishes the supply of water as a service pursuant to section 517.1 of the Local Government Act. Operation outside municipal boundaries 3. The supply of water herein established as a service shall operate: (1) inside the municipal boundaries of the Town of Oliver; and (2) outside municipal boundaries, in Electoral Area C of the Regional District of Okanagan-Similkameen. For clarity, establishment of a single water service under this bylaw shall not be interpreted as diminishing or canceling any of the rights granted to the Town by OIC 1870. Read a first, second and third time on the 14th day of October, 2003 Approved by the Inspector of Municipalities on the 18th day of December, 2003. Pursuant section 518(1)(b) of the Local Government Act, consent to this bylaw was granted by resolution of the board of the Regional District of Okanagan-Similkameen, on the 20th day of November, 2003.
